第61/2011號行政長官公告

捷克共和國政府與中華人民共和國政府以換文方式就捷克共和國在中華人民共和國香港特別行政區保留總領事館達成諒解。按照中央人民政府的命令，行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定，命令公佈捷克共和國政府照會的英文正式文本及中華人民共和國政府照會的中文正式文本。

根據上述諒解，自一九九九年十二月二十日中華人民共和國政府恢復對澳門行使主權之日起，捷克共和國駐中華人民共和國香港特別行政區總領事館亦可在澳門特別行政區執行領事職務。

　The Embassy of the Czech Republic in China presents its compliments to the Ministry of Foreign Affairs of the People’s Republic of China, and with reference to the recent diplomatic talks held between the two countries on the maintenance of the Consulate General of the Czech Republic in the Hong Kong Special Administrative Region of the People’s Republic of China, has the honour to propose the following understanding between the Governments of the two countries:

1. The Government of the People’s Republic of China agrees to the maintenance by the Government of the Czech Republic of its Consulate General in the Hong Kong Special Administrative Region of the People’s Republic of China.

2. The Government of the People’s Republic of China agrees that the Consulate General of the Czech Republic in the Hong Kong Special Administrative Region of the People’s Republic of China may also perform consular functions in Macao, after the Government of the People’s Republic of China resumes the exercise of sovereignity over Macao with effect from December 20, 1999.

3. The operations of the Consulate General of the Czech Republic in the Hong Kong Special Administrative Region of the People’s Republic of China shall be regulated by the Vienna Conventions of April 24, 1963. Consular affairs shall be dealt with on the principle of equality and mutual benefit and in a spirit of friendship and cooperation.

The Embassy of the Czech Republic in China has further honour to request the Ministry of Foreign Affairs of the People’s Republic of China to confirm the agreement of the Government of the People’s Republic of China with above principles.

The present Note together with the affirmative Note in reply from the esteemed Ministry of Foreign Affairs of the People’s Republic of China shall constitute an understanding between the Government of the Czech Republic and the Government of the People’s Republic of China which shall enter into effect on July 1, 1997.

The Embassy of the Czech Republic in China avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the People’s Republic of China the assurances of its highest consideration.

中華人民共和國外交部向捷克共和國駐華大使館致意並榮幸地收到大使館一九九七年六月二十五日第3250/97號照會，內容如下：

“捷克共和國駐華大使館向中華人民共和國外交部致意並謹提及我們兩國近期關於在中華人民共和國香港特別行政區保留捷克共和國總領事館的外交會談，謹建議兩國政府達成 如下諒解：

一、中華人民共和國政府同意捷克共和國政府在中華人民共和國香港特別行政區保留其總領事館。

二、中華人民共和國政府同意自一九九九年十二月二十日中華人民共和國政府恢復對澳門行使主權之日起，捷克共和國駐中華人民共和國香港特別行政區總領事館亦可在澳門執 行領事職務。

三、捷克共和國駐中華人民共和國香港特別行政區總領事館的運作應遵循一九六三年四月二十四日《維也納領事關係公約》。領事事務本着友好合作的精神和平等互利的原則予 以處理。

捷克共和國駐華大使館謹請求中華人民共和國外交部確認中華人民共和國政府同意上述原則。

本照會與中華人民共和國外交部的確認覆照將構成捷克共和國政府和中華人民共和國政府間的一項諒解，並自一九九七年七月一日起生效。”

中華人民共和國外交部謹代表中華人民共和國政府確認同意上述照會內容。
