    第33/2012號行政長官公告

    中華人民共和國就承認一九四四年十二月七日訂於芝加哥的《國際民用航空公約》(下稱“國際民航公約”)及決定參加國際民航組織的活動,於一九七四年二月十五日向國際民航組織秘書長發出通知書;

    中華人民共和國政府就國際民航公約及其相關的修改議定書適用於澳門特別行政區之事,分別於一九九九年十二月六日及二零零五年七月八日以照會通知國際民航組織秘書長;

    基於此,行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定,命令公佈:

    ——中華人民共和國一九七四年二月十五日通知書適用部分的中文正式文本及相應的葡文譯本;
    ——中華人民共和國政府一九九九年十二月六日照會的英文正式文本及相應的葡文譯本;
    ——中華人民共和國政府二零零五年七月八日照會的英文正式文本及相應的葡文譯本。

    二零一二年五月二十三日發佈。

    “……

    我謹通知你:中華人民共和國政府決定承認一九四四年十二月九日當時中國政府在芝加哥簽字並於一九四六年二月二十日交存批准書的《國際民航公約》……並決定自今日起參加國際民航組織的活動。

    根據公約第二章第五條和第九條的規定,為了飛行安全和公共安全的利益,外國民航飛機從事非航班飛行進入我國國境,需要事前向我國政府申請,在得到答覆接受後方能進入,並應遵守關於遵循指定的路線和在指定的航站降落的規定。關於第十八章的執行,以不損害我國主權為原則。

    我同時受權聲明:一九四九年十月一日,中華人民共和國政府成立以後,蔣介石集團盜用中國政府名義在《國際民航公約》的其他議定書上的簽字和批准均屬非法無效。

    Note of the People's Republic of China, of 6 December 1999

    In accordance with the Joint Declaration of the Government of the People's Republic of China and the Government of the Republic of Portugal on the Question of Macao signed on 13 April 1987, the Government of the People's Republic of China will resume the exercise of sovereignty over Macao with effect from 20 December 1999. Macao will, with effect from that date, become a Special Administrative Region of the People's Republic of China and will enjoy a high degree of autonomy, except in foreign and defence affairs which are the responsibilities of the Central People's Government of the People's Republic of China.

    In this connection, I am instructed by the Minister of Foreign Affairs of the People's Republic of China to inform Your Excellency of the following:

    The Convention on International Civil Aviation, done on 7 December 1944, which the Government of the People's Republic of China informed its admission on 15 February 1974, and Protocol relating to an Amendment to the Convention on International Civil Aviation [Article 45 - Permanent seat of the International Civil Aviation Organization] and Protocol relating to Certain Amendment to the Convention on International Civil Aviation [Article 48(A), 49(E) and 61], done on 14 June 1954, and Protocol relating to an Amendment to the Convention on International Civil Aviation [Article 48(A)], concluded on 15 September 1962, and Protocol relating to an Amendment to the Convention on International Civil Aviation [Article 50(A)], concluded on 12 March 1971, and Protocol on the Authentic Quadrilingual Text of the Convention on International Civil Aviation, done on 30 September 1977, and Protocol Relating to Amendment to the Convention on International Civil Aviation [Article. 83 Bis], done on 6 October 1980 and Protocol Relating to an Amendment to the Convention on International Civil Aviation [Article 3 Bis], adopted on 10 May 1980 (hereinafter referred to as the Convention and the Protocols), shall apply to the Macao Special Administrative Region with effect from 20 December 1999. The Government of the People's Republic of China also wishes to make the following declaration:

    The statement made by the Government of the People's Republic of China to the provisions of Articles 5 and 9 of Chapter II and the provisions of Chapter XVIII shall also apply to Macao Special Administrative Region.

    The Government of the People's Republic of China shall assume responsibility for the international rights and obligations arising from the application of the Convention and the Protocols to the Macao Special Administrative Region.

    It would be appreciated if the contents of the Note could be placed formally on record and brought to the attention of the other Parties to the Convention and the Protocols.

    On behalf of the Government of the People's Republic of China, I have the honor to notify you of the following:

    In accordance with the Basic Law of the Macau Special Administrative Region of the People's Republic of China, the Government of the People's Republic of China has decided that the following conventions shall apply to the Macau Special Administrative Region of the People's Republic of China:

    Protocol Relating to an Amendment to Article 50(a) of the Convention on International Civil Aviation, 1990;

    Protocol Relating to an Amendment to Article 56 of the Convention on International Civil Aviation, 1989.

    It would be appreciated if the contents of this Note could be placed formally on record and brought to the attention of the other Parties to the Conventions.
