第53/2011號行政長官公告

孟加拉人民共和國政府與中華人民共和國政府以換文方式就孟加拉人民共和國在中華人民共和國香港特別行政區保留總領事館達成諒解。按照中央人民政府的命令，行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定，命令公佈孟加拉人民共和國政府照會的英文正式文本及中華人民共和國政府照會的中文正式文本。

根據上述諒解，自一九九九年十二月二十日中華人民共和國恢復對澳門行使主權之日起，孟加拉人民共和國駐中華人民共和國香港特別行政區總領事館可在澳門特別行政區繼續執行領事職務。

I have the honour to refer to the recent meetings between our two governments on the maintenance by the Government of the People’s Republic of Bangladesh of its Consulate-General in the Hong Kong Special Administrative Region of the People’s Republic of China and propose the following as an understanding between our two governments:

1. The Government of the People’s Republic of China agrees to the maintenance by the Government of the People’s Republic of Bangladesh of its Consulate-General in the Hong Kong Special Administrative Region of the People’s Republic of China.

2. The Government of the People’s Republic of China takes note of the consular function which Bangladesh performs to Macao and agrees to the continuation of this function after the government of the People’s Republic of China resumes the exercise of sovereignty over Macao with effect from December 20, 1999.

3. The operations of the Bangladesh Consulate General in the Hong Kong Special Administrative Region are to be regulated by the Vienna Convention on Consular Relations of April 24, 1963. Consular matters are to be handled on the basis of equality and mutual benefit and in a friendly and cooperative spirit.

I would be grateful for Your Excellency’s confirmation that the above principles meet with the approval of the Government of the People’s Republic of China and serves as the basis for the conduct of Consular Relations between our two Governments in regard to the Hong Kong Special Administrative Region. The present note and Your Excellency’s affirmative note in reply constitute an understanding between our two governments coming into effect on July 1, 1997.

I avail myself of this opportunity to renew to Your Excellency, the assurances of my highest consideration.

我榮幸地收到閣下一九九六年十二月二十九日的來照，內容如下：

“我榮幸地提及我們兩國政府近期有關孟加拉人民共和國政府在中華人民共和國香港特別行政區保留總領事館的會晤，並建議我們兩國政府達成如下諒解：

一、中華人民共和國政府同意孟加拉人民共和國政府在香港特別行政區保留總領事館。

二、中華人民共和國政府注意到孟加拉在澳門執行領事職務的情況，並同意自一九九九年十二月二十日中華人民共和國恢復對澳門行使主權之日起繼續執行該 職務。

三、孟加拉駐香港特別行政區總領事館的運作應遵循一九六三年四月二十四日《維也納領事關係公約》的規定。領事事務本着友好合作的精神在平等互利的基 礎上予以處理。

如蒙閣下確認中華人民共和國政府同意上述原則並以此作為處理我們兩國政府涉及香港特別行政區領事關係的基礎，我將深表謝意。本照會以及閣下的確認覆 照將構成我們兩國政府之間的一項諒解，並自一九九七年七月一日起生效。”

我謹榮幸地代表中華人民共和國政府確認，同意上述照會內容。
