鑑於中華人民共和國已於一九九九年十二月二日通知作為一九六七年一月三十一日在紐約簽署的《關於難民地位的議定書》保管實體的聯合國秘書長，有關議定書將繼續在澳門特別行政區適用；

行政長官根據十二月二十日澳門特別行政區第3/1999號法律第六條第一款，命令公佈中華人民共和國作出的有關通知書。該通知書的中文本、與送交保管實體的文本相符的英文本，以及有關的葡文譯本附同於本公告。

通知書

……根據一九八七年四月十三日簽署的《中華人民共和國政府和葡萄牙共和國政府關於澳門問題的聯合聲明》（以下簡稱《聯合聲明》），中華人民共和國政府將於一九九九年十二月二十日對澳門恢復行使主權。自該日起，澳門將成為中華人民共和國的一個特別行政區，除外交和國防事務屬中華人民共和國中央人民政府管理外，享有高度自治權。

為此，我奉中華人民共和國外交部長之命通知如下：

中華人民共和國政府於一九八二年九月二十四日交存加入書的、一九六七年一月三十一日訂於紐約的《關於難民地位的議定書》（以下簡稱“議定書”），自一九九九年十二月二十日起將適用於澳門特別行政區，同時中華人民共和國政府聲明：中華人民共和國政府對議定書第四條所作的保留亦適用於澳門特別行政區。

因該議定書適用於澳門特別行政區所產生的國際權利和義務將由中華人民共和國政府承擔。……

Notification

"(...) In accordance with the Joint Declaration of the Government of the People's Republic of China and the Government of the Republic of Portugal on the Question of Macao (hereinafter referred to as the Joint Declaration), the Government of the People's Republic of China will resume the exercise of sovereignty over Macao with effect from 20 December 1999. Macao will, with effect from that date, become a Special Administrative Region of the People's Republic of China and will enjoy a high degree of autonomy, except in foreign and defence affairs which are the responsibilities of the Central People's Government of the People's Republic of China.

In this connection, I am instructed by the Minister of Foreign Affairs of the People's Republic of China to inform Your Excellency of the following:

The Protocol Relating to the Status of Refugees, adopted at New York on 31 January 1967 (hereinafter referred to as the "Protocol"), to which the Government of the People's Republic of China deposited the instrument of accession on 24 September 1982, will apply to the Macao Special Administrative Region with effect from 20 December 1999. The Government of the People's Republic of China also wishes to make the following declaration:

The reservation made by the Government of the People's Republic of China to Article 4 of the Protocol will also apply to the Macao Special Administrative Region.

The Government of the People's Republic of China will assume the responsibility for the international rights and obligations arising from the application of the Protocol to the Macao Special Administrative Region. (...)"

"(...) De acordo com a Declaração Conjunta do Governo da República Popular da China e do Governo da República Portuguesa sobre a Questão de Macau (de ora em diante designada por Declaração Conjunta), o Governo da República Popular da China reassumirá o exercício da soberania sobre Macau com efeito a partir de 20 de Dezembro de 1999. Macau tornar-se-á a partir dessa data uma Região Administrativa Especial da República Popular da China e gozará de um alto grau de autonomia, excepto nos assuntos das relações externas e da defesa, que são da responsabilidade do Governo Popular Central da República Popular da China.

Neste âmbito, fui instruído pelo Ministro dos Negócios Estrangeiros da República Popular da China para informar Vossa Excelência do seguinte:

O Protocolo relativo ao Estatuto do Refugiado, adoptado em Nova Iorque, em 31 de Janeiro de 1967 (de ora em diante designado por "Protocolo"), cujo instrumento de acessão do Governo da República Popular da China foi depositado em 24 de Setembro de 1982, aplicar-se-á na Região Administrativa Especial de Macau, com efeito a partir de 20 de Dezembro de 1999. O Governo da República Popular da China deseja ainda fazer a seguinte declaração:

A reserva formulada pelo Governo da República Popular da China ao artigo 4.º do Protocolo será igualmente aplicável na Região Administrativa Especial de Macau.

O Governo da República Popular da China assumirá a responsabilidade pelos direitos e obrigações internacionais decorrentes da aplicação do Protocolo na Região Administrativa Especial de Macau. (...)"
