    AGREEMENT

    BETWEEN

    THE MACAO SPECIAL ADMINISTRATIVE REGION OF THE PEOPLE’S REPUBLIC OF CHINA

    AND

    THE FEDERAL REPUBLIC OF NIGERIA

    ON

    THE TRANSFER OF SENTENCED PERSONS

    The Macao Special Administrative Region of the People’s Republic of China (“Macao SAR”), having been duly authorised to conclude this Agreement by the Central People’s Government of the People’s Republic of China, and the Federal Republic of Nigeria, hereinafter referred to as the “Parties” and in the singular the “Party”.

    DESIROUS of promoting effective cooperation between the two Parties on the transfer of sentenced persons for the purpose of facilitating their rehabilitation and social reintegration,

    CONVINCED that this purpose can be achieved through the conclusion of a bilateral agreement establishing that persons who are deprived of their liberty as a consequence of a criminal conviction may serve their sentences in their country or region,

    REAFFIRMING that sentenced persons shall enjoy their inherent right to dignity based on the universal respect for human rights,

    Have agreed as follows:

    ARTICLE 1

    Definitions

    For the purposes of this Agreement:

    (a) “Transferring Party” means the Party from whose jurisdiction the sentenced person may be, or has been, transferred;

    (b) “Receiving Party” means the Party to whose jurisdiction the sentenced person may be, or has been, transferred;

    (c) “sentence” means any punishment or measure involving deprivation of liberty ordered by a court of competent jurisdiction for a limited or determined period of time in the course of the exercise of its criminal jurisdiction;

    (d) “sentenced person” means a person who is required to be detained in a prison, a hospital or any other institution in the jurisdiction of the Transferring Party to serve a sentence;

    (e) “judgment” means a final decision or order of a competent court imposing a sentence which is no longer subject to appeal;

    (f) “legal representative” means a person duly authorised to represent a sentenced person in accordance with the laws of the Parties;

    (g) “permanent resident” means the status of a person as defined under the law of the Macao SAR.

    ARTICLE 2

    General Principle

    A sentenced person may be transferred from the jurisdiction of the Transferring Party to the jurisdiction of the Receiving Party in accordance with the provisions of this Agreement in order to serve the sentence imposed on him.

    ARTICLE 3

    Central Authorities

    1. The Central Authorities of the Parties shall process requests for transfer in accordance with the provisions of this Agreement.

    2. The Central Authority for the Macao SAR shall be the Secretariat for Administration and Justice of the Macao SAR. The Central Authority for the Federal Republic of Nigeria shall be the Office of the Attorney-General of the Federation and Minister of Justice. Either Party may change its Central Authority, in which case it shall promptly notify the other Party of such change in writing.

    3. The Macao SAR Central Authority will communicate directly with the Nigerian Central Authority or where necessary through diplomatic channel for the purposes of this Agreement. The Nigerian Central Authority will communicate directly with the Macao SAR Central Authority for the purposes of this Agreement.

    ARTICLE 4

    Conditions for Transfer

    A sentenced person may be transferred only on the following conditions:

    (a) the conduct on account of which the sentence has been imposed would constitute a criminal offence according to the law of the Receiving Party if it had been committed within the jurisdiction of its courts;

    (b) where the Macao SAR is the Receiving Party, the sentenced person is a permanent resident of the Macao SAR;

    (c) where the Federal Republic of Nigeria is the Receiving Party, the sentenced person is a national of the Federal Republic of Nigeria;

    (d) the judgement is final, and no further proceedings relating to the offence or any other offence committed by the sentenced person are pending in the jurisdiction of the Transferring Party;

    (e) the sentence imposed on the sentenced person is for a limited period of which at least one year remains to be served at the time of the request for transfer, provided that in exceptional cases, the Parties may still seek a transfer through consultations even if the sentenced person has less than one year of the sentence to serve;

    (f) the Transferring and Receiving Parties and the sentenced person all agree to the transfer, provided that, where in view of age or physical or mental condition either Party considers it necessary, the sentenced person’s consent may be given by his legal representative.

    ARTICLE 5

    Rights of Sentenced Person

    1. A sentenced person may express to either the Transferring Party or the Receiving Party his interest in being transferred under this Agreement.

    2. A sentenced person whose transfer is requested under this Agreement:

    (a) shall be informed by the Transferring Party of the substance of this Agreement;

    (b) shall have the terms of the transfer explained to him in writing in the language the sentenced person understands;

    (c) shall give a written consent to be transferred to the authorities of the Transferring Party.

    3. A sentenced person transferred to the Receiving Party shall have the same right and legal consequence as any other person sentenced under its jurisdiction for a similar offence, without prejudice to Article 7 of this Agreement.

    4. A sentenced person under this Agreement shall not be subjected to torture, cruel, inhuman or degrading treatment.

    5. A sentenced person transferred to the Receiving Party shall not be prosecuted again for the same offence on account of which he was sentenced in the Transferring Party.

    ARTICLE 6

    Procedure for Transfer

    1. The Parties shall endeavour to inform sentenced persons that they may apply for transfer under this Agreement. If a sentenced person wishes to be transferred, he may express such a wish to either Party.

    2. A request for transfer shall be made in writing by the Transferring Party or the Receiving Party to the other Party. The Transferring Party or the Receiving Party shall consider the wish of the sentenced person against the criteria set out in Article 4 of this Agreement before deciding whether to request or accept a transfer.

    3. Where a request for transfer has been made, the Transferring Party shall provide the Receiving Party with the following information:

    (a) personal particulars of the sentenced person, including:

    (i) name and gender;

    (ii) names of parents;

    (iii) nationality, date and place of birth;

    (iv) travel document;

    (v) the address of the place of abode in the Receiving Party, if available;

    (b) an authenticated copy of the judgment or a copy of the certificate of the conviction and sentence;

    (c) the termination date of the sentence, if applicable, and the length of time already served by the sentenced person and any remissions to which he is entitled on account of work done, good behaviour, pre-trial confinement or other reasons;

    (d) a statement of the facts upon which the conviction and sentence were based and a statement of the law providing for the relevant offence;

    (e) a declaration containing the written consent of the sentenced person or if he is not in a position to freely express his consent by reason of his age, physical or mental condition, that of his legal representative;

    (f) where appropriate, any medical reports on the sentenced person and information about his treatment in custody;

    (g) documentary proof showing or a declaration stating that the sentenced person is a national or permanent resident of the Receiving Party.

    4. Either Party shall, as far as possible, provide the other Party, if it so requests, with any relevant information, documents or statements before making a request for transfer or taking a decision on whether or not to agree to the transfer.

    5. If the request for transfer is accepted, the Receiving Party shall provide in writing the following information:

    (a) a statement indicating that the sentenced person is a national or a permanent resident of the Receiving Party for the purpose of this Agreement;

    (b) a copy of the relevant law of the Receiving Party which provides that the acts or omissions on account of which the sentence has been imposed in the Transferring Party constitute a criminal offence according to the law of the Receiving Party, or would constitute a criminal offence if committed in its jurisdiction;

    (c) a statement to the effect, in relation to the sentenced person, of any law or regulation relating to that person’s detention in the Receiving Party after that person’s transfer, including information related to the nature, duration and enforcement of the sentence;

    (d) a statement of any outstanding charges, convictions or criminal investigations in respect of the sentenced person.

    6. The Transferring Party shall afford an opportunity to the Receiving Party, if the Receiving Party so desires, to verify through a consular or any other authorised official designated by the Receiving Party, prior to the transfer, that the sentenced person’s consent to the transfer in accordance with Article 4(f) of this Agreement is given voluntarily and with full knowledge of the consequences thereof.

    7. Where the Parties have agreed to the transfer, the Transferring Party shall make arrangement for the transfer of the sentenced person. Delivery of the sentenced person by the authorities of the Transferring Party to those of the Receiving Party shall occur on a date at a place within the jurisdiction of the Transferring Party agreed by both Parties.

    8. If any Party decides not to agree to the transfer, it shall inform the other of its decision in writing.

    ARTICLE 7

    Retention of Jurisdiction

    The Transferring Party shall retain jurisdiction for ruling on any appeal lodged for a retrial regarding the judgement, or for the review of convictions and sentences imposed by its courts.

    ARTICLE 8

    Procedure for Enforcement of Sentence

    1. The continued enforcement of the sentence after transfer shall be governed by the laws and procedures of the Receiving Party, including those governing conditions for service of imprisonment, confinement or other deprivation of liberty, and those providing for the reduction of the term of imprisonment, confinement or other deprivation of liberty by parole, conditional release, remission or otherwise.

    2. Subject to paragraph 3 of this Article, the Receiving Party shall, when enforcing the sentence, be bound by the duration or termination date of the sentence imposed by the Transferring Party.

    3. If the sentence is by its nature or duration incompatible with the law of the Receiving Party, that Party may adapt the sentence in accordance with the sentence prescribed by its own law for a similar offence. In this case, the Central Authority of the Receiving Party shall inform the Transferring Party of the proposed adaptation of the sentence before deciding whether to agree to the transfer.

    4. When adapting the sentence, the appropriate authorities of the Receiving Party shall be bound by the facts stated in the judgment of the court of the Transferring Party. The adapted sentence shall be no severer than that imposed by the Transferring Party in terms of nature or duration. A sentence of deprivation of liberty shall not be converted into one of deprivation of property or of any other forms not involving deprivation of liberty.

    5. The Receiving Party may, if a sentenced person would be a juvenile according to its law, treat the sentenced person as a juvenile regardless of his status under the law of the Transferring Party.

    6. The Receiving Party shall forthwith modify or terminate the enforcement of the sentence after it has been informed of any decision by the Transferring Party in accordance with Article 7 of this Agreement to pardon the sentenced person, or of any other decision or measure of the Transferring Party that results in cancellation or reduction of the sentence.

    7. The Receiving Party shall inform the Transferring Party:

    (a) when the sentenced person is discharged;

    (b) if the sentenced person is granted conditional release;

    (c) if the sentenced person has escaped from custody before enforcement of the sentence has been completed; or

    (d) if the sentenced person is unable to complete the sentence for any reason.

    8. The Receiving Party shall, if the Transferring Party so requests, provide any other information requested in relation to the enforcement of the sentence.

    ARTICLE 9

    Transit of Sentenced Person

    If either Party intends to transfer a sentenced person to or from the jurisdiction of a third Party, the other Party shall, insofar as not contrary to its laws, co-operate in facilitating the transit through its jurisdiction of such a sentenced person. The Party intending to make such a transfer shall give advance notice to the other Party of such transit.

    ARTICLE 10

    Property and Assets of Sentenced Person

    1. The Parties shall facilitate the transfer of property, assets and equity instruments of a sentenced person that are not confiscated by law.

    2. The Parties shall ensure that a sentenced person is aware of his property rights and guarantee his access to legal counsel and aid.

    ARTICLE 11

    Language

    A request for transfer submitted pursuant to this Agreement and all other relevant documents and information that should be provided shall be accompanied by a translation into the official language of the Receiving Party or into the English language.

    ARTICLE 12

    Costs

    All costs of the transfer and transportation of a sentenced person shall be borne by the Transferring Party until the time of delivery of the sentenced person to the jurisdiction of the Receiving Party.

    ARTICLE 13

    Other International Obligations

    This Agreement shall not affect the implementation of both Parties of any international agreements, conventions, treaties or protocols applicable to them.

    ARTICLE 14

    Amendment

    1. This Agreement may be amended by mutual consent of the Parties following the conclusion of their internal procedures. Such amendment shall be communicated to the Macao SAR through the Central Authority and to the Federal Republic of Nigeria through diplomatic channel or the Central Authority.

    2. Any amendment agreed upon by the Parties is an integrated part of this Agreement.

    ARTICLE 15

    Settlement of Disputes

    Any dispute arising out of the interpretation, application or implementation of this Agreement shall be resolved by the Central Authorities of the Parties through consultations. If the Central Authorities are unable to reach an agreement, the dispute shall be resolved through diplomatic channels.

    ARTICLE 16

    Unexpired and Existing Obligations

    The termination of this Agreement shall not affect the implementation of programmes and projects initiated while the Agreement is in force but cannot be completed by the date of the termination. Any such programme or project shall be carried on to completion unless otherwise agreed by the Parties.

    ARTICLE 17

    Entry into Force and Termination

    1. This Agreement shall enter into force thirty (30) days after the date of exchange of notes by the Parties in writing that their respective legal procedures requirements for the entry into force of the Agreement have been complied with.

    2. This Agreement shall be applicable to the transfer of a sentenced person who has been sentenced either before or after the entry into force of this Agreement.

    3. Either Party may terminate this Agreement at any time by written notification to the other Party. Such termination shall become effective at the expiration of one hundred and eighty (180) days after the date of receipt of notification.

    In witness whereof, the undersigned being duly authorised thereto by their respective Governments, have signed this Agreement in two originals, in the English and Chinese languages, both texts being equally authentic.

    SOBRE

    A TRANSFERÊNCIA DE PESSOAS CONDENADAS

    A Região Administrativa Especial de Macau da República Popular da China («RAE de Macau»), tendo sido devidamente autorizada a celebrar o presente Acordo pelo Governo Popular Central da República Popular da China, e a República Federal da Nigéria, doravante referidas como as «Partes», e no singular como a «Parte»;

    DESEJANDO promover uma cooperação efectiva entre as duas Partes no que se refere à transferência de pessoas condenadas, com o objectivo de favorecer a sua reabilitação e reinserção social;

    CONVENCIDAS de que este objectivo pode ser alcançado através da celebração de um acordo bilateral estabelecendo que as pessoas que se encontram privadas da sua liberdade em consequência de uma sentença condenatória podem cumprir pena no país ou região a que pertencem;

    REAFIRMANDO que as pessoas condenadas devem gozar do direito inerente à sua dignidade com base fundamento no respeito universal pelos direitos humanos;

    Acordam no seguinte:

    Artigo 1.º

    Definições

    Para os fins do presente Acordo:

    a) «Parte transferente» significa a Parte de cuja jurisdição a pessoa condenada pode ser ou foi transferida;

    b) «Parte receptora» significa a Parte para cuja jurisdição a pessoa condenada pode ser ou foi transferida;

    c) «Pena» significa qualquer pena ou medida privativa da liberdade, com duração limitada ou determinada, imposta por um tribunal no exercício da sua competência judicial em matéria penal;

    d) «Pessoa condenada» significa uma pessoa que se encontra detida em estabelecimento prisional, hospital ou em qualquer outra instituição na jurisdição da Parte transferente a cumprir uma pena;

    e) «Sentença» significa uma decisão final ou uma ordem de um tribunal competente para impor uma pena que já não é susceptível de recurso;

    f) «Representante legal» significa uma pessoa devidamente autorizada a representar uma pessoa condenada em conformidade com a legislação das Partes;

    g) «Residente permanente» significa o estatuto de uma pessoa tal como definido nos termos da lei da RAE de Macau.

    Artigo 2.º

    Princípio geral

    Uma pessoa condenada pode ser transferida da jurisdição da Parte transferente para a jurisdição da Parte receptora, em conformidade com as disposições do presente Acordo, para aí cumprir a pena que lhe foi imposta.

    Artigo 3.º

    Autoridades centrais

    1. Compete às autoridades centrais das Partes formular os pedidos de transferência em conformidade com as disposições do presente Acordo.

    2. A autoridade central na RAE de Macau é a Secretária para a Administração e Justiça da RAE de Macau. A autoridade central da República Federal da Nigéria é o Gabinete do Procurador-Geral da Federação e Ministro da Justiça. Qualquer Parte no presente Acordo pode alterar a sua autoridade central; nesse caso, deve notificar tal facto imediatamente, por escrito, à outra Parte.

    3. A autoridade central da RAE de Macau comunicará directamente com a autoridade central da Nigéria ou, quando necessário, pela via diplomática para os fins do presente Acordo. A autoridade central da Nigéria comunicará directamente com a autoridade central na RAE de Macau para os fins do presente Acordo.

    Artigo 4.º

    Condições de transferência

    A transferência de pessoa condenada apenas pode ter lugar nas seguintes condições:

    a) A conduta que originou a condenação constituiria também um crime na lei da Parte receptora, caso tivesse sido praticada na sua jurisdição;

    b) Quando a RAE de Macau é a Parte receptora e a pessoa condenada é residente permanente da RAE de Macau;

    c) Quando a República Federal da Nigéria é a Parte receptora e a pessoa condenada é nacional da República Federal da Nigéria;

    d) A sentença é final e não existem processos pendentes sobre o mesmo crime ou qualquer outro crime praticado pela pessoa condenada na jurisdição da Parte transferente;

    e) A duração da pena imposta à pessoa condenada é por um período limitado, e ainda falta por cumprir, na data da apresentação do pedido de transferência, pelo menos um período não inferior a um ano, sendo que, em casos excepcionais, as Partes podem ainda, através de consultas, acordar na transferência da pessoa condenada mesmo que o período a cumprir seja inferior a um ano;

    f) A Parte transferente, a Parte receptora e a pessoa condenada tenham consentido na transferência, na condição de que o consentimento da pessoa condenada pode ser expresso pelo seu representante legal, quando qualquer uma das Partes considere necessário em virtude da idade ou do estado físico ou mental da pessoa condenada.

    Artigo 5.º

    Direitos da pessoa condenada

    1. A pessoa condenada pode manifestar interesse em ser transferida, ao abrigo do presente Acordo, quer à Parte transferente quer à Parte receptora.

    2. Uma pessoa condenada cuja transferência seja pedida ao abrigo do presente Acordo:

    a) Deve ser informada pela Parte transferente do conteúdo do presente Acordo;

    b) Deve ter conhecimento dos termos da transferência por escrito, na língua que a pessoa condenada domine;

    c) Deve dar o consentimento da transferência por escrito às autoridades da Parte transferente.

    3. A pessoa condenada transferida para a Parte receptora deve ter os mesmos direitos e consequências jurídicas que qualquer outra pessoa condenada sob a sua jurisdição por crime de idêntica natureza, sem prejuízo do disposto no artigo 7.º do presente Acordo.

    4. A pessoa condenada abrangida pelo presente Acordo não pode ser sujeita a tortura, a tratamento cruel, desumano ou degradante.

    5. A pessoa condenada transferida para a Parte receptora não pode ser criminalmente acusada pelo mesmo crime pelo qual foi condenada na Parte transferente.

    Artigo 6.º

    Procedimentos de transferência

    1. As Partes devem informar as pessoas condenadas de que estas podem pedir a transferência ao abrigo do presente Acordo. No caso de uma pessoa condenada desejar ser transferida, esta pode manifestar a sua vontade junto de qualquer Parte.

    2. O pedido de transferência deve ser apresentado por escrito pela Parte transferente ou pela Parte receptora à outra Parte. Antes de decidirem sobre a apresentação ou sobre a aceitação do pedido de transferência, a Parte transferente ou a Parte receptora deve considerar a vontade da pessoa condenada, tendo em atenção as condições enunciadas no artigo 4.º do presente Acordo.

    3. Após a formulação do pedido de transferência, a Parte transferente deve fornecer à Parte receptora as seguintes informações:

    a) Dados pessoais da pessoa condenada, incluindo:

    i) nome e género;

    ii) filiação;

    iii) nacionalidade, data e local de nascimento;

    iv) documentos de viagem;

    v) a morada do local de residência na Parte receptora, se disponível;

    b) Uma cópia autenticada da sentença ou uma cópia da certidão da sentença condenatória e da pena;

    c) A data do termo da pena, caso aplicável, e o período de tempo já cumprido pela pessoa condenada, bem como qualquer comutação da pena a que tenha direito em virtude do trabalho prestado, da boa conduta, da prisão preventiva ou por outros motivos;

    d) Uma exposição dos factos que fundamentaram a condenação e a pena, e uma exposição da lei que prevê o crime que lhe foi imputado;

    e) Uma declaração da pessoa condenada contendo o seu consentimento por escrito na transferência, ou o do seu representante legal caso não esteja capaz de exprimir livremente o seu consentimento em razão da sua idade, estado físico ou mental;

    f) Sempre que for caso disso, quaisquer relatórios médicos sobre a pessoa condenada e informações sobre o tratamento que lhe foi administrado enquanto esteve sob custódia;

    g) Prova documental ou uma declaração atestando que a pessoa condenada é nacional ou residente permanente da Parte receptora.

    4. Cada Parte deve, antes de formular um pedido de transferência ou de tomar a decisão de aceitar ou de recusar a transferência, fornecer, tanto quanto possível, à outra Parte, se esta assim o solicitar, quaisquer informações, documentos ou exposições pertinentes.

    5. Se o pedido de transferência for aceite, a Parte receptora deve fornecer, por escrito, as seguintes informações:

    a) Uma declaração a indicar que a pessoa condenada é nacional ou residente permanente da Parte receptora para os fins do presente Acordo;

    b) Uma cópia da legislação pertinente da Parte receptora a dispor que os actos ou omissões pelos quais a pena foi imposta na Parte transferente constituem um crime nos termos da lei da Parte receptora, ou constituiriam um crime caso fossem praticados na sua jurisdição;

    c) Uma declaração, em relação à pessoa condenada, sobre qualquer lei ou regulamento relativo à detenção dessa pessoa na Parte receptora depois da sua transferência, incluindo informação relacionada com a natureza, duração e execução da pena;

    d) Uma exposição sobre outras acusações pendentes, condenações ou investigações criminais que digam respeito à pessoa condenada.

    6. No caso de a Parte receptora pretender verificar, antes da transferência, e através de funcionário consular ou de qualquer outro funcionário por si designado, se o consentimento da pessoa condenada na transferência foi, em conformidade com o disposto na alínea f) do artigo 4.º do presente Acordo, voluntário e com pleno conhecimento das consequências dessa transferência, a Parte transferente deve facultar-lhe essa oportunidade.

    7. Caso tenham acordado na transferência, a Parte transferente deve tomar providências para a transferência da pessoa condenada. A entrega da pessoa condenada pelas autoridades da Parte transferente às autoridades da Parte receptora deve ocorrer numa data e num local situado na jurisdição da Parte transferente, aceite por ambas as Partes.

    8. Se qualquer uma das Partes decidir não aceitar a transferência, a outra Parte deve ser informada por escrito da decisão.

    Artigo 7.º

    Reserva de competência jurisdicional

    À Parte transferente compete decidir sobre qualquer recurso interposto para a revisão da sentença ou para a revisão das condenações e penas impostas pelos seus tribunais.

    Artigo 8.º

    Processo de execução da pena

    1. À continuação da execução da pena após a transferência aplica-se a legislação e os procedimentos da Parte receptora, nomeadamente aqueles que regem as condições do cumprimento das penas de prisão, do isolamento ou de outras formas de privação de liberdade, e aqueles que preveem a redução da duração das penas de prisão, do isolamento ou de outras formas de privação de liberdade através da liberdade condicional, da libertação com condições, da comutação de pena ou outras.

    2. Salvo o disposto no n.º 3 do presente artigo, na execução da pena, a Parte receptora fica vinculada à duração e à data do termo da pena imposta pela Parte transferente.

    3. Se a natureza ou a duração da pena forem incompatíveis com a lei da Parte receptora, a pena pode ser adaptada à pena prevista na sua lei para um crime de idêntica natureza. Neste caso, a autoridade central da Parte receptora deve, antes de tomar a decisão de aceitar a transferência, informar a Parte transferente da proposta de adaptação da pena.

    4. As autoridades competentes da Parte receptora ficam vinculadas aos factos indicados na sentença do tribunal da Parte transferente quando adaptarem a pena. A pena resultante dessa adaptação não pode ser mais grave em termos de natureza ou duração do que a pena imposta pela Parte transferente. Uma pena privativa de liberdade não pode ser convertida numa sanção patrimonial ou noutras formas não privativas de liberdade.

    5. A Parte receptora pode, se uma pessoa condenada for considerada menor face à sua lei, tratar a pessoa condenada com o estatuto de menor, independentemente do seu estatuto jurídico na lei da Parte transferente.

    6. Após ter sido informada de qualquer decisão da Parte transferente, em conformidade com o artigo 7.º do presente Acordo, de conceder perdão à pessoa condenada, ou de qualquer outra decisão ou medida adoptada pela Parte transferente que anule ou reduza a pena, a Parte receptora deve de imediato alterar ou cessar a execução da pena.

    7. A Parte receptora deve informar a Parte transferente:

    a) Quando a pessoa condenada é posta em liberdade;

    b) Se a pessoa condenada é posta em liberdade condicional;

    c) Se ocorrer a evasão da pessoa condenada da prisão antes do termo da execução da pena; ou

    d) Se pessoa condenada estiver incapacitada para cumprir a pena por qualquer motivo.

    8. A Parte receptora deve, se a Parte transferente assim o solicitar, facultar quaisquer outras informações relativas à execução da pena.

    Artigo 9.º

    Trânsito de pessoa condenada

    Qualquer Parte deve cooperar para facilitar o trânsito da pessoa condenada através da área da sua jurisdição, dentro dos limites permitidos pela sua legislação, sempre que a outra Parte pretender transferir uma pessoa condenada de ou para uma terceira jurisdição. A Parte que pretende efectuar a transferência deve notificar com antecedência este facto à outra Parte.

    Artigo 10.º

    Propriedade e bens da pessoa condenada

    1. As Partes devem facilitar a transferência de propriedade, bens e instrumentos patrimoniais de uma pessoa condenada desde que não tenham sido, por lei, objecto de confisco.

    2. As Partes devem assegurar que a pessoa condenada está ciente dos seus direitos de propriedade e devem garantir o seu acesso a aconselhamento jurídico e a apoio judiciário.

    Artigo 11.º

    Línguas

    Um pedido de transferência submetido nos termos do presente Acordo e todos os outros documentos e informações pertinentes a serem facultados devem ser acompanhados de uma tradução para a língua oficial da Parte receptora ou para a língua inglesa.

    Artigo 12.º

    Encargos

    Todos os encargos relativos à transferência e transporte de uma pessoa condenada são suportados pela Parte transferente até ao momento da entrega da pessoa condenada às autoridades da jurisdição da Parte receptora.

    Artigo 13.º

    Outras obrigações internacionais

    O presente Acordo não prejudica a execução de quaisquer acordos, convenções, tratados ou protocolos internacionais aplicáveis a ambas as Partes.

    Artigo 14.º

    Emendas

    1. O presente Acordo pode ser objecto de emendas por mútuo consentimento entre as Partes, concluídos os respectivos procedimentos internos. As emendas devem ser comunicadas à RAE de Macau através da autoridade central, e à República Federal da Nigéria pela via diplomática ou através da autoridade central.

    2. Quaisquer emendas acordadas entre as Partes constituem parte integrante do presente Acordo.

    Artigo 15.º

    Resolução de litígios

    Todo o litígio decorrente da interpretação, aplicação ou execução do presente Acordo deve ser resolvido, através de consultas, pelas autoridades centrais das Partes. Caso as autoridades centrais não cheguem a um consenso, o litígio deve ser resolvido pela via diplomática.

    Artigo 16.º

    Obrigações existentes ou inextintas

    O termo do presente Acordo não deve afectar a execução de programas e projectos iniciados durante a vigência do Acordo mas que não foram concluídos antes da data do seu termo. Qualquer um destes programas ou projectos deve prosseguir até à sua conclusão, salvo se as Partes acordarem de diferente modo.

    Artigo 17.º

    Entrada em vigor e denúncia

    1. O presente Acordo entra em vigor trinta (30) dias após a data da última troca de notas por escrito entre as Partes, comunicando o cumprimento das respectivas formalidades legais para a entrada em vigor do Acordo.

    2. O presente Acordo é aplicável à transferência de uma pessoa que tenha sido condenada antes ou depois da entrada em vigor do presente Acordo.

    3. Qualquer uma das Partes pode denunciar o presente Acordo, em qualquer momento, mediante notificação escrita à outra Parte. A denúncia produz efeitos cento e oitenta (180) dias após a data da recepção da referida notificação.

    Em fé do que os abaixo assinados, devidamente autorizados para o efeito pelos respectivos Governos, assinaram o presente Acordo em duplicado, nas línguas inglesa e chinesa, sendo ambos os textos igualmente autênticos.
