    Nos termos da alínea c) do n.º 1 do artigo 200.º da Constituição, o Governo decreta o seguinte:

    Artigo único. É aprovada, para ratificação, a Convenção Quadro sobre Alterações Climáticas, adoptada em 9 de Maio de 1992 pelo Comité Intergovernamental de Negociação instituído pela Assembleia Geral das Nações Unidas e aberta à assinatura em 4 de Junho de 1992 na Conferência das Nações Unidas sobre o Ambiente e Desenvolvimento, cujo texto original em inglês e a respectiva tradução para português seguem em anexo ao presente decreto.

    UNITED NATIONS FRAMEWORK CONVENTION ON CLIMATE CHANGE

    The Parties to this Convention:

    Acknowledging that change in the Earth's climate and its adverse effects are a common concern of humankind;

    Concerned that human activities have been substantially increasing the atmospheric concentrations of greenhouse gases, that these increases enhance the natural greenhouse effect, and that this will result on average in an additional warming of the Earth's surface and atmosphere and may adversely affect natural ecosystems and humankind;

    Nothing that the largest share of historical and current global emissions of greenhouse gases has originated in developed countries, that per capita emissions in developing countries are still relatively low and that the share of global emissions originating in developing countries will grow to meet their social and development needs;

    Aware of the role and importance in terrestrial and marine ecosystems of sinks and reservoirs of greenhouse gases,

    Nothing that there are many uncertainties in predictions of climate change, particularly with regard to the timing, magnitude and regional patterns thereof;

    Acknowleding that the global nature of climate change calls for the widest possible cooperation by all countries and their participation in an effective and appropriate international response, in accordance with their common but differentiated responsibilities and respective capabilities and their social and economic conditions;

    Recalling the pertinent provisions of the Declaration of the United Nations Conference on the Human Environment, adopted at Stockholm on 16 June 1972;

    Recalling also that States have, in accordance with the Charter of the United Nations and the principles of international law, the sovereing right to exploit their own resources pursuant to their own environmental and developmental policies, and the responsibility to ensure that activities within their jurisdiction or control do note cause damage to the environment of other States or of areas beyond the limits of national jurisdiction;

    Reaffirming the principle of sovereignty of States in international cooperation to address climate change;

    Recognizing that States should enact effective environmental legislation, that environmental standards, management objectives and priorities should reflect the environmental and developmental context to which they apply, and that standards applied by some countries may be inappropriate and of unwarranted economic and social cost to other countries, in particular developing countries;

    Recalling the provisions of General Assembly resolution 44/228, of 22 December 1989, on the United Nations Conference on Environment and Development, and resolutions 43/53 of 6 December 1988, 44/207, of 22 December 1989, 45/212, of 21 December 1990, and 46/169, of 19 December 1991, on protection of global climate for present and future generations of mankind;

    Recalling also the provisions of General Assembly Resolution 44/206, of 22 December 1989, on the possible adverse effects of sealevel rise on islands and coastal areas, particularly low-lying coastal areas and the pertinent provisions of General Assembly Resolution 44/172, of 19 December 1989, on the implementation of the Plan of Action to Combat Desertification;

    Recalling further the Vienna Convention for the Protection of the Ozone Layer, 1985, and the Montreal Protocol on Substances that Deplete the Ozone Layer, 1987, as adjusted and amended on 29 June 1990;

    Noting the Ministerial Declaration of the Second World Climate Conference adopted on 7 November 1990;

    Conscious of the valuable analytical work being conducted by many States on climate change and of the important contributions of the World Meteorological Organization, the United Nations Environment Programme and other organs, organizations and bodies of the United Nations system, as well as other international and intergovernmental bodies, to the exchange of results of scientific research and the coordination of research;

    Recognizing that steps required to understand and address climate change will be environmentally, socially and economically most effective if they are based on relevant scientific, technical and economic considerations and continually re-evaluated in the light of new findings in these areas;

    Recognizing that various actions to address climate change can be justified economically in their own right and can also help in solving other environmental problems;

    Recognizing also the need for developed countries to take immediate action in a flexible manner on the basis of clear priorities, as a first step towards comprehensive response strategies at the global, national and, where agreed, regional levels that take into account all greenhouse gases, with due consideration of their relative contributions to the enhancement of the greenhouse effect;

    Recognizing further that low-lying and other small island countries, countries with low-lying coastal, arid and semi-arid areas or areas liable to floods, drought and desertification, and developing countries with fragile mountainous ecosystems are particularly vulnerable to the adverse effects of climate change;

    Recognizing the special difficulties of those countries, especially developing countries, whose economies are particularly dependent on fossil fuel production, use and exportation, as a consequence of action taken on limiting greenhouse gas emissions;

    Affirming that responses to climate change should be coordinated with social and economic development in an integrated manner with a view to avoiding adverse impacts on the latter, taking into full account the legitimate priority needs of developing countries for the achievement of sustained economic growth and the eradication of poverty;

    Recognizing that all countries, especially developing countries, need access to resources required to achieve sustainable social and economic development and that, in order for developing countries to progress towards that goal, their energy consumption will need to grow taking into account the possibilities for achieving greater energy efficiency and for controlling greenhouse gas emissions in general, including through the application of new technologies on terms which make such an application economically and socially beneficial;

    Determined to protect the climate system for present and future generations;

    have agreed as follows:

    ARTICLE 1

    Definitions (*)

    (*) Titles of articles are included solely to assist the reader.

    For the purposes of this Convention:

    1) «Adverse effects of climate change» means changes in the physical environment or biota resulting from climate change which have significant deleterious effects on the composition, resilience or productivity of natural and managed ecosystems or on the operation of socio-economic systems or on human health and welfare;

    2) «Climate change» means a change of climate which is attributed directly or indirectly to human activity that alters the composition of the global atmosphere and which is in addition to natural climate variability observed over comparable time periods;

    3) «Climate system» means the totality of the atmosphere, hydrosphere, biosphere and geosphere and their interactions;

    4) «Emissions» means the release of greenhouse gases and/or their precursors into the atmosphere over a specified area and period of time;

    5) «Greenhouse gases» means those gaseous constituents of the atmosphere, both natural and anthropogenic, that absorb and re-emit infrared radiation;

    6) «Regional economic integration organization» means an organization constituted by sovereign States of a given region which has competence in respect of matters governed by this Convention or its protocols and has been duly authorized, in accordance with its internal procedures, to sign, ratify, accept, approve or accede to the instruments concerned;

    7) «Reservoir» means a component or components of the climate system where a greenhouse gas or a precursor of a grenhouse gas is stored;

    8) «Sink» means any process, activity or mechanism which removes a greenhouse gas, an aerosol or a precursor of a greenhouse gas from the atmosphere;

    9) «Source» means any process or activity which releases a greenhouse gas, an aerosol or a precursor of a greenhouse gas into the atmosphere.

    ARTICLE 2

    Objective

    The ultimate objective of this Convention and any related legal instruments that the Conference of the Parties may adopt is to achieve, in accordance with the relevant provisions of the Convention, stabilization of greenhouse gas concentrations in the atmosphere at a level that would prevent dangerous anthropogenic interference with the climate system. Such a level should be achieved within a time-frame sufficient to allow ecosystems to adapt naturally to climate change, to ensure that food production is not threatened and to enable economic development to proceed in a sustainable manner.

    ARTICLE 3

    Principles

    In their actions to achieve the objective of the Convention and to implement its provisions, the Parties shall be guided, inter alia, by the following:

    1) The Parties should protect the climate system for the benefit of present and future generations of humankind, on the basis of equity and in accordance with their common but differentiated responsibilities and respective capabilities. Accordingly, the developed country Parties should take the lead in combating climate change and the adverse effects thereof;

    2) The specific needs and special circumstances of developing country Parties, especially those that are particularly vulnerable to the adverse effects of climate change, and of those Parties, especially developing country Parties, that would have to bear a disproportionate or abnormal burden under the Convention, should be given full consideration;

    3) The Parties should take precautionary measures to anticipate, prevent or minimize the causes of climate change and mitigate its adverse effects. Where there are threats of serious or irreversible damage, lack of full scientific certainty should not be used as a reason for postponing such measures, taking into account that policies and measures to deal with climate change should be cost-effective so as to ensure global benefits at the lowest possible cost. To achieve this, such policies and measures should take into account different socio-economic contexts, be comprehensive, cover all relevant sources, sinks and reservoirs of greenhouse gases and adaptation, and comprise all economic sectors. Efforts to address climate change may be carried out cooperatively by interested Parties;

    4) The Parties have a right to, and should, promote sustainable development. Policies and measures to protect the climate system against human-induced change should be appropriate for the specific conditions of each Party and should be integrated with national development programmes, taking into account that economic development is essential for adopting measures to address climate change;

    5) The Parties should cooperate to promote a supportive and open international economic system that would lead to sustainable economic growth and development in all Parties, particularly developing country Parties, thus enabling them better to address the problems of climate change. Measures taken to combat climate change, including unilateral ones, should not constitute a means of arbitrary or unjustifiable discrimination or a disguised restriction on international trade.

    ARTICLE 4

    Commitments

    1— All Parties, taking into account their common but differentiated responsibilities and their specific national and regional development priorities, objectives and circumstances, shall:

    a) Develop, periodically update, publish and make available to the Conference of the Parties, in accordance with article 12, national inventories of anthropogenic emissions by sources and removals by sinks of all greenhouse gases not controlled by the Montreal Protocol, using comparable methodologies to be agreed upon by the Conference of the Parties;

    b) Formulate, implement, publish and regularly update national and, where appropriate, regional programmes containing measures to mitigate climate change by addressing anthropogenic emissions by sources and removals by sinks of all greenhouse gases not controlled by the Montreal Protocol, and measures to facilitate adequate adaptation to climate change;

    c) Promote and cooperate in the development, application and diffusion, including transfer, of technologies, practices and processes that control, reduce or prevent anthropogenic emissions of greenhouse gases not controlled by the Montreal Protocol in all relevant sectors, including the energy, transport, industry, agriculture, forestry and waste management sectors;

    d) Promote sustainable management, and promote and cooperate in the conservation and enhancement, as appropriate, of sinks and reservoirs of all greenhouse gases not controlled by the Montreal Protocol, including biomass, forests and oceans as well as other terrestrial, coastal and marine ecosystems;

    e) Cooperate in preparing for adaptation to the impacts of climate change; develop and elaborate appropriate and integrated plans for coastal zone management, water resources and agriculture, and for the protection and rehabilitation of areas, particularly in Africa, affected by drought and desertification, as well as floods;

    f) Take climate change considerations into account, to the extent feasible, in their relevant social, economic and environmental policies and actions, and employ appropriate methods, for example impact assessments, formulated and determined nationally, with a view to minimizing adverse effects on the economy, on public health and on the quality of the environment, of projects or measures undertaken by them to mitigate or adapt to climate change;

    g) Promote and cooperate in scientific, technological, technical, socio-economic and other research, systematic observation and development of data archives related to the climate system and intended to further the understanding and to reduce or eliminate the remaining uncertainties regarding the causes, effects, magnitude and timing of climate change and the economic and social consequences of various response strategies;

    h) Promote and cooperate in the full, open and prompt exchange of relevant scientific, technological, technical, socio-economic and legal information related to the climate system and climate change, and to the economic and social consequences of various response strategies;

    i) Promote and cooperate in education, training and public awareness related to climate change and encourage the widest participation in this process, including that of non-governmental organizations, and

    j) Communicate to the Conference of the Parties information related to implementation, in accordance with article 12.

    2 — The developed country Parties and other Parties included in annex I commit themselves specifically as provided for in the following:

    a) Each of these Parties shall adopt national (1) policies and take corresponding measures on the mitigation of climate change, by limiting its anthropogenic emissions of greenhouse gases and protecting and enhancing its greenhouse gas sinks and reservoirs. These policies and measures will demonstrate that developed countries are taking the lead in modifying longer-term trends in anthropogenic emissions consistent with the objective of the Convention, recognizing that the return by the end of the present decade to earlier levels of anthropogenic emissions of carbon dioxide and other greenhouse gases not controlled by the Montreal Protocol would contribute to such modification, and taking into account the differences in these Parties, starting points and approaches, economic structures and resource bases, the need to maintain strong and sustainable economic growth, available technologies and other individual circumstances, as well as the need for equitable and appropriate contributions by each of these Parties to the global effort regarding that objective. These Parties may implement such policies and measures jointly with other Parties and may assist other Parties in contributing to the achievement of the objective of the Convention and, in particular, that of this subparagraph;

    (1) This includes policies and measures adopted by regional economic integration organizations.

    b) In order to promote progress to this end, each of these Parties shall communicate, within six months of the entry into force of the Convention for it and periodically thereafter, and in accordance with article 12, detailed information on its policies and measures referred to in subparagraph a) above, as well as on its resulting projected anthropogenic emissions by sources and removals by sinks of greenhouse gases not controlled by the Montreal Protocol for the period referred to in subparagraph a), with the aim of returning individually or jointly to their 1990 levels these anthropogenic emissions of carbon dioxide and other greenhouse gases not controlled by the Montreal Protocol. This information will be reviewed by the Conference of the Parties, at its first session and periodically thereafter, in accordance with article 7;

    c) Calculations of emissions by sources and removals by sinks of greenhouse gases for the purposes of subparagraph b) above should take into account the best available scientific knowledge, including of the effective capacity of sinks and the respective contributions of such gases to climate change. The Conference of the Parties shall consider and agree on methodologies for theses calculations at its first session and review them regularly thereafter;

    d) The Conference of the Parties shall, at its first session, review the adequacy of subparagraphs a) and b) above. Such review shall be carried out in the light of the best available scientific information and assessment on climate change and its impacts, as well as relevant technical, social and economic information. Based on this review, the Conference of the Parties shall take appropriate action, which may include the adoption of amendments to the commitments in subparagraphs a) and b) above. The Conference of the Parties, at its first session, shall also take decisions regarding criteria for joint implementation as indicated in subparagraph a) above. A second review of subparagraphs a) and b) shall take place not later than 31 December 1998, and thereafter at regular intervals determined by the Conference of the Parties, until the objective of the Convention is met;

    e) Each of these Parties shall:

    i) Coordinate as appropriate with other such Parties, relevant economic and administrative instruments developed to achieve the objective of the Convention; and

    ii) Identify and periodically review its own policies and practices which encourage activities that lead to greater levels of anthropogenic emissions of greenhouse gases not controlled by the Montreal Protocol than would otherwise occur;

    f) The Conference of the Parties shall review, not later than 31 December 1998, available information with a view to taking decisions regarding such amendments to the lists in annexes I and II as may be appropriate, with the approval of the Party concerned;

    g) Any Party not included in annex I may, in its instrument of ratification, acceptance, approval or accession, or at any time thereafter, notify the Depositary that it intends to be bound by subparagraphs a) and b) above. The depositary shall inform the other signatories and Parties of any such notification.

    3 — The developed country Parties and other developed Parties included in annex II shall provide new and additional financial resources to meet the agreed full costs incurred by developing country Parties in complying with their obligations under article 12, paragraph 1. They shall also provide such financial resources, including for the transfer of technology, needed by the developing country Parties to meet the agreed full incremental costs of implementing measures that are covered by paragraph 1 of this article and that are agreed between a developing country Party and the international entity or entities referred to in article 11, in accordance with that article. The implementation of these commitments shall take into account the need for adequacy and predictability in the flow of funds and the importance of appropriate burden sharing among the developed country Parties.

    4 — The developed country Parties and other developed Parties included in annex II shall also assist the developing country Parties that are particularly vulnerable to the adverse effects of climate change in meeting costs of adaptation to those adverse effects.

    5 — The developed country Parties and other developed Parties included in annex II shall take all practicable steps to promote, facilitate and finance, as appropriate, the transfer of, or access to, environmentally sound technologies and know-how to other Parties, particularly developing country Parties, to enable them to implement the provisions of the Convention. In this process, the developed country Parties shall support the development and enhancement of endogenous capacities and technologies of developing country Parties. Other Parties and organizations in a position to do so may also assist in facilitating the transfer of such technologies.

    6 — In the implementation of their commitments under paragraph 2 above, a certain degree of flexibility shall be allowed by the Conference of the Parties to the Parties included in annex I undergoing the process of transition to a market economy, in order to enhance the ability of these Parties to address climate change, including with regard to the historical level of anthropogenic emissions of greenhouse gases not controlled by the Montreal Protocol chosen as a reference.

    7 — The extent to which developing country Parties will effectively implement their commitments under the Convention will depend on the effective implementation by developed country Parties of their commitments under the Convention related to financial resources and transfer of technology and will take full into account that economic and social development and poverty eradication are the first and overriding priorities of the developing country Parties.

    8 — In the implementation of the commitments in this article, the Parties shall give full consideration to what actions are necessary under the Convention, including actions related to funding, insurance and the transfer of technology, to meet the specific needs and concerns of developing country Parties arising from the adverse effects of climate change and/or the impact of the implementation of response measures, especially on:

    a) Small island countries;

    b) Countries with low-lying coastal areas;

    c) Countries with arid and semi-arid areas, forested areas and areas liable to forest decay;

    d) Countries with areas prone to natural disasters;

    e) Countries with areas liable to drought and desertification;

    f) Countries with areas of high urban atmospheric pollution;

    g) Countries with areas with fragile ecosystems, including mountainous ecosystems;

    h) Countries whose economies are highly dependent on income generated from the production, processing and export, and/or on consumption of fossil fuels and associated energy-intensive products; and

    i) Land-locked and transit countries.

    Further, the Conference of the Parties may take actions, as appropriate, with respect to this paragraph.

    9 — The Parties shall take full account of the specific needs and special situations of the least developed countries in their actions with regard to funding and transfer of technology.

    10 — The Parties shall, in accordance with article 10, take into consideration in the implementation of the commitments of the Convention the situation of Parties, particularly developing country Parties, with economies that are vulnerable to the adverse effects of the implementation of measures to respond to climate change. This applies notably to Parties with economies that are highly dependent on income generated from the production, processing and export, and/or consumption of fossil fuels and associated energy-intensive products and/or the use of fossil fuels for which such Parties have serious difficulties in switching to alternatives.

    ARTICLE 5

    Research and systematic observation

    In carrying out their commitments under article 4, paragraph 1, g), the Parties shall:

    a) Support and further develop, as appropriate, international and intergovernmental programmes and networks or organizations aimed at defining, conducting, assessing and financing research, data collection and systematic observation, taking into account the need to minimize duplication of effort;

    b) Support international and intergovernmental efforts to strengthen systematic observation and national scientific and technical research capacities and capabilities, particularly in developing countries, and to promote access to, and the exchange of, data and analyses thereof obtained from areas beyond national jurisdiction; and

    c) Take into account the particular concerns and needs of developing countries and cooperate in improving their endogenous capacities and capabilities to participate in the efforts referred to in subparagraphs a) and b) above.

    ARTICLE 6

    Education, training and public awareness

    In carrying out their commitments under article 4, paragraph 1, i), the Parties shall:

    a) Promote and facilitate at the national and, as appropriate, subregional and regional levels, and in accordance with national laws and regulations, and within their respective capacities:

    i) The development and implementation of educational and public awareness programmes on climate change and its effects;

    ii) Public access to information on climate change and its effects;

    iii) Public participation in addressing climate change and its effects and developing adequate responses; and

    iv) Training of scientific, technical and managerial personnel;

    b) Cooperate in and promote, at the international level, and, where appropriate, using existing bodies:

    i) The development and exchange of educational and public awareness material on climate change and its effects; and

    ii) The development and implementation of education and training programmes, including the strengthening of national institutions and the exchange or secondment of personnel to train experts in this field, in particular for developing countries.

    ARTICLE 7

    Conference of the Parties

    1 — A Conference of the Parties is hereby established.

    2 — The Conference of the Parties, as the supreme body of this Convention, shall keep under regular review the implementation of the Convention and any related legal instruments that the Conference of the Parties may adopt, and shall make, within its mandate, the decisions necessary to promote the effective implementation of the Convention. To this end, it shall:

    a) Periodically examine the obligations of the Parties and the institutional arrangements under the Convention, in the light of the objective of the Convention, the experience gained in its implementation and the evolution of scientific and technological knowledge;

    b) Promote and facilitate the exchange of information on measures adopted by the Parties to address climate change and its effects, taking into account the differing circumstances, responsibilities and capabilities of the Parties and their respective commitments under the Convention;

    c) Facilitate, at the request of two or more Parties, the coordination of measures adopted by them to address climate change and its effects, taking into account the differing circumstances, responsibilities and capabilities of the Parties and their respective commitments under the Convention;

    d) Promote and guide, in accordance with the objective and provisions of the Convention, the development and periodic refinement of comparable methodologies, to be agreed on by the Conference of the Parties, inter alia, for preparing inventories of greenhouse gas emissions by sources and removals by sinks, and for evaluating the effectiveness of measures to limit the emissions and enhance the removals of these gases;

    e) Assess, on the basis of all information made available to it in accordance with the provisions of the Convention, the implementation of the Convention by the Parties, the overall effects of the measures taken pursuant to the Convention, in particular environmental, economic and social effects as well as their cumulative impacts and the extent to which progress towards the objective of the Convention is being achieved;

    f) Consider and adopt regular reports on the implementation of the Convention and ensure their publication;

    g) Make recommendations on any matters necessary for the implementation of the Convention;

    h) Seek to mobilize financial resources in accordance with article 4, paragraphs 3, 4 and 5, and article 11;

    i) Establish such subsidiary bodies as are deemed necessary for the implementation of the Convention;

    j) Review reports submitted by its subsidiary bodies and provide guidance to them;

    k) Agree upon and adopt, by consensus, rules of procedure and financial rules for itself and for any subsidiary bodies;

    l) Seek and utilize, where appropriate, the services and cooperation of, and information provided by, competent international organizations and intergovernmental and non-governmental bodies; and

    m) Exercise such other functions as are required for the achievement of the objective of the Convention as well as all other functions assigned to it under the Convention.

    3 — The Conference of the Parties shall, at its first session, adopt its own rules of procedure as well as those of the subsidiary bodies established by the Convention, which shall include decision-making procedures of matters not already covered by decision-making procedures stipulated in the Convention. Such procedures may include specified majorities required for the adoption of particular decisions.

    4 — The first session of the Conference of the Parties shall be convened by the interim secretariat referred to in article 21 and shall take place not later than one year after the date of entry into force of the Convention. Thereafter, ordinary sessions of the Conference of the Parties shall be held every year unless otherwise decided by the Conference of the Parties.

    5 — Extraordinary sessions of the Conference of the Parties shall be held at such other times as may be deemed necessary by the Conference, or at the written request of any Party, provided that, within six months of the request being communicated to the Parties by the secretariat, it is supported by at least one-third of the Parties.

    6 — The United Nations, its specialized agencies and the International Atomic Energy Agency, as well as any State member thereof or observers thereto not Party to the Convention, may be represented at sessions of the Conference of the Parties as observers. Any body or agency, whether national or international, governmental or non-governmental, which is qualified in matters covered by the Convention, and which has informed the secretariat of its wish to be represented at a session of the Conference of the Parties as an observer, may be so admitted unless at least one-third of the Parties present object. The admission and participation of observers shall be subject to the rules of procedure adopted by the Conference of the Parties.

    ARTICLE 8

    Secretariat

    1 — A secretariat is hereby established.

    2 — The functions of the secretariat shall be:

    a) To make arrangements for sessions of the Conference of the Parties and its subsidiary bodies established under the Convention and to provide them with services as required;

    b) To compile and transmit reports submitted to it;

    c) To facilitate assistance to the Parties, particularly developing country Parties, on request, in the compilation and communication of information required in accordance with the provisions of the Convention;

    d) To prepare reports on its activities and present them to the Conference of the Parties;

    e) To ensure the necessary coordination with the secretariats of other relevant international bodies;

    f) To enter, under the overall guidance of the Conference of the Parties, into such administrative and contractual arrangements as may be required for the effective discharge of its functions; and

    g) To perform the other secretariat functions specified in the Convention and in any of its protocols and such other functions as may be determined by the Conference of the Parties.

    3 — The Conference of the Parties, at its first session, shall designate a permanent secretariat and make arrangements for its functioning.

    ARTICLE 9

    Subsidiary body for scientific and technological advice

    1 — A subsidiary body for scientific and technological advice is hereby established to provide the Conference of the Parties and, as appropriate, its other subsidiary bodies with timely information and advice on scientific and technological matters relating to the Convention. This body shall be open to participation by all Parties and shall be multidisciplinary. It shall comprise government representatives competent in the relevant field of expertise. It shall report regularly to the Conference of the Parties on all aspects of its work.

    2 — Under the guidance of the Conference of the Parties, and drawing upon existing competent international bodies, this body shall:

    a) Provide assessments of the state of scientific knowledge relating to climate change and its effects;

    b) Prepare scientific assessments on the effects of measures taken in the implementation of the Convention;

    c) Identify innovative, efficient and state-of-the-art technologies and know-how and advise on the ways and means of promoting development and/or transferring such technologies;

    d) Provide advice on scientific programmes, international cooperation in research and development related to climate change, as well as on ways and means of suporting endogenous capacity-building in developing countries; and

    e) Respond to scientific, technological and methodological questions that the Conference of the Parties and its subsidiary bodies may put to the body.

    3 — The functions and terms of reference of this body may be further elaborated by the Conference of the Parties.

    ARTICLE 10

    Subsidiary body for implementation

    1 — A subsidiary body for implementation is hereby established to assist the Conference of the Parties in the assessment and review of the effective implementation of the Convention. This body shall be opent to participation by all Parties and comprise government representatives who are experts on matters related to climate change. It shall report regularly to the Conference of the Parties on all aspects of its work.

    2 — Under the guidance of the Conference of the Parties, this body shall:

    a) Consider the information communicated in accordance with article 12, paragraph 1, to assess the overall aggregated effect of the steps taken by the Parties in the light of the latest scientific assessments concerning climate change;

    b) Consider the information communicated in accordance with article 12, paragraph 2, in order to assist the Conference of the Parties in carrying out the reviews required by article 4, paragraph 2, d); and

    c) Assist the Conference of the Parties, as appropriate, in the preparation and implementation of its decisions.

    ARTICLE 11

    Financial mecshanism

    1 — A mechanism for the provision of financial resources on a grant or concessional basis, including for the transfer of technology, is hereby defined. It shall function under the guidance of and be accountable to the Conference of the Parties, which shall decide on its policies, programme priorities and eligibility criteria related to this Convention. Its operation shall be entrusted to one or more existing international entities.

    2 — The financial mechanism shall have an equitable and balanced representation of all Parties within a transparent system of governance.

    3 — The Conference of the Parties and the entity or entities entrusted with the operation of the financial mechanism shall agree upon arrangements to give effect to the above paragraphs, which shall include the following:

    a) Modalities to ensure that the funded projects to addess climate change are in conformity with the policies, programme priorities and eligibility criteria established by the Conference of the Parties;

    b) Modalities by which a particular funding decision may be reconsidered in light of these policies, programme priorities and eligibility criteria;

    c) Provision by the entity or entities of regular reports to the Conference of the Parties on its funding operations, which is consistent with the requirement for accountability set out in paragraph 1 above; and

    d) Determination in a predictable and identifiable manner of the amount of funding necessary and available for the implementation of this Convention and the conditions under which that amount shall be periodically reviewed.

    4 — The Conference of the Parties shall make arrangements to implement the above mentioned provisions at its first session, reviewing and taking into account the interim arrangements referred to in article 21, paragraph 3, and shall decide whether these interim arrangements shall be maintained. Within four years thereafter, the Conference of the Parties shall review the financial mechanism and take appropriate measures.

    5 — The developed country Parties may also provide and developing country Parties avail themselves of, financial resources related to the implementation of the Convention through bilateral, regional and other multilateral channels.

    ARTICLE 12

    Communication of information related to implementation

    1 — In accordance with article 4, paragraph 1, each Party shall communicate to the Conference of the Parties, through the secretariat, the following elements of information:

    a) A national inventory of anthropogenic emissions by sources and removals by sinks of all greenhouse gases not controlled by the Montreal Protocol, to the extent its capacities permit, using comparable methodologies to be promoted and agreed upon by the Conference of the Parties;

    b) A general description of steps taken or envisaged by the Party to implement the Convention; and

    c) Any other information that the Party considers relevant to the achievement of the objective of the Convention and suitable for inclusion in its communication, including, if feasible, material relevant for calculations of global emission trends.

    2 — Each developed country Party and each other Party included in annex I shall incorporate in its communication the following elements of information:

    a) A detailed description of the policies and measures that it has adopted to implement its commitment under article 4, paragraphs 2, a) and 2, b); and

    b) A specific estimate of the effects that the policies and measures referred to in subparagraph a) immediately above will have on anthropogenic emissions by its sources and removals by its sinks of greenhouse gases during the period referred to in article 4, paragraph 2, a).

    3 — In addition, each developed country Party and each other developed Party included in annex II shall incorporate details of measures taken in accordance with article 4, paragraphs 3, 4 and 5.

    4 — Developing country Parties may, on a voluntary basis, propose projects for financing, including specific technologies, materials, equipment, techniques or practices that would be needed to implement such projects, along with, if possible, an estimate of all incremental costs, of the reductions of emissions and increments of removals of greenhouse gases, as well as an estimate of the consequent benefits.

    5 — Each developed country Party and each other Party included in annex I shall make its initial communication within six months of the entry into force of the Convention for that Party. Each Party not so listed shall make its initial communication within three years of the entry into force of the Convention for that Party, or of the availability of financial resources in accordance with article 4, paragraph 3. Parties that are least developed countries may make their initial communication at their discretion. The frequency of subsequent communications by all Parties shall be determined by the Conference of the Parties, taking into account the differentiated timetable set by this paragraph.

    6 — Information communicated by Parties under this article shall be transmitted by the secretariat as soon as possible to the Conference of the Parties and to any subsidiary bodies concerned. If necessary, the procedures for the communication of information may be further considered by the Conference of the Parties.

    7 — From its first session, the Conference of the Parties shall arrange for the provision to developing country Parties of technical and financial support, on request, in compiling and communicating information under this article, as well as in indentifying the technical and financial needs associated with proposed projects and response measures under article 4. Such support may be provided by other Parties, by competent international organizations and by the secretariat, as appropriate.

    8 — Any group of Parties may, subject to guidelines adopted by the Conference of the Parties, and to prior notification to the Conference of the Parties, make a joint communication in fulfilment of their obligations under this article, provided that such a communication includes information on the fulfilment by each of these Parties of its individual obligations under the Convention.

    9 — Information received by the secretariat that is designated by a Party as confidential, in accordance with criteria to be established by the Conference of the Parties, shall be aggregated by the secretariat to protect its confidentiality before being made available to any of the bodies involved in the communication and review of information.

    10 — Subject to paragraph 9 above, and without prejudice to the ability of any Party to make public its communication at any time, the secretariat shall make communications by Parties under this Article publicly available at the time they are submitted to the Conference of the Parties.

    ARTICLE 13

    Resolution of questions regarding implementation

    The Conference of the Parties shall, at its first session, consider the establishment of a multilateral consultative process, available to Parties on their request, for the resolution of questions regarding the implementation of the Convention.

    ARTICLE 14

    Settlement of disputes

    1 — In the event of a dispute between any two or more Parties concerning the interpretation or application of the Convention, the Parties concerned shall seek a settlement of the dispute through negotiation or any other peaceful means of their own choice.

    2 — When ratifying, accepting, approving or acceding to the Convention, or at any time thereafter, a Party which is not a regional economic integration organization may declare in a written instrument submitted to the depositary that, in respect of any dispute concerning the interpretation or application of the Convention, it recognizes as compulsory ipso facto and without special agreement, in relation to any Party accepting the same obligation:

    a) Submission of the dispute to the International Court of Justice; and/or

    b) Arbitration in accordance with procedures to be adopted by the Conference of the Parties as soon as practicable, in an annex on arbitration.

    A Party which is a regional economic integration organization may make a declaration with like effect in relation to arbitration in accordance with the procedures referred to in subparagraph b) above.

    3 — A declaration made under paragraph 2 above shall remain in force until it expires in accordance with its terms or until three months after written notice of its revocation has been deposited with the depositary.

    4 — A new declaration, a notice of revocation or the expiry of a declaration shall not in any way affect proceedings pending before the International Court of Justice or the arbitral tribunal, unless the parties to the dispute otherwise agree.

    5 — Subject to the operation of paragraph 2 above, if after twelve months following notification by one Party to another that a dispute exists between them, the Parties concerned have not been able to settle their dispute through the means mentioned in paragraph 1 above, the dispute shall be submitted, at the request of any of the parties to the dispute, to conciliation.

    6 — A conciliation commission shall be created upon the request of one of the parties to the dispute. The commission shall be composed of anequal number of members appointed by each party concerned and a chairman chosen jointly by the members appointed by each party. The commission shall render a recommendatory award, which the parties shall consider in good faith.

    7 — Additional procedures relating to conciliation shall be adopted by the Conference of the Parties, as soon as practicable, in an annex on conciliation.

    8 — The provisions of this article shall apply to any related legal instrument which the Conference of the Parties may adopt, unless the instrument provides otherwise.

    ARTICLE 15

    Amendments to the Convention

    1 — Any Party may propose amendments to the Convention.

    2 — Amendments to the Convention shall be adopted at an ordinary session of the Conference of the Parties. The text of any proposed amendment to the Convention shall be communicated to the Parties by the secretariat at least six months before the meeting at which it is proposed for adoption. The secretariat shall also communicate proposed amendments to the signatories to the Convention and, for information, to the depositary.

    3 — The Parties shall make every effort to reach agreement on any proposed amendment to the Convention by consensus. If all efforts at consensus have been exhausted, and no agreement reached, the amendment shall as a last resort be adopted by a three-fourths majority vote of the Parties present and voting at the meeting. The adopted amendment shall be communicated by the secretariat to the depositary, who shall circulate it to all Parties for their acceptance.

    4 — Instruments of acceptance in respect of an amendment shall be deposited with the depositary. An amendment adopted in accordance with paragraph 3 above shall enter into force for those Parties having accepted it on the ninetieth day after the date of receipt by the depositary of an instrument of acceptance by at least three-fourths of the Parties to the Convention.

    5 — The amendment shall enter into force for any other Party on the ninetieth day after the date on which that Party deposits with the depositary its instrument of acceptance of the said amendment.

    6 — For the purposes of this article, «Parties present and voting» means Parties present and casting an affirmative or negative vote.

    ARTICLE 16

    Adoption and amendment of annexes to the Convention

    1 — Annexes to the Convention shall form an integral part thereof and, unless otherwise expressly provided, a reference to the Convention constitutes at the same time a reference to any annexes thereto. Without prejudice to the provisions of article 14, paragraphs 2, b), and 7, such annexes shall be restricted to lists, forms and any other material of a descriptive nature that is of a scientific, technical, procedural or administrative character.

    2 — Annexes to the Convention shall be proposed and adopted in accordance with the procedure set forth in article 15, paragraphs 2, 3 and 4.

    3 — An annex that has been adopted in accordance with paragraph 2 above shall enter into force for all Parties to the Convention six months after the date of the communication by the depositary to such Parties of the adoption of the annex, except for those Parties that have notified the depositary, in writing, within that period of their non-acceptance of the annex. The annex shall enter into force for Parties which withdraw their notification of non-acceptance on the ninetieth day after the date on which withdrawal of such notification has been received by the depositary.

    4 — The proposal, adoption and entry into force of amendments to annexes to the Convention shall be subject to the same procedure as that for the proposal, adoption and entry into force of annexes to the Convention in accordance with paragraphs 2 and 3 above.

    5 — If the adoption of an annex or an amendment to an annex involves an amendment to the Convention, that annex or amendment to an annex shall not enter into force until such time as the amendment to the Convention enters into force.

    ARTICLE 17

    Protocols

    1 — The Conference of the Parties may, at any ordinary session, adopt protocols to the Convention.

    2 — The text of any proposed protocol shall be communicated to the Parties by the secretariat at least six months before such a session.

    3 — The requirements for the entry into force of any protocol shall be established by that instrument.

    4 — Only Parties to the Convention may be Parties to a protocol.

    5 — Decisions under any protocol shall be taken only by the Parties to the protocol concerned.

    ARTICLE 18

    Right to vote

    1 — Each Party to the Convention shall have one vote, except as provided for in paragraph 2 below.

    2 — Regional economic integration organizations, in matters within their competence, shall exercise their right to vote with a number of votes equal to the number of their member States that are Parties to the Convention. Such an organization shall not exercise its right to vote if any of its member States exercises its right, and vice versa.

    ARTICLE 19

    Depositary

    The Secretary-General of the United Nations shall be the depositary of the Convention and of protocols adopted in accordance with article 17.

    ARTICLE 20

    Signature

    This Convention shall be open for signature by States members of the United Nations or of any of its specialized agencies or that are Parties to the Statute of the International Court of Justice and by regional economic integration organizations at Rio de Janeiro, during the United Nations Conference on Environment and Development, and thereafter at United Nations headquarters in New York from 20 June 1992 to 19 June 1993.

    ARTICLE 21

    Interim arrangements

    1 — The secretariat functions referred to in article 8 will be carried out on an interim basis by the secretariat established by the General Assembly of the United Nations in its Resolution 45/212, of 21 December 1990, until the completion of the first session of the Conference of the Parties.

    2 — The head of the interim secretariat referred to in paragraph 1 above will cooperate closely with the Intergovernmental Panel on Climate Change to ensure that the Panel can respond to the need for objective scientific and technical advice. Other relevant scientific bodies could also be consulted.

    3 — The Global Environment Facility of the United Nations Development Programme, the United Nations Environment Programme and the International Bank for Reconstruction and Development shall be the international entity entrusted with the operation of the financial mechanism referred to in article 11 on a interim basis. In this connection, the Global Environment Facility should be appropriately restructured and its membership made universal to enable it to fulfil the requirements of article 11.

    ARTICLE 22

    Ratification, acceptance, approval or accession

    1 — The Convention shall be subject to ratification, acceptance, approval or accession by States and by regional economic integration organizations. It shall be open for accession from the day after the date of which the Convention is closed for signature. Instruments of ratification, acceptance, approval or accession shall be deposited with the depositary.

    2 — Any regional economic integration organization which becomes a Party to the Convention without any of its member States being a Party shall be bound by all the obligations under the Convention. In the case of such organizations, one or more of whose member States is a Party to the Convention, the organization and its member States shall decide on their respective responsibilities for the performance of their obligations under the Convention. In such cases, the organization and the member States shall not be entitled to exercise rights under the Convention concurrently.

    3 — In their instruments of ratification, acceptance, approval or accession, regional economic integration organizations shall declare the extent of their competence with respect to the matters governed by the Convention. These organizations shall also inform the depositary, who shall in turn inform the Parties, of any substantial modification in the extent of their competence.

    ARTICLE 23

    Entry into force

    1 — The Convention shall enter into force on the ninetieth day after the date of deposit of the fiftieth instrument of ratification, acceptance, approval or accession.

    2 — For each State or regional economic integration organization that ratifies, accepts or approves the Convention or accedes thereto after the deposit of the fiftieth instrument of ratification, acceptance, approval or accession, the Convention shall enter into force on the ninetieth day after the date of deposit by such State or regional economic integration organization of its instrument of ratification, acceptance, approval or accession.

    3 — For the purposes of paragraphs 1 and 2 above, any instrument deposited by a regional economic integration organization shall not be counted as additional to those deposited by States members of the organization.

    ARTICLE 24

    Reservations

    No reservations may be made to the Convention.

    ARTICLE 25

    Withdrawal

    1 — At any time after three years from the date on which the Convention has entered into force for a Party, that Party may withdraw from the Convention by giving written notification to the depositary.

    2 — Any such withdrawal shall take effect upon expiry of one year from the date of receipt by the Depositary of the notification of withdrawal, or on such later date as may be specified in the notification of withdrawal.

    3 — Any Party that withdraws from the Convention shall be considered as also having withdrawn from any protocol to which it is a Party.

    ARTICLE 26

    Authentic texts

    The original of this Convention, of which the Arabic, Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.

    In witness whereof the undersigned, being duly authorized to that effect, have signed this Convention.

    CONVENÇÃO QUADRO DAS NAÇÕES UNIDAS SOBRE ALTERAÇÕES CLIMÁTICAS

    As Partes nesta Convenção:

    Reconhecendo que a alteração do clima da Terra e os seus efeitos negativos são uma preocupação comum da humanidade;

    Preocupadas por as actividades humanas terem aumentado substancialmente na atmosfera as concentrações de gases com efeito de estufa e pelo facto de esse aumento estar a acrescer o efeito de estufa natural, o que irá resultar num aquecimento médio adicional da superfície da Terra e da atmosfera, podendo afectar adversamente os ecossistemas naturais e a humanidade;

    Notando que a maior parte das emissões globais actuais e históricas de gases com efeito de estufa teve origem em países desenvolvidos, que as emissões per capita nos países em desenvolvimento são ainda relativamente baixas e que a quota-parte das emissões globais com origem nos países em desenvolvimento irá aumentar para satisfazer as suas necessidades sociais e de desenvolvimento;

    Conhecedoras do papel e importância dos ecossistemas terrestres e marinhos como sumidouros e reservatórios dos gases com efeito de estufa;

    Notando que existem muitas incertezas nas previsões sobre as alterações climáticas, especialmente quanto ao momento da sua ocorrência, amplitude e modelo regional;

    Reconhecendo que a natureza global da alteração climática requer a mais ampla cooperação possível entre todos os países e a sua participação numa resposta internacional eficaz e apropriada, de acordo com as suas responsabilidades comuns mas diferenciadas e de acordo com as suas capacidades respectivas e com as suas condições sociais e económicas;

    Relembrando as disposições pertinentes da Declaração da Conferência das Nações Unidas sobre o Ambiente Humano, adoptada em Estocolmo em 16 de Junho de 1972;

    Relembrando também que, de acordo com a Carta das Nações Unidas e com os princípios do direito internacional, os Estados têm o direito soberano de explorarem os seus próprios recursos de acordo com as suas políticas ambientais e de desenvolvimento, assim como a responsabilidade de assegurarem que as actividades sob a sua jurisdição ou controlo não causem danos ao ambiente de outros Estados ou áreas situadas fora dos limites da sua soberania nacional;

    Reafirmando o princípio da soberania dos Estados na cooperação internacional relativa às alterações climáticas;

    Reconhecendo que os Estados deveriam aprovar uma legislação eficaz para o ambiente, que as normas ambientais, a gestão dos objectivos e prioridades deverão reflectir o contexto ambiental e de desenvolvimento a que se aplicam e que os valores de referência adoptados por certos países podem ser inapropriados e implicar custos económicos e sociais excessivos para outros países, especialmente os países em desenvolvimento;

    Recordando as disposições da Resolução n.º 44/228 da Assembleia Geral, de 22 de Dezembro de 1989, sobre a Conferência das Nações Unidas sobre o Ambiente e Desenvolvimento, assim como as Resoluções n.os 43/53, de 6 de Dezembro de 1988, 44/207, de 22 de Dezembro de 1989, 45/212, de 21 de Dezembro de 1990, e 46/169, de 19 de Dezembro de 1991, sobre a protecção do clima global para as gerações actuais e futuras da humanidade;

    Recordando também as disposições da Resolução n.º 44/206 da Assembleia Geral, de 22 de Dezembro de 1989, sobre os possíveis efeitos negativos da subida do nível das águas do mar sobre as ilhas e sobre as áreas costeiras, especialmente as áreas costeiras baixas, assim como as disposições da Resolução n.º 44/172, de 19 de Dezembro de 1989, da Assembleia Geral sobre a implementação do Plano de Acção de Combate à Desertificação;

    Recordando ainda a Convenção de Viena para a Protecção da Camada de ozono, de 1985, e o Protocolo de Montreal sobre as Substâncias Que Diminuem a Camada de Ozono, de 1987, com os ajustamentos e emendas de 29 de Junho de 1990;

    Notando a Declaração Ministerial da Segunda Conferência Mundial do Clima, adoptada em 7 de Novembro de 1990;

    Conscientes do valioso trabalho analítico que está a ser realizado por muitos Estados sobre as alterações climáticas e das contribuições importantes da Organização Mundial de Meteorologia, do Programa das Nações Unidas para o Ambiente e outros órgãos, organizações e entidades do sistema das Nações Unidas assim como de outros órgãos internacionais e intergovernamentais, no intercâmbio de resultados da investigação científica e na coordenação das investigações;

    Reconhecendo que os passos necessários à compreensão e à resolução dos problemas das alterações climáticas serão mais eficazes, de um ponto de vista ambiental, social e económico, se se basearem em considerações científicas, técnicas e económicas relevantes e continuamente reavaliadas à luz das novas descobertas nestes domínios;

    Reconhecendo que diversas acções destinadas a resolver a alteração climática podem ser economicamente justificadas em si mesmas e ajudar a resolver outros problemas ambientais;

    Reconhecendo também a necessidade de que os países desenvolvidos tomam acções imediatas, de modo flexível e com base em prioridades definidas, como um primeiro passo para o desenvolvimento de estratégias de resposta a nível global, nacional e, quando acordado, regional que tenham em conta todos os gases com efeito de estufa e a contribuição relativa de cada um deles para o aumento deste efeito;

    Reconhecendo ainda que os países com baixa altitude, os formados por pequenas ilhas, países com áreas costeiras baixas, áridas e semiáridas, ou com áreas sujeitas a inundações, secas ou desertificação, assim como os países em desenvolvimento com ecossistemas montanhosos frágeis, são especialmente vulneráveis aos efeitos adversos das alterações climáticas;

    Reconhecendo as dificuldades especiais desses países, especialmente os países em desenvolvimento, cujas economias estão particularmente dependentes da produção, uso e exportação de combustíveis fósseis, em consequência das acções destinadas a limitar a emissão de gases com efeito de estufa;

    Afirmando que as respostas a dar à alteração climática devem estar coordenadas com o desenvolvimento económico e social, de um modo integrado, tendo em vista evitar impactes negativos nestes últimos, tendo totalmente em conta as necessidades prioritárias e legítimas dos países em desenvolvimento para alcançarem um crescimento económico sustentado e a erradicação da pobreza;

    Reconhecendo que todos os países, especialmente os países em desenvolvimento, devem ter acesso aos recursos necessários para alcançarem um desenvolvimento social e económico sustentável, tendo em conta que esses países devem progredir no sentido do alcance deste objectivo e que o seu consumo energético necessitará de aumentar, tendo em consideração as possibilidades de se conseguir uma maior eficiência energética e de se controlar as emissões de gases com efeito de estufa em geral, incluindo a aplicação de novas tecnologias em termos que tornem tal aplicação social e economicamente benéfica;

    Decididas a proteger o sistema climático para as gerações actuais e futuras;

    concordaram no seguinte:

    ARTIGO 1.º

    Definições

    Para efeitos desta Convenção:

    1) «Efeitos adversos das alterações climáticas» significa as modificações no ambiente físico, ou biota, resultantes da alteração climática, que tenham efeitos negativos significativos na composição, resistência ou produtividade dos ecossistemas naturais e sob gestão, ou no funcionamento dos sistemas sócio-económicos ou ainda sobre a saúde e o bem-estar humanos;

    2) «Alteração climática» significa uma modificação no clima atribuível, directa ou indirectamente, à actividade humana que altera a composição da atmosfera global e que, conjugada com as variações climáticas naturais, é observada durante períodos de tempo comparáveis;

    3) «Sistema climático» significa o conjunto da atmosfera, hidrosfera, biosfera e litosfera e suas interacções;

    4) «Emissões» significa a libertação de gases, com efeito de estufa, e ou seus percursores na atmosfera sobre uma área específica e durante certo período;

    5) «Gases com efeito de estufa» significa os constituintes gasosos da atmosfera, tanto naturais como antropogénicos, que absorvem e reemitem a radiação infravermelha;

    6) «Organização de integração económica regional» significa uma organização constituída por Estados soberanos de certa região que tem competência relativamente a assuntos regidos por esta Convenção ou seus protocolos e que está devidamente autorizada, de acordo com os seus processos internos, a assinar, ratificar, aceitar, aprovar ou aceder os instrumentos em causa;

    7) «Reservatório» significa um componente, ou componentes, do sistema climático em que um gás com efeito de estufa, ou um seu precursor, é armazenado;

    8) «Sumidouro» significa qualquer processo, actividade ou mecanismo que remove da atmosfera um gás com efeito de estufa, ou um seu percursor, ou um aerossol;

    9) «Fonte» significa qualquer processo ou actividade que liberta gases com efeito de estufa, ou um seu percursor ou aerossóis para a atmosfera.

    ARTIGO 2.º

    Objectivo

    O objectivo final desta Convenção e de quaisquer instrumentos legais que a Conferência das Partes possa vir a adoptar é o de conseguir, de acordo com as disposições relevantes da Convenção, a estabilização das concentrações na atmosfera de gases com efeito de estufa a um nível que evite uma interferência antropogénica perigosa com o sistema climático. Tal nível deveria ser atingido durante um espaço de tempo suficiente para permitir a adaptação natural dos ecossistemas às alterações climáticas, para garantir que a produção de alimentos não seja ameaçada e para permitir que o desenvolvimento económico prossiga de uma forma sustentável.

    ARTIGO 3.º

    Princípios

    Nas suas acções destinadas a alcançar o objectivo da Convenção e para aplicar as suas disposições, as Partes guiar-se-ão, inter alia, pelos princípios seguintes:

    1) As Partes Contratantes devem proteger o sistema climático para beneficio das gerações presentes e futuras da humanidade, com base na equidade e de acordo com as suas responsabilidades comuns mas diferenciados e com as respectivas capacidades. Assim, as Partes constituídas por países desenvolvidos devem tomar a liderança no combate à alteração climática e aos seus efeitos adversos;

    2) As necessidades específicas e as circunstâncias especiais das Partes constituídas por países em desenvolvimento, especialmente os que são particularmente vulneráveis aos efeitos prejudiciais das alterações climáticas, e das Partes Contratantes, especialmente os países em desenvolvimento, que deveriam suportar um encargo desproporcionado e anormal resultante da Convenção, devem ser tidas em plena consideração;

    3) As Partes devem tomar medidas cautelares para antecipar, evitar ou minimizar as causas das alterações climáticas e mitigar os seus efeitos prejudiciais. Quando haja ameaças de danos graves ou irreversíveis, a falta de certeza científica não deve ser utilizada para justificar o adiamento da tomada de tais medidas, tendo em conta, no entanto, que as políticas e as medidas relacionadas com as alterações climáticas devem ser eficazes relativamente ao seu custo, de tal modo que garantam a obtenção de benefícios globais ao menor custo possível. Para se conseguir isto, tais políticas e medidas devem ter em consideração os diversos contextos sócio-económicos, acessíveis, cobrirem todas as fontes, sumidouros e reservatórios de gases com efeito de estufa e adaptar-se e englobar todos os sectores económicos. Os esforços direccionados às alterações climáticas podem ser realizados em cooperação entre as Partes interessadas;

    4) As Partes têm o direito e devem promover o desenvolvimento sustentável. As políticas e as medidas para proteger o sistema climático contra as alterações causadas pela actividade humana devem ser apropriadas às condições específicas de cada Parte e devem estar integradas nos programas nacionais de desenvolvimento, tendo em consideração que o desenvolvimento económico é essencial para a adopção de medidas direccionadas com as alterações climáticas;

    5) As Partes devem cooperar na promoção de um sistema económico internacional, apoiante e aberto, que conduza a um crescimento económico e a um desenvolvimento sustentáveis em todas as Partes, especialmente as Partes Contratantes dos países em desenvolvimento, permitindo assim que estes tenham uma maior capacidade para enfrentar os problemas suscitados pelas alterações climáticas. As medidas tomadas para combater as alterações climáticas, incluindo as medidas unilaterais, não devem constituir um meio para efectuar uma discriminação arbitrária ou injustificada, ou uma restrição encapotada, ao comércio internacional.

    ARTIGO 4.º

    Compromissos

    1 — Todas as Partes, tendo em consideração as suas responsabilidades comuns, mas diferenciadas, as suas prioridades específicas de desenvolvimento nacional e regional e os seus objectivos e circunstâncias, devem:

    a) Desenvolver, actualizar periodicamente, publicar e facultar à Conferência das Partes, de acordo com os termos do artigo 12.º, os seus inventários nacionais de emissões antropogénicas por fontes, assim como da remoção pelos sumidouros de todos os gases com efeitos de estufa não controlados pelo Protocolo de Montreal, mediante a utilização de metodologias comparáveis, a acordar pela Conferência das Partes;

    b) Formular, implementar, publicar e actualizar regularmente programas nacionais e, quando apropriado, regionais, contendo medidas para mitigar as alterações climáticas, considerando as emissões antropogénicas por fontes e a remoção, pelos sumidouros, de todos os gases com efeito de estufa não controlados pelo Protocolo de Montreal, e medidas para facilitar uma adaptação adequada às alterações climáticas;

    c) Promover e cooperar no desenvolvimento, aplicação e divulgação, incluindo a transferência de tecnologias, práticas e processos que controlem, reduzam ou previnam as emissões antropogénicas de gases de efeito de estufa não controlados pelo Protocolo de Montreal, em todos os sectores relevantes, incluindo o da energia, dos transportes, da indústria, da agricultura, da silvicultura e da gestão de resíduos;

    d) Promover uma gestão sustentável e, quando apropriado, promover e cooperar na conservação e na melhoria de sumidouros e reservatórios de todos os gases com efeito de estufa não controlados pelo Protocolo de Montreal, incluindo a biomassa, as florestas, os oceanos, assim como outros ecossistemas terrestres, costeiros e marinhos;

    e) Cooperar na preparação para a adaptação aos impactes das alterações climáticas, desenvolver e elaborar planos apropriados e integrados contemplando a gestão das zonas costeiras, dos recursos hídricos e da agricultura e na protecção e reabilitação de áreas, especialmente em África, atingidas pela seca e pela desertificação, assim como por inundações;

    f) Ter em conta as alterações climáticas, tanto quanto possível, nas suas acções e políticas sociais, económicas e ambientais relevantes e empregar os métodos apropriados, por exemplo a avaliação de impactes, formulados e definidos a nível nacional, tendo em vista minimizar os efeitos adversos na economia, na saúde pública e na qualidade do ambiente dos projectos ou medidas por eles tomados para mitigar ou adaptar às alterações climáticas;

    g) Promover e cooperar na investigação científica, tecnológica, técnica, sócio-económica e outras, na observação sistemática e no desenvolvimento de arquivos de dados relativos ao sistema climático e destinados a aumentar a compreensão e a reduzir ou eliminar as incertezas subsistentes quanto às causas, efeitos, amplitude e dimensão temporal das alterações climáticas e quanto às consequências económicas e sociais das várias estratégias de resposta;

    h) Promover e cooperar no intercâmbio total, aberto e rápido, de informação científica, tecnológica, técnica, socio-económica e legislativa relativa ao sistema climático e as alterações climáticas e às consequências económicas e sociais das várias estratégias de resposta;

    i) Promover e cooperar na educação, formação e informação do público relativa as alterações climáticas e encorajar uma mais ampla participação neste processo, incluindo a de organizações não governamentais; e

    j) Comunicar à Conferência das Partes a informação relativa à implementação, de acordo com os termos do artigo 12.º

    2 — As Partes Contratantes constituídas por países desenvolvidos e as outras Partes, incluídas no anexo I, comprometem-se, especificamente, segundo os termos seguintes:

    a) Cada uma destas Partes deverá adoptar políticas e tomar as medidas correspondentes para a mitigação das alterações climáticas, limitando as suas emissões antropogénicas de gases de efeito de estufa e protegendo e desenvolvendo os seus sumidouros e reservatórios de gases com efeito de estufa. Estas políticas e medidas irão demonstrar que os países desenvolvidos estão a tomar a liderança na modificação das tendências a longo prazo das emissões antropogénicas, de uma maneira consistente com o objectivo desta Convenção, reconhecendo que o retorno, no final desta década, aos níveis anteriores de emissões antropogénicas de dióxido de carbono e de outros gases com efeito de estufa não controlados pelo Protocolo de Montreal irá contribuir para tal modificação e tendo em conta as diferenças entre as Partes quanto aos pontos de partida e modos de encarar o problema, as estruturas económicas e os recursos de base, a necessidade de manter um forte e sustentável crescimento económico, as tecnologias disponíveis e outras condicionantes individuais, assim como a necessidade de contributos apropriados e equitativos de cada uma das Partes, num esforço global para alcançar esse objectivo. Estas Partes podem desenvolver essas políticas e medidas juntamente com outras Partes e podem ajudar outras Partes a contribuir para o alcance do objectivo da Convenção, especialmente o desta alínea;

    b) Para promover o progresso em direcção a este objectivo, cada uma destas Partes deverá comunicar, num prazo de seis meses a partir da entrada em vigor desta Convenção e depois, periodicamente e nos termos do artigo 12.º, informação detalhada sobre as suas políticas e medidas referidas na alínea a) supra, assim como sobre as suas protecções de emissões antropogénicas por fontes e remoções por sumidouros dos gases com efeito de estufa não controlados pelo Protocolo de Montreal durante o período referido na alínea a), com o objectivo de regressarem, individual ou conjuntamente, aos níveis de 1990 destas emissões antropogénicas de dióxido de carbono e de outros gases com efeito de estufa não controlados pelo Protocolo de Montreal. Esta informação será estudada pela Conferência das Partes, na sua primeira sessão, e depois, periodicamente, de acordo com os termos do artigo 7.º;

    c) Os cálculos das emissões a partir das fontes e as remoções pelos sumidouros dos gases com efeito de estufa, nos termos da alínea b) supra, devem ter em conta os melhores conhecimentos científicos disponíveis, incluindo a capacidade efectiva dos sumidouros e a contribuição respectiva desses gases para as alterações climáticas. A Conferência das Partes, na sua primeira sessão, deverá considerar e acordar as metodologias para efectuar esses cálculos e, subsequentemente, revê-las periodicamente;

    d) Na sua primeira sessão, a Conferência das Partes deverá rever a adequação das alíneas a) e b) supra. Tais revisões serão levadas a cabo à luz da melhor informação científica disponível e da melhor avaliação sobre as alterações climáticas e seus impactes, assim como da relevante informação técnica, social e económica. Com base nessa revisão, a Conferência das Partes deverá tomar as acções apropriadas, as quais poderão incluir a adopção de emendas aos compromissos definidos nas alíneas a) e b) supra. Na sua primeira sessão, a Conferência das Partes também deverá tomar decisões relativamente aos critérios da implementação conjunta, como se indica na alínea a) supra. A segunda revisão das alíneas a) e b) deverá realizar-se, o mais tardar, até 31 de Dezembro de 1998 e, subsequentemente, em intervalos regulares, a determinar pela Conferência das Partes, até atingir o objectivo desta Convenção;

    e) Cada uma destas Partes deverá:

    i) Coordenar, de forma apropriada, com outras Partes, os instrumentos económicos e administrativos relevantes desenvolvidos para alcançar o objectivo da Convenção; e

    ii) Identificar e rever, periodicamente, as suas políticas e práticas que encorajem actividades que conduzam a maiores níveis de emissões antropogénicas de gases com efeito de estufa não controlados pelo Protocolo de Montreal que venham, porventura, a ocorrer;

    f) O mais tardar até 31 de Dezembro de 1998, a Conferência das Partes deverá rever a informação disponível, com o objectivo de tomar, quando apropriado, decisões relativas às emendas à lista constante dos anexos I e II, com a aprovação da Parte interessada;

    g) Qualquer Parte não incluída no anexo I pode, no seu instrumento de ratificação, aceitação, aprovação ou acessão, ou em qualquer momento posterior, notificar o depositário de que se tenciona obrigar segundo os termos das alíneas a) e b) supra. O depositário deverá informar os outros signatários e Partes de tal notificação.

    3 — As Partes Contratantes constituídas por países desenvolvidos e outras Partes desenvolvidas incluídas no anexo II deverão providenciar novos e adicionais recursos financeiros globais para satisfazer os custos acordados a suportar pelas Partes constituídas por países em desenvolvimento no cumprimento das suas obrigações nos termos do parágrafo 1 do artigo 12.º Também deverão fornecer os recursos financeiros, inclusive para a transferência de tecnologia, necessários às Partes constituídas por países em desenvolvimento para poderem suportar a totalidade dos custos adicionais acordados para a aplicação das medidas contempladas no parágrafo 1 deste artigo e que sejam acordados entre uma Parte constituída por um país em desenvolvimento e a entidade ou entidades internacionais referidas no artigo 11º, de acordo com os termos desse artigo. A implementação destes compromissos deverá ter em conta a necessidade de adequação e de previsibilidade do fluxo de fundos e da importância de uma repartição apropriada de encargos entre as Partes constituídas por países desenvolvidos.

    4 — As Partes dos países desenvolvidos e outras Partes desenvolvidas incluídas no anexo II também deverão ajudar as Partes constituídas por países em desenvolvimento, que são particularmente vulneráveis aos efeitos adversos das alterações climáticas, a suportarem os custos da adaptação a esses efeitos adversos.

    5 — As Partes dos países desenvolvidos e outras Partes desenvolvidas, incluídas no anexo II, deverão tomar todas as etapas possíveis para promover, facilitar e financiar, quando apropriado, a transferência de, ou o acesso a, tecnologias ambientalmente sãs e know-how às outras Partes, particularmente às Partes constituídas por países em desenvolvimento, para lhes permitir a implementação das disposições da Convenção. Neste processo, as Partes constituídas por países desenvolvidos deverão suportar o desenvolvimento e o incremento de capacidades endógenas e de tecnologias das Partes constituídas por países em desenvolvimento. As outras Partes e organizações que se achem em posição de o fazer deverão também contribuir, facilitando a transferência de tais tecnologias.

    6 — Na implementação dos seus compromissos, nos termos do parágrafo 2 acima, será permitido, pela Conferência das Partes, um certo grau de flexibilidade às Partes incluídas no anexo I que estejam num processo de transição para a economia de mercado, de modo a melhorar a capacidade dessas Partes no relativo às alterações climáticas, incluindo o tomar-se em consideração valores históricos, considerados como referência, das emissões antropogénicas de gases com efeito de estufa não controlados pelo Protocolo de Montreal.

    7 — O grau de implementação efectiva dos seus compromissos, nos termos da Convenção, pelas Partes constituídas por países em desenvolvimento dependerá da implementação efectiva pelas Partes constituídas por países desenvolvidos dos seus compromissos, nos termos da Convenção, relacionados com os recursos financeiros e transferência de tecnologia e terá totalmente em consideração o desenvolvimento económico e social e a erradicação da pobreza como objectivos absolutamente prioritários das Partes constituídas por países em desenvolvimento.

    8 — Na implementação dos compromissos deste artigo, as Partes darão a sua atenção plena às acções necessárias, ao abrigo da Convenção, incluindo as acções relativas a financiamentos, seguros e à transferência de tecnologia, para satisfazer as necessidades e as preocupações específicas das Partes constituídas por países em desenvolvimento que decorram dos efeitos adversos das alterações climáticas e ou do impacte da implementação de medidas de resposta, em particular:

    a) Pequenos países insulares;

    b) Países com áreas costeiras baixas;

    c) Países com zonas áridas e semiáridas, áreas florestais e áreas sujeitas à degradação florestal;

    d) Países com áreas propensas a catástrofes naturais;

    e) Países com áreas sujeitas a secas e à desertificação;

    f) Países com áreas onde existe uma elevada poluição atmosférica urbana;

    g) Países com áreas contendo ecossistemas frágeis, incluindo ecossistemas montanhosos;

    h) Países cujas economias estão altamente dependentes de recitas geradas a partir da produção, processamento e exportação, e ou do consumo de combustíveis fósseis e associados a produtos de energia intensiva; e

    i) Países interiores e de passagem.

    Além disso, a Conferência das Partes pode tomar as acções apropriadas relativamente a este parágrafo.

    9 — Nas suas acções relativas ao financiamento e à transferência de tecnologia, as Partes deverão ter plenamente em conta as necessidades específicas e as situações especiais dos países menos desenvolvidos.

    10 — Na implementação dos compromissos da Convenção e de acordo com os termos do artigo 10.º, as Partes deverão ter em consideração a situação daquelas Partes, particularmente das constituídas por países em desenvolvimento, cujas economias são vulneráveis aos efeitos adversos da implementação das medidas de resposta as alterações climáticas. Isto aplica-se, nomeadamente, às Partes cujas economias são altamente dependentes de receitas geradas a partir da produção, processamento e exportação, e ou do consumo de combustíveis fósseis e associados a produtos de energia intensiva, e ou da utilização de combustíveis fósseis relativamente aos quais essas Partes têm séries dificuldades em mudar para fontes alternativas.

    ARTIGO 5.º

    Investigação e observação sistemática

    Na implementação dos seus compromissos, nos termos da alínea g) do parágrafo 1 do artigo 4.º, as Partes deverão:

    a) Apoiar e desenvolver, de forma apropriada, programas e redes ou organizações internacionais e intergovernamentais cujos objectivos são a definição, a condução, a avaliação e o financiamento da investigação, da recolha de dados e da observação sistemática, tendo em conta a necessidade de minimizar a duplicação de esforços;

    b) Apoiar os esforços internacionais e intergovernamentais para reforçar a observação sistemática e as capacidades de investigação científica e técnica nacionais, particularmente nos países em desenvolvimento, e promover o acesso e o intercâmbio de dados e de análises obtidos a partir de zonas situadas fora das jurisdições nacionais; e

    c) Ter em conta as preocupações e as necessidades particulares dos países em desenvolvimento e cooperar na melhoria das suas capacidades endógenas para participar nos esforços mencionados nas alíneas a) e b) acima.

    ARTIGO 6.º

    Educação, formação e informação do público

    Na implementação dos seus compromissos, ao abrigo da alínea i) do parágrafo 1 do artigo 4.º, as Partes deverão:

    a) Promover e facilitar, aos níveis nacional e, quando apropriado, sub-regional e regional, de acordo com as leis e regulamentos nacionais e segundo as suas capacidades respectivas:

    i) O desenvolvimento e a implementação de programas de educação e de informação do público sobre as alterações climáticas e seus efeitos;

    ii) O acesso do público à informação sobre as alterações climáticas e seus efeitos;

    iii) A participação do público nas medidas de combate às alterações climáticas e seus efeitos e no desenvolvimento de respostas adequadas; e

    iv) A formação de pessoal científico, técnico e de gestão;

    b) Cooperar e promover, a nível internacional e, quando possível, utilizando organismos existentes:

    i) O desenvolvimento e o intercâmbio de material educativo e de informação do público sobre as alterações climáticas e seus efeitos; e

    ii) O desenvolvimento e a implementação de programas de educação e de formação, incluindo o reforço das instituições nacionais e do intercâmbio ou do apoio de pessoal para formar peritos neste domínio, especialmente nos países em desenvolvimento.

    ARTIGO 7.º

    Conferência das partes

    1 — Uma Conferência das Partes é aqui estabelecida.

    2 — A Conferência das Partes, como órgão supremo da Convenção, deverá examinar regularmente a implementação da Convenção e quaisquer instrumentos legais com ela relacionados que a Conferência das Partes possa vir a adoptar e deverá tomar, nos termos do seu mandato, as decisões necessárias para promover a implementação efectiva da Convenção. Para tal, deverá:

    a) Examinar periodicamente as obrigações das Partes e os acordos institucionais realizados ao abrigo desta Convenção e examinar também à luz dos objectivos da Convenção, a experiência adquirida na sua implementação e a evolução dos conhecimentos científicos e tecnológicos;

    b) Promover e facilitar o intercâmbio de informações sobre as medidas adoptadas pelas Partes relacionadas com as alterações climáticas e seus efeitos, tendo em conta os diferentes condicionamentos, responsabilidades e capacidades das Partes e dos seus respectivos compromissos ao abrigo da Convenção;

    c) Facilitar, a pedido de duas ou mais Partes, a coordenação de medidas por elas adoptadas relacionadas com as alterações climáticas e seus efeitos, tendo em conta as diferentes condicionantes, responsabilidades e capacidades das Partes e dos seus respectivos compromissos ao abrigo da Convenção;

    d) Promover e orientar, de acordo com o objectivo e com as disposições da Convenção, o desenvolvimento e o melhoramento periódico de metodologias comparáveis, a serem acordadas pela Conferência das Partes, inter alia, para preparar inventários sobre as emissões pelas fontes de gases com efeito de estufa e sobre a sua remoção pelos sumidouros e para avaliar a eficácia das medidas destinadas a limitar as emissões e a melhorar a remoção desses gases;

    e) Avaliar, com base em toda a informação disponível de acordo com as disposições da Convenção, a implementação da Convenção pelas Partes, os efeitos globais das medidas tomadas ao abrigo da Convenção, em particular os efeitos ambientais, económicos e sociais, assim como os seus impactes cumulativos, e em que medida estão a ser realizados progressos para atingir os objectivos da Convenção;

    f) Considerar e adoptar relatórios regulares sobre a implementação da Convenção e assegurar a sua publicação;

    g) Fazer recomendações sobre quaisquer matérias necessárias para a implementação da Convenção;

    h) Procurar mobilizar recursos financeiros, de acordo com os parágrafos 3, 4 e 5 do artigo 4.º e com o artigo 11.º;

    i) Criar os órgãos subsidiários que sejam considerados necessários para a implementação da Convenção;

    j) Examinar os relatórios apresentados pelos órgãos subsidiários e proporcionar-lhes directivas;

    k) Acordar e adoptar, por consenso, regras processuais e financeiras para si e para os seus órgãos subsidiários;

    l)Procurar e utilizar, quando apropriado, os serviços e a cooperação, assim como a informação proporcionada por organizações internacionais e intergovernamentais e organizações não governamentais competentes; e

    m) Exercer outras funções que sejam necessárias para alcançar o objectivo da Convenção, assim como todas as funções que lhe foram atribuídas ao abrigo da Convenção.

    ARTIGO 8.º

    Estabelecimento do Secretariado

    1 — O Secretariado é aqui estabelecido.

    2 — As funções do Secretariado serão:

    a) Preparar as sessões da Conferência das Partes e dos seus órgãos subsidiários criados pela Convenção e proporcionar-lhes os serviços solicitados;

    b) Compilar e transmitir os relatórios que lhe forem submetidos;

    c) Assistir as Partes, particularmente as dos países em desenvolvimento, quando solicitado, na compilação e comunicação da informação requerida de acordo com as disposições da Convenção;

    d) Preparar os relatórios sobre as suas actividades e apresentá-los à Conferência das Partes;

    e) Assegurar a necessária coordenação com os secretariados de outros órgãos internacionais relevantes;

    f) Empenhar-se, sob a orientação da Conferência das Partes, nas disposições administrativas e contratuais que possam ser requeridas para o efectivo cumprimento das suas funções; e

    g) Realizar as outras funções de secretariado especificadas na Convenção e em qualquer dos seus protocolos e também aquelas que possam ser determinadas pela Conferência das Partes.

    3 — A Conferência das Partes, na sua primeira sessão, designará um secretariado permanente e tomará as disposições necessárias para o seu funcionamento.

    ARTIGO 9.º

    Órgão subsidiário de consulta científica e tecnológica

    1 — É criado um órgão subsidiário de consulta científica e tecnológica para facultar à Conferência das Partes e, quando apropriado, aos outros órgãos subsidiários informação e opiniões atempadas sobre assuntos científicos e tecnológicos relativos à Convenção. Este órgão estará aberto à participação de todas as Partes e deverá ser multidisciplinar. Deverá compreender representantes dos governos competentes no domínio relevante de peritagem. Deverá enviar relatórios regulares à Conferência das Partes sobre todos os aspectos do seu trabalho.

    2 — Sob a orientação da Conferência das Partes e apoiando-se nos competentes órgãos internacionais existentes, este órgão deverá:

    a) Fornecer avaliações sobre o estado do conhecimento científico relativo às alterações climáticas e aos seus efeitos;

    b) Preparar avaliações científicas sobre os efeitos das medidas tomadas para a implementação da Convenção;

    c) Identificar tecnologias inovadoras, eficazes e actualizadas e know-how e aconselhar sobre as formas e meios de se promover o desenvolvimento e ou a transferência de tais tecnologias;

    d) Orientar sobre programas científicos e de cooperação internacional em investigação e desenvolvimento relacionados com as alterações climáticas, assim como sobre as formas endógenas e os meios de apoiar o aumento das capacidades nos países em desenvolvimento; e

    e) Dar resposta às perguntas de natureza científica, tecnológica e metodológica que a Conferência das Partes ou os seus órgãos subsidiários lhe possam colocar.

    3 — As funções e os termos de referência deste órgão podem ainda ser objecto de uma maior especificação por parte da Conferência das Partes.

    ARTIGO 10.º

    Órgão subsidiário de implementação

    1 — É criado um órgão subsidiário de implementação para assistir a Conferência das Partes na avaliação e no exame da implementação efectiva da Convenção. Este órgão estará aberto à participação de todas as Partes e compreenderá representantes dos governos que sejam peritos em assuntos relativos às alterações climáticas. Deverá enviar à Conferência das Partes relatórios regulares sobre todos os aspectos da sua actividade.

    2 — Sob a orientação da Conferência das Partes, este órgão deverá:

    a) Considerar a informação comunicada ao abrigo do parágrafo 1 do artigo 12.º para avaliar o efeito cumulativo global dos passos dados pelas Partes, à luz das mais recentes avaliações científicas relativas às alterações climáticas;

    b) Considerar a informação comunicada ao abrigo do parágrafo 2 do artigo 12.º, de modo a apoiar a Conferência das Partes no exame requerido pela alínea d) do parágrafo 2 do artigo 4.º; e

    c) Dar assistência à Conferência das Partes, quando apropriado, na preparação e na implementação das suas decisões.

    ARTIGO 11.º

    Mecanismo financeiro

    1 — Fica aqui definido um mecanismo para a provisão de recursos financeiros numa base de doação ou de concessão, incluindo a transferência de tecnologia. Deverá funcionar sob a direcção da Conferência das Partes e ser responsável perante ela, devendo esta decidir sobre as suas políticas, programas prioritários e critérios elegíveis relativos a esta Convenção. A sua gestão será confiada a uma ou mais das entidades internacionais existentes.

    2 — O mecanismo financeiro deverá possuir uma representação equitativa e equilibrada de todas as Partes, dentro de um sistema de gestão transparente.

    3 — A Conferência das Partes e a entidade ou entidades incumbidas da gestão do mecanismo financeiro deverão acordar sobre as modalidades destinadas a efectivar as disposições dos parágrafos anteriores, as quais deverão incluir o seguinte:

    a) As modalidades para garantir que os projectos financiados relacionados com as alterações climáticas estejam em conformidade com as políticas, programas prioritários e critérios elegíveis determinados pela Conferência das Partes;

    b) As modalidades segundo as quais uma dada decisão de financiamento pode ser reconsiderada à luz dessas políticas, programas prioritários e critérios elegíveis;

    c) Apresentação à Conferência das Partes, pela entidade ou entidades, de relatórios regulares sobre as suas operações de financiamento, o que se enquadra na disposição de responsabilidade definida no parágrafo 1 acima; e

    d) Determinação, de um modo previsível e identificável, dos montantes necessários e disponíveis para o financiamento da implementação desta Convenção e as condições segundo as quais tais montantes serão periodicamente revistos.

    4 — Na sua primeira sessão, a Conferência das Partes deverá tomar as medidas necessárias para implementar as disposições anteriores, revendo e tendo em conta as medidas provisórias referidas no parágrafo 3 do artigo 21.º, e deverá também decidir se estas medidas deverão ser mantidas. Num prazo de quatro anos a Conferência das Partes deverá rever o mecanismo financeiro e tomar as medidas apropriadas.

    5 — As Partes constituídas por países desenvolvidos também poderão disponibilizar e as Partes constituídas por países em desenvolvimento poderão beneficiar de recursos financeiros relativos à implementação desta Convenção através de canais bilaterais, regionais e outros multilaterais.

    ARTIGO 12.º

    Comunicação e informação relativa à implementação

    1 — De acordo com o parágrafo 1 do artigo 4.º, cada Parte deverá comunicar à Conferência das Partes, através do Secretariado, os seguintes elementos informativos:

    a) Um inventário nacional das emissões antropogénicas por fontes e das remoções pelos semidouros de todos os gases de efeito de estufa não controlados pelo Protocolo de Montreal, na medida das suas capacidades, utilizando metodologias comparáveis a serem promovidas e acordadas pela Conferência das Partes;

    b) Uma descrição geral das etapas tomadas ou visionadas pela Parte para implementar a Convenção; e

    c) Qualquer outra informação que a Parte considere ser relevante para o alcance dos objectivos da Convenção e deseje ser incluída na sua comunicação, incluindo, se possível, a matéria relevante para o cálculo das tendências das emissões globais.

    2 — Cada Parte constituída por um país desenvolvido e cada uma das Partes incluídas no anexo I deverão incluir, na sua comunicação, os seguintes elementos informativos:

    a) Uma descrição pormenorizada das políticas e das medidas que adoptou para implementar o seu compromisso ao abrigo das alíneas a) e b) do parágrafo 2 do artigo 4.º; e

    b) Uma estimativa específica dos efeitos que as políticas e as medidas referidas na alínea a) acima irão ter sobre as emissões antropogénicas por fontes e sobre a remoção pelos sumidouros dos gases de efeito de estufa durante o período referido na alínea a) do parágrafo 2 do artigo 4.º

    3 — Além disso, cada Parte constituída por um país desenvolvido e cada outra Parte desenvolvida incluídas no anexo II deverão incluir pormenores sobre as medidas tomadas de acordo com os parágrafos 3, 4 e 5 do artigo 4.º

    4 — As Partes constituídas por países em desenvolvimento podem, numa base voluntária, propor projectos para financiamento, incluindo tecnologias específicas, materiais, equipamento, técnicas ou práticas que sejam necessárias para implementar tais projectos, acompanhados, se possível, de uma estimativa de todos os custos incrementais, das reduções das emissões e dos aumentos da remoção de gases com efeito de estufa, assim como de uma estimativa dos benefícios resultantes.

    5 — Cada Parte constituída por um país desenvolvido e cada uma das Partes incluídas no anexo I deverá realizar a sua comunicação inicial num prazo de seis meses a partir da entrada em vigor da Convenção relativamente a essa Parte. Cada Parte que não pertença à lista acima definida deverá fazer a sua comunicação inicial num prazo de três anos a partir da entrada em vigor da Convenção para essa Parte ou a partir da disponibilização dos recursos financeiros, de acordo com o parágrafo 3 do artigo 4.º As Partes constituídas pelos países menos desenvolvidos podem fazer a sua comunicação inicial quando lhes aprouver. A frequência das comunicações subsequentes por todas as Partes será determinada pela Conferência das Partes, tendo em conta o agendamento diferenciado estabelecido neste parágrafo.

    6 — A informação comunicada pelas Partes ao abrigo deste artigo será transmitida pelo Secretariado, o mais cedo possível, à Conferência das Partes e a qualquer dos órgãos subsidiários. Se necessário, os processos de comunicação de informação poderão ser alvo de um estudo mais aprofundado pela Conferência das Partes.

    7 — A partir da sua primeira sessão, a Conferência das Partes deverá tomar as medidas necessárias para fornecer, a seu pedido, às Partes constituídas por países em desenvolvimento os apoios técnicos e financeiros para a compilação e para a comunicação de informação nos termos deste artigo, assim como para identificar as necessidades técnicas e financeiras associadas aos projectos propostos e às medidas de resposta previstos no artigo 4 º Tal apoio pode ser facultado por outras Partes por organizações internacionais competentes e pelo Secretariado, consoante o que for apropriado.

    8 — Qualquer grupo de Partes pode, sujeito às linhas orientadoras adoptadas pela Conferência das Partes e à sua notificação prévia, fazer uma comunicação conjunta para cumprimento das suas obrigações nos termos deste artigo, desde que tal comunicação inclua informação sobre o cumprimento, por cada uma das Partes, das suas obrigações individuais nos termos desta Convenção.

    9 — A informação recebida pelo Secretariado que seja designada como confidencial por uma Parte, de acordo com os critérios a estabelecer pela Conferência das Partes, será agregada pelo Secretariado para proteger a sua natureza confidencial antes de ser colocada à disposição de qualquer dos órgãos envolvidos na comunicação e no exame da informação.

    10 — Sujeito aos termos do parágrafo 9 acima e sem prejuízo da capacidade de qualquer Parte para fazer a sua comunicação em qualquer momento, o Secretariado deverá tornar públicas, nos termos deste artigo, as comunicações das Partes no momento em que estas forem apresentadas à Conferência das Partes.

    ARTIGO 13.º

    Resolução de questões relativas à implementação da Convenção

    Na sua primeira sessão, a Conferência das Partes deverá considerar o estabelecimento de um processo consultivo multilateral, acessível às Partes, a seu pedido, para a resolução de questões relativas à implementação da Convenção.

    ARTIGO 14.º

    Resolução de conflitos

    1 — Caso haja um conflito entre duas ou mais Partes relativamente à interpretação ou à aplicação da Convenção, as Partes interessadas deverão procurar resolvê-lo através da negociação ou de qualquer outro meio pacífico da sua própria escolha.

    2 — Ao ratificar, aceitar, aprovar ou aceder à Convenção, ou em qualquer momento posterior, uma Parte que não seja uma organização de integração económica regional pode declarar, em instrumento escrito apresentado ao depositário, que, relativamente a qualquer conflito relativo à interpretação ou à aplicação da Convenção, reconhece como compulsória ipso facto e sem qualquer acordo especial relativamente a qualquer Parte que aceite a mesma obrigação:

    a) A submissão do conflito ao Tribunal Internacional de Justiça; e ou

    b) A arbitragem, de acordo com os procedimentos a serem adoptados, logo que possível, pela Conferência das Partes e que estarão presentes num anexo relativo à arbitragem.

    Uma Parte que seja uma organização de integração económica regional pode fazer uma declaração para o mesmo efeito, relativamente à arbitragem, de acordo com os termos referidos na alínea b) supra.

    3 — A declaração feita ao abrigo do parágrafo 2 supra manter-se-á em vigor até que expire segundo os seus termos ou no prazo de três meses depois de a notificação escrita de revogação ter sido entregue ao depositário.

    4 — Uma nova declaração, uma notificação de revogação ou a expiração da declaração não terá qualquer efeito sobre os processos pendentes perante o Tribunal Internacional de Justiça ou perante o tribunal de arbitragem, a não ser que as Partes em conflito decidam diversamente.

    5 — Sujeito aos termos do parágrafo 2 supra, se forem decorridos 12 meses sobre a notificação por uma das Partes à outra de que existe um conflito entre elas e que as Partes envolvidas não tenham conseguido solucionar esse conflito pelos meios referidos no parágrafo 1, a questão será, a pedido de qualquer das Partes, submetida à conciliação.

    6 — A comissão de conciliação será criada mediante o pedido de uma das Partes no conflito. A comissão será composta por um número igual de membros nomeados por cada uma das Partes interessadas e por um presidente escolhido conjuntamente pelos membros nomeados por cada uma das Partes. A comissão fará uma recomendação, a qual será considerada como sendo de boa fé pelas Partes.

    7 — A Conferência das Partes deverá adoptar, logo que possível, outros processos relativos à conciliação num anexo sobre a conciliação.

    8 — As disposições deste artigo serão aplicáveis a qualquer instrumento legal que a Conferência das Partes possa vir a adoptar, a não ser que esse instrumento determine de outra forma.

    ARTIGO 15.º

    Emendas à Convenção

    1 — Qualquer Parte pode propor emendas à Convenção.

    2 — As emendas à Convenção serão adoptadas em sessão ordinária da Conferência das Partes. O texto de qualquer proposta de emenda à Convenção será comunicado às Partes pelo Secretariado pelo menos seis meses antes da sessão na qual será proposta a sua adopção. O Secretariado também deverá comunicar as propostas de emendas aos signatários da Convenção e, para informação, ao depositário.

    3 — As Partes farão todos os esforços para conseguir chegar, por consenso, a um acordo sobre qualquer emenda proposta. Uma vez esgotados todos os esforços para se conseguir o consenso sem que a emenda tenha sido adoptada, esta, como último recurso, será adoptada por uma maioria de três quartos dos votos das Partes presentes e votantes na sessão. A emenda adoptada será comunicada pelo Secretariado ao depositário, o qual deverá distribuí-la às Partes para aceitação.

    4 — Os instrumentos de aceitação relativos a uma emenda serão depositados junto do depositário. Uma emenda adoptada de acordo com os termos do parágrafo supra entrará em vigor, para aquelas Partes que a aceitaram, no 90.º dia após a data de recepção pelo depositário de um instrumento de aceitação de pelo menos três quartos das Partes da Convenção.

    5 — A emenda entrará em vigor para qualquer outra Parte no 90.º dia após a data em que essa Parte depositou junto do depositário o seu instrumento de aceitação da referida emenda.

    6 — Para os efeitos deste artigo, «as Partes presentes e votantes» significa as Partes presentes e que votam afirmativa ou negativamente.

    ARTIGO 16º

    Adopção e emendas aos anexos da Convenção

    1 — Os anexos à Convenção serão parte integrante dela; a não ser que diversamente especificado, uma referência à Convenção constitui, ao mesmo tempo, uma referência a quaisquer anexos a ela. Sem prejuízo das disposições da alínea b) do parágrafo 2 e do parágrafo 7 do artigo 14.º, tais anexos limitar-se-ão a listas, formulários e qualquer outro material de natureza descritiva que tenha um carácter científico, técnico, processual ou administrativo.

    2 — Os anexos à Convenção serão propostos e adoptados segundo o processo estabelecido nos parágrafos 2, 3 e 4 do artigo 15.º

    3 — Um anexo que tenha sido adoptado de acordo com o parágrafo 2 supra entrará em vigor para todas as Partes da Convenção seis meses depois da data da comunicação pelo depositário às Partes da adopção desse anexo, com excepção daquelas Partes que tenham notificado o depositário, por escrito, dentro desse prazo, da não aceitação do anexo. O anexo entrará em vigor para as Partes que tenham retirado a sua notificação de não aceitação no 90.º dia após a data em que tal notificação de retirada de não aceitação tenha sido recebida pelo depositário.

    4 — A proposta, a adopção e a entrada em vigor das emendas aos anexos à Convenção estarão sujeitas ao mesmo processo utilizado para a proposta, aprovação e entrada em vigor dos anexos à Convenção, nos termos dos parágrafos 2 e 3 supra.

    5 — Se a adopção de um anexo ou de uma emenda a um anexo implicar uma emenda à Convenção, esse anexo ou emenda a um anexo só entrarão em vigor no momento em que a emenda à Convenção entre em vigor.

    ARTIGO 17.º

    Protocolos

    1 — A Conferência das Partes pode, em qualquer sessão ordinária, adoptar protocolos para a Convenção.

    2 — O texto de qualquer protocolo proposto será comunicado às Partes, pelo Secretariado, pelo menos seis meses antes de tal sessão.

    3 — Os requisitos para a entrada em vigor de qualquer protocolo serão estabelecidos pelo próprio instrumento.

    4 — Só as Partes da Convenção podem ser Partes num protocolo.

    5 — As decisões ao abrigo de qualquer protocolo só poderão ser tomadas pelas Partes nesse protocolo.

    ARTIGO 18.º

    Direito de voto

    1 — Cada Parte da Convenção terá direito a um voto, excepto nos casos previstos no parágrafo 2 abaixo.

    2 — Em assuntos que sejam da sua competência, as organizações de integração económica regional deverão exercer o seu direito de voto com um número de votos igual ao número dos seus Estados membros que sejam Partes da Convenção. Tal organização não poderá exercer o seu direito de voto se algum dos seus Estados membros exercer esse direito, e vice-versa.

    ARTIGO 19.º

    Depositário

    O Secretário-Geral das Nações Unidas será o depositário da Convenção e dos protocolos adoptados segundo os termos do artigo 17.º

    ARTIGO 20.º

    Assinatura

    Esta Convenção estará aberta para a assinatura pelos Estados membros das Nações Unidas, ou por qualquer das suas agências especializadas ou pelos Estados Partes do Estatuto do Tribunal Internacional de Justiça e pelas organizações de integração económica regional, no Rio de Janeiro, durante a CNUAD, e depois na sede das Nações Unidas, em Nova Iorque, de 20 de Junho de 1992 a 19 de Junho de 1993.

    ARTIGO 21.º

    Disposições provisórias

    1 — As funções do Secretariado referidas no artigo 8.º serão desempenhadas, numa base provisória, pelo Secretariado estabelecido pela Assembleia Geral das Nações Unidas na sua Resolução n.º 45/212, de 21 de Dezembro de 1990, até ao termo da primeira sessão da Conferência das Partes.

    2 — A chefia do Secretariado provisório referido no parágrafo 1 supra deverá cooperar estreitamento com o Painel Intergovernamental sobre as Alterações Climáticas para garantir que o Painel possa responder à necessidade de haver conselhos científicos e técnicos objectivos. Também podem ser consultados outros órgãos científicos relevantes.

    3 — O Fundo para o Ambiente do Globo do Programa das Nações Unidas para o Desenvolvimento, o Programa das Nações Unidas para o Ambiente e o Banco Internacional para a Reconstrução e Desenvolvimento serão, numa base provisória, a entidade internacional encarregada da gestão do mecanismo financeiro referido no artigo 11.º Neste contexto o Fundo para o Ambiente do Globo deveria ser apropriadamente reestruturado e o direito de associação tornado universal para dar total cumprimento ao estabelecimento no artigo 11.º

    ARTIGO 22.º

    Ratificação, aceitação, aprovação ou acessão

    1 — A Convenção ficará sujeita à ratificação, aceitação, aprovação ou acessão pelos Estados e pelas organizações de integração económica regional. Estará aberta a acessão a partir do dia seguinte à data em que for encerrada à assinatura. Os instrumentos de ratificação, aceitação, aprovação ou acessão serão depositados junto do depositário.

    2 — Qualquer organização de integração económica regional que se torne Parte da Convenção sem que qualquer dos seus Estados membros seja Parte ficará ligada pelas obrigações resultantes da Convenção. No caso de um ou mais Estados membros dessa organização serem Parte da Convenção a organização e os seus Estados membros deverão decidir sobre as suas responsabilidades respectivas para o cumprimento das suas obrigações nos termos da Convenção. Em tais casos, a organização e os seus Estados membros não poderão exercer conjuntamente os seus direitos ao abrigo da Convenção.

    3 — Nos seus instrumentos de ratificação, aceitação, aprovação ou acessão, as organizações de integração económica regional deverão declarar a extensão das suas competências relativamente aos assuntos regidos pela Convenção. Estas organizações deverão também informar o depositário, que por sua vez informará as Partes, de qualquer alteração substancial na extensão das suas competências.

    ARTIGO 23.º

    Entrada em vigor

    1 — A Convenção entrará em vigor no 90.º dia após a data do depósito do 50.º instrumento de ratificação, aceitação, aprovação ou acessão.

    2 — Para cada Estado ou organização de integração económica regional que ratifique, aceite ou aprove a Convenção ou aceda a ela depois de ter sido depositado o 50.º instrumento de ratificação, aceitação, aprovação ou acessão, a Convenção entrará em vigor no 90.º dia após a data do depósito, por tal Estado ou organização de integração económica regional, do seu instrumento de ratificação, aceitação, aprovação ou acessão.

    3 — Para os efeitos dos parágrafos 1 e 2 supra, qualquer instrumento depositado por uma organização de integração económica regional não será contado como adicional aos instrumentos depositados pelos Estados membros da organização.

    ARTIGO 24.º

    Reservas

    Não podem ser manifestadas reservas à Convenção.

    ARTIGO 25.º

    Retirada

    1 — Decorridos três anos a partir da data em que a Convenção entrou em vigor para uma Parte, essa Parte pode, a qualquer momento, retirar-se da Convenção mediante notificação escrita ao depositário.

    2 — Qualquer retirada produzirá efeito decorrido um ano sobre a data de recepção, pelo depositário, da notificação de retirada ou em data posterior que possa ter sido especificada na notificação de retirada.

    3 — Qualquer Parte que se retire da Convenção será considerada como tendo-se também retirado de qualquer protocolo de que seja Parte.

    ARTIGO 26.º

    Textos autênticos

    O original desta Convenção, cujos textos em árabe, chinês, inglês, francês, russo e espanhol são igualmente autênticos, será depositado junto do Secretário-Geral das Nações Unidas.

    Em virtude do que os abaixo assinados, devidamente autorizados para tal, assinaram esta Convenção.
