第40/2009號行政長官公告
鑑於中華人民共和國就二零零四年十月五日在布加勒斯特舉行的第二十三屆萬國郵政聯盟大會（布加勒斯特大會）通過的《萬國郵政聯盟組織法第七附加議定書》，於二零零八年十一月十四日向作為《萬國郵政聯盟組織法》、其附加議定書以及萬國郵政聯盟其他法規保管實體的萬國郵政聯盟國際局總局長交存批准書，並於同日作出通知，《萬國郵政聯盟組織法第七附加議定書》適用於澳門特別行政區；
鑑於根據《萬國郵政聯盟組織法第七附加議定書》第七條的規定，《萬國郵政聯盟組織法第七附加議定書》自二零零六年一月一日起在國際法律秩序上生效，且自二零零八年十一月十四日起對中華人民共和國生效，包括對澳門特別行政區生效；
再鑑於根據經《萬國郵政聯盟組織法第七附加議定書》修改的《萬國郵政聯盟組織法》第三十一條的規定，一九九九年九月十五日在北京舉行的上屆大會（北京大會）通過的萬國郵政聯盟其他法規已被布加勒斯特大會通過的相關法規所取代，且後者同樣自二零零六年一月一日起在國際法律秩序上生效；
同時，鑑於上述北京大會通過的《萬國郵政聯盟組織法第六附加議定書》以及中華人民共和國分別於二零零三年六月十八日及二零零四年三月二日作出的、關於北京大會通過的法規適用於澳門特別行政區的通知書從未在《澳門特別行政區公報》公佈；
行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定，命令公佈：
- ——中華人民共和國於二零零三年六月十八日送交保管實體關於一九九九年九月十五日在北京通過的《萬國郵政聯盟總規則》、《萬國郵政公約》及《郵政支付業務協定》適用於澳門特別行政區的通知書英文文本的適用部分及相應的中、葡文譯本；
- ——中華人民共和國於二零零四年三月二日送交保管實體關於《萬國郵政聯盟組織法第六附加議定書》適用於澳門特別行政區的通知書中、英文文本的適用部分及相應的葡文譯本；
- ——《萬國郵政聯盟組織法第六附加議定書》的法文正式文本及相應的中、葡文譯本；
- ——中華人民共和國於二零零八年十一月十四日送交保管實體關於《萬國郵政聯盟組織法第七附加議定書》適用於澳門特別行政區的通知書中、英文文本的適用部分及相應的葡文譯本；
- ——《萬國郵政聯盟組織法第七附加議定書》的法文正式文本及相應的中、葡文譯本；
- ——二零零四年十月五日在布加勒斯特大會通過的萬國郵政聯盟其他法規，即《萬國郵政聯盟總規則》、《萬國郵政公約》及其最後議定書，以及《郵政支付業務協定》的法文正式文本及相應的中、葡文譯本。
一九九四年九月十四日在漢城舉行的第二十一屆萬國郵政聯盟大會通過的《萬國郵政聯盟組織法第五附加議定書》及萬國郵政聯盟其他法規的法文正式文本及相應的葡文譯本公佈於一九九九年十二月十七日第五十期《澳門政府公報》第三副刊。

On behalf of my Government, I have the honor to inform you that, pursuant to Article 153 of the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China and Article 138 of the Basic Law of the Macau Special Administrative Region of the People’s Republic of China, the application to these two Special Administrative Regions of international agreements to which the People’s Republic of China is or becomes a party shall be decided by the Central People’s Government, in accordance with the circumstances and needs of the Regions, and after seeking the views of the governments of the Regions.
After seeking the views of the governments of the two Special Administrative Regions respectively, the Government of the People’s Republic of China has decided that the General Regulations of the Universal Postal Union, the Universal Postal Convention, and the Postal Payment Services Agreement which were signed in Beijing on 15 September 1999 are applicable to the Hong Kong Special Administrative Region and the Macao Special Administrative Region.

I have the honor to transfer the Ratification by the Government of the People’s Republic of China of the Sixth Additional Protocol to the Constitution of the Universal Postal Union signed by the representative of the Government of the People’s Republic of China in Beijing on 15 September 1999.
On behalf of the Government of the People’s Republic of China, I have also the honor to make the following statement:
In accordance with the articles in the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China and the Basic Law of the Macao Special Administrative Region of the People’s Republic of China, after seeking the views of the governments of the two Special Administrative Regions, the Government of the People’s Republic of China has decided that the Sixth Additional Protocol to the Constitution of the Universal Postal Union signed in Beijing on 15 September 1999 is applicable to the Hong Kong Special Administrative Region and the Macao Special Administrative Region.

I, instructed by the Government, have the honour to submit to Your Excellency the Instrument of Ratification of the People’s Republic of China (hereinafter referred to as “the PRC”) for the Seventh Additional Protocol to the Constitution of the Universal Postal Union, adopted by the 23rd Universal Postal Congress on October 5, 2004, (hereinafter referred to as “the Protocol”), and to state the following on behalf of the Government of the PRC:
In accordance with the Basic Law of the Hong Kong Special Administrative Region of the PRC and the Basic Law of the Macao Special Administrative Region of the PRC, the Government of the PRC decides that the Protocol applies to the Hong Kong Special Administrative Region and Macao Special Administrative Region of the PRC.
