Aviso do Chefe do Executivo n.º 88/2011

O Governo do Estado da Eritreia e o Governo da República Popular da China concluíram, por troca de notas, o acordo relativo à nomeação de um cônsul honorário do Estado da Eritreia na Região Administrativa Especial de Hong Kong da República Popular da China. Neste sentido, o Chefe do Executivo manda publicar, nos termos do n.º 1 do artigo 6.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, por ordem do Governo Popular Central, a Nota do Governo do Estado da Eritreia no seu texto autêntico em língua inglesa e a Nota do Governo da República Popular da China no seu texto autêntico em língua chinesa.

Em conformidade com o disposto no referido acordo, o Governo do Estado da Eritreia nomeia um cônsul honorário na Região Administrativa Especial de Hong Kong da República Popular da China, cuja área de jurisdição consular inclui a Região Administrativa Especial de Hong Kong e a Região Administrativa Especial de Macau.

Mais se torna público que o referido acordo entrou em vigor em 10 de Agosto de 2005.

The Embassy of the State of Eritrea presents its compliments to the Ministry of the Foreign Affairs of the People’s Republic of China and has the honour to confirm the following on behalf of the government of the State of Eritrea:

The Government of the State of Eritrea and the Government of the People’s Republic of China,

Desirous of developing friendly relations between the two countries,

With regard to the appointment of the honorary consul in Hong Kong by the Government of the State of Eritrea, and

Through friendly consultations,

Have agreed as follows:

1. The Government of the People’s Republic of China agrees to the appointment of an honorary consul in Hong Kong by the Government of the State of Eritrea, whose consular district shall cover the Hong Kong Special Administrative Region (HKSAR) and Macao Special Administrative Region (MSAR).

2. The honorary consul of the State of Eritrea in Hong Kong shall exercise his or her consular functions within the scope as defined in The Vienna Convention on Consular Relations done on 24 April 1963, the relevant laws and regulations of the People’s Republic of China, including the laws of HKSAR and MSAR.

3. The Government of the People’s Republic of China will, in accordance with The Vienna Convention on Consular Relations done on 24 April 1963 and the relevant laws and regulations of the People’s Republic of China, accord necessary assistance and facilities for the performance of the functions of the honorary consul of the State of Eritrea in Hong Kong.

4. The honorary consul of the State of Eritrea in Hong Kong should be a permanent resident of HKSAR.

5. The State of Eritrea shall not maintain the honorary consular post upon its establishment of a career consular post in Hong Kong.

6. The two sides shall properly handle consular issues between the two countries in the spirit of friendly consultations, and in accordance with The Vienna Convention on Consular Relations and international practice.

If the Ministry of the Foreign Affairs of the People’s Republic of China confirms, on behalf of the Government of the People’s Republic of China, the foregoing points in a note of reply, this note and the Ministry’s note of reply shall constitute an agreement between the two governments, which shall come into force as from the date of the note of reply.
