Aviso do Chefe do Executivo n.º 49/2014

Considerando que a República Popular da China, por nota datada de 28 de Setembro de 2010, notificou o Secretário-Geral da Organização Marítima Internacional sobre a aplicação na Região Administrativa Especial de Macau, a partir de 11 de Outubro de 2010, do Protocolo de 1988 relativo à Convenção Internacional das Linhas de Carga, 1966, concluído em Londres, em 11 de Novembro de 1988, adiante designado por Protocolo de 1988;

Mais considerando que o Comité de Segurança Marítima da Organização Marítima Internacional, através da sua resolução MSC.329(90), de 24 de Maio de 2012, adoptou emendas ao Protocolo de 1988 e que, nos termos da subalínea (ii) da alínea (g) do n.º 2 do artigo VI do Protocolo de 1988, e de acordo com o n.º 3 da referida resolução, tais emendas entram em vigor na República Popular da China, incluindo a Região Administrativa Especial de Macau, em 1 de Janeiro de 2014;

O Chefe do Executivo manda publicar, nos termos do n.º 1 do artigo 6.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, a resolução MSC.329(90), que contém as referidas emendas, nos seus textos autênticos em línguas chinesa e inglesa.

RESOLUTION MSC.329(90)

(adopted on 24 May 2012)

AMENDMENTS TO THE PROTOCOL OF 1988 RELATING TO THE INTERNATIONAL CONVENTION ON LOAD LINES, 1966, AS AMENDED

THE MARITIME SAFETY COMMITTEE,

RECALLING Article 28(b) of the Convention on the International Maritime Organization concerning the functions of the Committee,

RECALLING FURTHER article VI of the Protocol of 1988 relating to the International Convention on Load Lines, 1966 (hereinafter referred to as the “1988 Load Lines Protocol”) concerning amendment procedures,

HAVING CONSIDERED, at its ninetieth session, amendments to the 1988 Load Lines Protocol proposed and circulated in accordance with paragraph 2(a) of article VI thereof,

1. ADOPTS, in accordance with paragraph 2(d) of article VI of the 1988 Load Lines Protocol, amendments to the 1988 Load Lines Protocol, the text of which is set out in the annex to the present resolution;

2. DETERMINES, in accordance with paragraph 2(f)(ii)(bb) of article VI of the 1988 Load Lines Protocol, that the said amendments shall be deemed to have been accepted on 1 July 2013, unless, prior to that date, more than one third of the Parties to the 1988 Load Lines Protocol or Parties the combined merchant fleets of which constitute not less than 50 per cent of the gross tonnage of the world’s merchant fleet, have notified their objections to the amendments;

3. INVITES the Parties concerned to note that, in accordance with paragraph 2(g)(ii) of article VI of the 1988 Load Lines Protocol, the amendments shall enter into force on 1 January 2014 upon their acceptance in accordance with paragraph 2 above;

4. REQUESTS the Secretary-General, in conformity with paragraph 2(e) of article VI of the 1988 Load Lines Protocol, to transmit certified copies of the present resolution and the text of the amendments contained in the annex to all Parties to the 1988 Load Lines Protocol;

5. FURTHER REQUESTS the Secretary-General to transmit copies of this resolution and its annex to Members of the Organization, which are not Parties to the 1988 Load Lines Protocol.

Regulation 47 — Southern Winter Seasonal Zone

The existing text of regulation 47 is replaced by the following:

“The northern boundary of the Southern Winter Seasonal Zone is:

the rhumb line from the east coast of the American continent at Cape Tres Puntas to the point latitude 34º S, longitude 50º W, thence the parallel of latitude 34º S to longitude 16º E, thence the rhumb line to the point latitude 36º S, longitude 20º E, thence the rhumb line to the point latitude 34º S, longitude 30º E, thence along the rhumb line to the point latitude 35º30´ S, longitude 118º E, and thence the rhumb line to Cape Grim on the north-west coast of Tasmania; thence along the north and east coasts of Tasmania to the southernmost point of Bruny Island, thence the rhumb line to Black Rock Point on Stewart Island, thence the rhumb line to the point latitude 47º S, longitude 170º E, thence along the rhumb line to the point latitude 33º S, longitude 170º W, and thence the parallel of latitude 33º S to the point latitude 33º S, longitude 79º W, thence the rhumb line to the point latitude 41º S, longitude 75º W, thence the rhumb line to Punta Corona lighthouse on Chiloe Island, latitude 41º47´ S, longitude 73º53´ W, thence along the north, east and south coasts of Chiloe Island to the point latitude 43º20´ S, longitude 74º20´ W, and thence the meridian of longitude 74º20´ W to the parallel of latitude 45º45´ S, including the inner zone of Chiloe channels from the meridian 74º20´ W to the east.

Seasonal periods:

WINTER: 16 April to 15 October

SUMMER: 16 October to 15 April”
