根據《澳門組織章程》第三條第二款之規定,本人批准:
一九九八年十二月六日在杜拜簽訂的澳門政府與阿拉伯聯合酋長國政府航空運輸協定及有關附件。該協定及附件並由澳門總督於同日根據本人在一九九六年三月九日作出及刊登於同月九日《共和國公報》第二組副刊之批示核准。

澳門政府經葡萄牙主管主權機構正式授權並經中華人民共和國政府同意,和阿拉伯聯合酋長國政府,
以下稱為締約雙方,
希望在其之間及以遠地區建立航班而締結一項協定,達成協議如下:
除非文中另有要求,本協定中:
(一)“地區”在澳門方面,包括澳門半島,氹仔島和路環島;在阿拉伯聯合酋長國方面,採納一九四四年十二月七日在芝加哥開放簽字的國際民航公約(以下稱之為公約)第二條中“領土”的含意。
(二)“航空當局”在澳門方面指民航局或就本協定授權執行上述當局目前行使任何職能的任何個人或機構;在阿拉伯聯合酋長國方面指交通部長和或授權執行該部長在民航方面目前行使任何職能的任何個人或機構。
(三)“指定空運企業”一詞指根據本協定第四條獲得指定和許可的一家或多家空運企業。
(四)“航班”、“國際航班”、“空運企業”和“非運輸業務性經停”名詞,分別採納公約第九十六條所載的含意。
締約雙方在執行本協定時,其作法應符合公約的規定,包括附件和對公約或對附件的任何修改,只要這些規定適用於國際航班。
一、締約一方給予締約另一方關於定期國際航班的下列權利:
(一)飛越其地區而不降落的權利;
(二)在其地區作非運輸業務性經停的權利。
二、締約一方給予締約另一方在本協定中規定的權利,以便在本協定所附航線表中有關部份規定的航線上建立定期國際航班。此種航班和航線以下分別稱之為“協議航班”和“規定航線”。
締約一方指定空運企業在規定航線上經營協議航班時,除了本條第一款規定的權利外,應享有在締約另一方地區內本協定航線表中該航線規定的地點降停,以混合或分開方式上下旅客和貨物包括郵件。
三、本條第二款不應被視為給予締約一方空運企業在締約另一方地區內裝載旅客、貨物和郵件前往締約另一方地區內另一地點的權利。
一、締約一方有權指定一家或多家空運企業在規定航線上經營協議航班。
二、收到此種指定后,在不違反本條第三款和第四款規定的情況下,締約另一方應毫不延誤地授予指定的空運企業以適當的經營許可。
三、締約一方航空當局可以要求締約另一方指定空運企業向其証實,該空運企業具備資格履行該當局根據公約的規定在經營國際航班方面通常和合理採用的法律和規定制定的條件。
四、締約一方有權拒絕授予本條第二款中所述的經營許可,或對該指定空運企業行使本協定第三條規定的權利附加其認為必要的條件,如該締約方其對下列情況不滿意:
(一) 在澳門方面,該空運企業不在澳門註冊和以澳門為主要經營地;
(二) 在阿拉伯聯合酋長國方面,該空運企業的主要所有權和有效控制權不屬於阿拉伯聯合酋長國或其國民或兩者。
五、獲得指定和許可的空運企業,可以隨時開始經營協議航班,條件是按照本協定第十一條確定的該航班的運價已經生效。
一、在下列任一情況下,締約一方有權撤銷經營許可或暫停締約另一方指定空運企業行使本協定第三條規定的權利,或對行使這些權利附加其認為必要的條件:
(一)在其不滿意
就澳門而言,該空運企業不在澳門註冊和以澳門為主要經營地;
就阿拉伯聯合酋長國而言,該空運企業的主要所有權和有效控制權不屬於阿拉伯聯合酋長國或其國民或兩者;
(二)該空運企業不遵守授予這些權利的締約方的法律或規定;
(三)該空運企業在其它方面未能按照本協定規定的條件經營。
二、除非為防止進一步違反法律或規定,必須立即撤銷、暫停或附加本條第一款所述的條件,此項權利應在與締約另一方協商之後方可行使。
一、締約一方指定空運企業經營國際航班的飛機及其正常機上設備、燃油和潤滑油、以及在此種飛機上的機上供應品(包括食品、飲料和煙草),在進入締約另一方地區時應免除所有海關關稅、進口限制和消費稅、檢驗費和其它類似收費,條件是此等設備和供應品必須留置在飛機上直至重新出口或在該地區上空飛行的航段上在機上使用。
二、下列物品,除與提供服務相應的費用外,亦應免除相同的關稅、費用和收費:
(一) 在締約一方地區裝上飛機,在上述締約方當局規定數量之內,供締約另一方經營國際航班出港飛機機上使用的機上供應品;
(二) 締約一方指定空運企業為維護或修理經營國際航班飛機運入締約另一方地區的零備件;
(三) 在締約一方地區內為締約另一方指定空運企業經營國際航班的出港飛機供應的燃料和潤滑油,即使它們是在裝上飛機的締約方地區上空飛行的航段上使用。
以上(一)款、(二)款和(三)款所述物品可以要求置於海關監管或控制之下。
三、正常機上設備以及留置在締約一方飛機上的物品和供應品,只有經該地區海關當局批准方可在締約另一方地區內卸下。在此情況下,它們應置於上述當局監管之下直至重新出口或根據海關規定另行處理。
四、締約一方對締約另一方的飛機使用機場和航空導航設施可以征收或允許征收的任何費用不應高於其自己從事定期國際航班的空運企業所支付的任何費用。
一、締約一方關於飛機旅客、機組或貨物進出其地區,諸如入境、放行、移居和移民、護照、海關、貨幣、健康和檢疫的法律和規定,在進入、離開和在上述地區之內時應予以履行或代為此種旅客、機組、貨物履行。
二、締約一方關於從事國際航行的飛機入境或出境其地區,或關於締約另一方此種飛機在其地區內運營和航行的法律和規定應該適用。
三、對直接過境締約一方地區和不離開為此目的而設的機場區域的旅客、行李和貨物,只採取非常簡化的控制措施。直接過境的行李和貨物應免除海關關稅和其它類似稅捐。
一、締約一方指定空運企業在其各自地區之間規定航線上經營協議航班應享有公平和均等的機會。
二、在經營協議航班方面,締約一方指定空運企業應考慮到締約另一方指定空運企業的利益,以免不適當地影響后者在相同航線的全部或部分航段上提供的航班。
三、締約一方指定空運企業提供的協議航班應對公眾對在規定航線上的運輸要求保持合理的關系,應以合理的載運比率提供足夠的運力,以滿足當前和合理預計到的來自和前往指定空運企業締約一方地區的旅客、貨物包括郵件在內的運輸要求。在規定航線上指定空運企業締約方地區以外的其它非締約方地區的地點上下旅客和貨物包括郵件所提供的運輸,應根據運力需與下列相聯系的原則予以規定:
(一) 前往和來自指定空運企業締約方地區的運輸需要;
(二) 在考慮到該區域內非締約方空運企業建立的航班之后,協議航班途經地區的運輸需要;
(三) 聯程航班經營的需要。
一、締約一方指定空運企業應盡可能提前在協議航班開航之前將航班時刻包括使用機型的資料提交締約另一方航空當局批准。
二、本條的要求也同樣適用於有關協議航班的任何變更。
一、締約雙方重申,彼此之間對保障民航安全免受非法行為干擾的責任構成本協定不可缺少的一個部分。締約雙方應特別遵守一九六三年九月十四日在東京簽訂的關於在航空器內犯罪和犯有某些其它行為的公約,一九七零年十二月十六日在海牙簽訂的關於制止非法劫持航空器的公約,以及一九七一年九月二十三日在蒙特利爾簽訂的關於制止危害民用航空安全的非法行為的公約的規定。
二、締約雙方應根據請求相互提供一切必要的協助,以防止非法劫持民用飛機和其它危及該等飛機、及其旅客和機組、機場和導航設施安全的非法行為,以及危及民航安全的任何其它威脅。
三、締約雙方在相互的關系中,應遵守國際民航組織所制定的航空保安規定和指定為國際民航公約的附件,只要這些保安規定適用於締約雙方。締約雙方須要求,締約各方注冊的飛機經營機構或以締約各方地區為主要經營地或永久駐地的飛機經營機構,以及締約各方地區的機場經營機構的運作符合該等航空安全規定。
四、締約一方同意可以要求該等飛機經營機構在進出或留在締約另一方的地區時遵守締約另一方要求的上
述第三款所述的航空保安規定。締約一方須確保在其地區內有效地實施足夠的措施,以保護飛機和在旅客登機或裝載貨物之前及登機裝貨時檢查旅客、機組、手提物品、行李、貨物和機上供應品。締約一方對締約另一方為對付某項特定的威脅要求采取合理的特別安全措施,
亦應給於同情的考慮。
五、尚若發生非法劫持民用飛機的事件或威脅,或其它針對民用飛機,其旅客和機組、機場及飛機導航設施安全的非法行為,締約雙方須互相協助,以便盡速使用通訊聯絡及其它適當措施,按情況實際可行的程度迅速及安全地終止上述事件或此種事件的威脅。
一、在下列條款中,“運價”一詞指為運輸旅客和貨物而支付的價格以及使用這些價格的條件,包括代理和其它輔助服務的價格和條件,但不包括運輸郵件的報酬和條件。
二、締約一方空運企業為前往或來自締約另一方地區的運輸所收取的運價應在合理的水平上制定,適當考慮所有有關因素,包括經營成本、合理利潤和其它空運企業的運價。
三、本條第二款所述的運價,如果可能,應在與航線全部或部分航段上經營的其它空運企業協商之後,由締約雙方有關指定空運企業商定。此種協議,應盡可能地通過使用國際航空運輸協會制定運價的程序予以達成。
四、按此協議的運價至少應在擬議實施之日九十天之前提交締約雙方航空當局批准。在特殊情況下,經上述當局同意,此期限可以縮短。
五、該項批准可以明確作出;如果在根據本條第四款提交之日的三十天內任何一方航空當局未表示不批准,這些運價應視為已經批准。在提交期限按第四款規定縮短的情況下,航空當局可以同意,在期限內必須通知的期限將少於三十天。
六、如果不能根據本條第三款就一項運價達成協議,或者在按照本條第五款適用的期限過程中,一方航空當局向另一方航空當局發出通知,不批准按照本條第三款協議的一項運價,締約雙方航空當局應在與它們認為其意見可取的任何其它非締約方協商之後,努力通過協議確定任何運價。
七、如果航空當局不能同意根據本條第四款提交給其的任何運價,或根據本條第六款確定運價,分歧應按本協定第十六條規定解決。
八、根據本條規定制定的運價應持續有效,直至制定一項新的運價。但是,一項運價不應由於本款而在其已經失效之日之後延長超過十二個月。
一、締約一方指定空運企業應在經營協議航班(定期航班)之前不少於三十天向締約另一方航空當局上報其建議的班期時刻供其批准。此種班期時刻應包括所有有關情報,包括使用的機型、航班班次和飛行時刻。
二、締約一方航空當局應按要求向締約另一方航空當局提供為保存記錄合理所需的定期或其它統計說明。此種說明應包括這些空運企業在協議航班上運輸的業務量以及此種業務的起訖地點的全部情況。
一、締約一方給予締約另一方指定空運企業將在該締約一方地區內賺取的收支餘額匯出的權利。此種匯款應根據在發生收入的地區的締約一方的外匯兌換規定辦理。此種匯出應在正式比價的基礎上,或在沒有正式比價時按當時支付的有效外匯市場比價迅速辦理。
二、如果締約一方對締約另一方指定空運企業匯出收支餘額加以限制,後者有權對締約一方指定空運企業附加對等限制。
三、締約雙方同意,要求其各自有關當局就其空運企業活動的收入訂立一項避免雙重稅收的協定。
一、締約一方指定空運企業可以根據締約另一方關於入境、居留和就業的法律和規定,在締約另一方地區內派駐和保留負責管理、技術、經營其航班活動的僱員和其他人員。
二、這些人員需求可由締約一方指定空運企業選擇,通過其自己的員工或使用只有獲得批准在該締約方地區內從事此種服務(包括為其它空運企業服務)在締約另一方地區內營業的任何其它機構、公司或空運企業的服務加以解決。
一、締約一方可就本協定的解釋、實施或修改要求協商、協商可以口頭或書面形式并應在收到要求之日起六十天內開始,除非締約雙方同意延長或縮短該期限。
二、締約雙方航空當局將以密切合作的精神隨時協商,以便確保執行和滿意地遵守本協定和所附的航線表的規定。
一、如果締約雙方就本協定的解釋或實施發生任何爭議,締約雙方首先應設法通過談判加以解決。
二、如果締約雙方未能按照本條第一款的規定通過談判達成一項解決辦法,將根據國際慣例通過仲裁予以解決。
一、如果締約一方認為需要修改本協定包括附後的航線表的任何規定,應根據本協定第十五條協商之後進行。
二、如果修改涉及附後的航線表以外的協定的規定,修改應根據其法律程序經締約一方批准並在通過適當途徑互換信函之日生效。
三、如果修改僅僅涉及附後的航線表的規定,可以在締約雙方航空當局之間商定並自航空當局批准之日起生效。
本協定和任何其後修改應向國際民航組織登記。
締約一方可隨時書面通知締約另一方其終止本協定的決定。此項通知應同時發給國際民航組織。在此情況下,本協定自締約另一方收到終止通知之日起一年後終止,除非在本期限到期之前協議撤銷終止通知。在締約另一方未確認收到時,該通知應在國際民航組織收到該通知十四天之後被認為已經收到。
除非另外明確規定,本協定的附件應被視為協定的組成部份以及所有對協定的引述將包括對附件的引述。
本協定自締約雙方相互通知必需的程序已經履行之日起生效。
下列全權代表,經其各自政府正式授權,已在本協定上簽字為証。
本協定一式兩份,於一九九八年十二月六日在迪拜用中文、葡萄牙文、阿拉伯文和英文寫成,四種文本同等作准。遇有分歧時,以英文為准。

三、在以上航線上授於締約雙方指定空運企業第五種自由業務權。但是,不載業務的經營允許經過任何中間點或任何以遠點。香港、台灣和中國內地的地點不得作為中間點或以遠點經營。
四、締約任何一方指定空運企業的任何或全部航班可以選擇在本附件規定航線上省略任何地點,條件是這些航班在指定空運企業的締約方地區內始發或終止。
五、在互惠的基礎上,締約雙方使用其自己或租賃的設備的全貨運航班應予以積極考慮。
The Government of Macau, being duly authorized by the competent sovereign institution of the Portuguese Republic and with the consent of the Government of the People’s Republic of China and the Government of the United Arab Emirates,
hereinafter referred to as the Contracting Parties,
Desiring to conclude an Agreement, for the purpose of establishing air services between and beyond their respective areas,
Have agreed as follows:
For the purpose of this Agreements, unless the context otherwise requires:
1. the term “area” in relation to Macau, includes Macau Peninsula and the Taipa and Coloane Islands and in relation to United Arab Emirates has the meaning assigned to “territory” in Article 2 of the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944 (hereinafter referred to as the Convention).
2. the term “aeronautical authorities” means in the case of Macau, the Civil Aviation Authority or any person or body authorized to perform any functions at present exercised by the said Authority in respect of this Agreement and in the case of United Arab Emirates the Minister of Communications and or any person or body authorized to perform any functions at present exercised by the Minister in respect of Civil Aviation.
3. the term “designated airline” means an airline or airlines which have been designated and authorized in accordance with Article 4 of this Agreement.
4. the terms “air service”, “international air service”, “airline”, and “stop for non-traffic purposes” have the meanings respectively assigned to them in Article 96 of the Convention.
In implementing this Agreement, the Contracting Parties shall act in conformity with the provisions of the Convention including the Annexes, and any amendments to the Convention or to the Annexes, insofar as these provisions are applicable to international air services.
1. Each Contracting Party grants to the other Contracting Party the following rights in respect of its scheduled international air services:
a) the right to fly across its area without landing;
b) the rights to make stops in its area for non-traffic purposes.
2. Each Contracting Party grants to the other Contracting Party the rights specified in this Agreement for the purpose of establishing scheduled international air services on the routes specified in the appropriate Section of the Schedule annexed to this Agreement. Such services and routes are hereafter called “the agreed services” and “the specified routes” respectively.
While operating an agreed service on a specified route the airline designated by each Contracting Party shall enjoy in addition to the rights specified in paragraph 1 of this Article the right to make stops in the area of the other Contracting Party at the points specified for that route in the Schedule to this Agreement for the purpose of taking on board and discharging passengers and cargo including mail in combination or separately.
3. Nothing in paragraph 2 of this Article shall be deemed to confer on the airline of one Contracting Party the privilege of taking on board, in the area of the other Contracting Party, passengers cargo, and mail carried for hire or reward and destined for another point in the area of the other Contracting Party.
1. Each Contracting Party shall have the right to designate in writing to the other Contracting Party one or more airlines for the purpose of operating the agreed services on the specified routes.
2. On receipt of such designation, the other Contracting Party shall, subject to the provisions of paragraphs 3 and 4 of this Article, without delay grant to the airline designated the appropriate operating authorization.
3. The aeronautical authorities of one Contracting Party may require the airline designated by the other Contracting Party to satisfy them that it is qualified to fulfill the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services by such authorities in accordance with the provisions of the Convention.
4. Each Contracting Party shall have the right to refuse to grant the operating authorization referred to in paragraph 2 of this Article, or to impose such conditions as it may deem necessary on the exercise by the designated airline of the rights specified in Article 3 of this Agreement, in any case where the Contracting Party is not satisfied that if:
a) in the case of Macau, that airline is not incorporated and has its principal place of business in Macau;
b) in the case of the United Arab Emirates, substantial ownership and effective control of that airline are not vested in the United Arab Emirates or in its nationals or both.
5. When an airline has been so designated and authorized, it may begin at any time to operate the agreed services, provided that tariffs established in accordance with Article 11 of this Agreement are in force in respect of this service.
1. Each Contracting Party shall have the right to revoke an operating authorization or to suspend the exercise of the rights specified in Article 3 of this Agreement by the airline designated by the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of these rights in any of the following cases:
a) in any case where it is not satisfied that
in the case of Macau, that airline is incorporated and has its principal place of business in Macau;
in the case of the United Arab Emirates, substantial ownership and effective control of that airline are vested in the United Arab Emirates or in its nationals or both.
b) in the case of failure by that airline to comply with the laws or regulations of the Contracting Party granting these rights,
c) in case the airline otherwise fails to operate in accordance with the conditions prescribed under this Agreement.
2. Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph 1 of this Article is essential to prevent further infringements of laws or regulations, such rights shall be exercised only after consultation with the other Contracting Party.
1. Aircraft operated on international air services by the designated airline of either Contracting Party, as well as their regular equipment, supplies of fuels and lubricants, and aircraft stores (including food, beverages and tobacco) on board such aircraft shall be exempt from all customs duties, import restrictions, and excise tax, inspection fees and other similar charges on arriving in the area of the other Contracting Party, provided such equipment and supplies remain on board the aircraft up to such time as they are re-exported or are used on board aircraft on the part of the journey performed over that area.
2. There shall also be exemption from the same duties, fees and charges with the exception of charges corresponding to the service performed:
a) aircraft stores taken on board in the area of a Contracting Party, within limits fixed by the authorities of said Contracting Party, and for use on board outbound aircraft engaged in an international air services of the other Contracting Party;
b) spare parts entered into the area of either Contracting Party for the maintenance or repair of aircraft used on international air services by the designated airlines of the other Contracting Party;
c) fuel and lubricants supplied in the area of a Contracting Party to an outbound aircraft of a designated airline of the other Contracting Party engaged in an international air service, even when these supplies are to be used on the part of the journey performed over the area of the Contracting Party in which they are taken on board.
Materials referred to in sub-paragraph a), b) and c) above may be required to be kept under customs supervision or control.
3. Regular airborne equipment, as well as the materials and supplies retained on board the aircraft of either Contracting Party, may be unloaded in the area of the other Contracting Party only with the approval of the customs authorities of that area. In such a case, they may be placed under the supervision of the said authorities up to such time as they are re-exported or otherwise disposed of in accordance with customs regulations.
4. Any charges that may be imposed or permitted to be imposed by a Contracting Party for the use of such airports and air navigation facilities by the aircraft of any other Contracting Party shall not be higher than those that would be paid by its own airline(s) engaged in scheduled international air services.
1. The laws and regulations of a Contracting Party as to the admission to or departure from its area of passengers, crew, or cargo of aircraft, such as regulations relating to entry, clearance, immigration and emigration, passports, customs, currency, health and quarantine shall be complied with by or on behalf of such passengers, crew or cargo upon entrance into or departure from, or while within the area of that Contracting Party.
2. The laws and regulations of a Contracting Party relating to the admission to or departure from its area of aircraft engaged in international air navigation, or to the operation and navigation of such aircraft of the other Contracting Party while within its area shall be applied.
3. Passengers, baggage and cargo in direct transit across the area of one Contracting Party and not leaving the zone of the airport reserved for such purpose shall only be subject to a very simplified control. Baggage and cargo in direct transit shall be exempt from customs duties and other similar taxes.
1. There shall be fair and equal opportunity for the designated airline of each Contracting Party to operate the agreed services on the specified routes between their respective areas.
2. In operating the agreed services, the designated airlines of each Contracting Party shall take into account the interests of the airlines of the other Contracting Party so as not to affect unduly the services, which the latter provide on the whole or part of the same routes.
3. The agreed services provided by the designated airline of the Contracting Party shall bear close relationship to the requirements of the public for transportation on the specified routes and shall have as their primary objective the provision, at a reasonable load factor, of capacity adequate to carry the current and reasonably anticipated requirements for the carriage of passengers and cargo including mail originating from or destined for the area of the Contracting Party which has designated the airline. Provision for the carriage of passengers and cargo including mail both taken on board and discharged at points on the specified routes in the areas of other non-Contracting Parties other than that designating the airline shall be made in accordance with the general principle that capacity shall be related to:
a) traffic requirements to and from the area of the Contracting Party which has designated the airline;
b) traffic requirements of the area through which the agreed service passes, after taking account of other transport services established by airlines of the non-Contracting Parties comprising the area; and
c) the requirements of through airline operation.
1. The designated airline of a Contracting Party shall provide for approval to the aeronautical authorities of the other Contracting Party as long in advance as practicable prior to the inauguration of the agreed services, flight schedules including information on the type of aircraft to be used.
2. The requirements of this Article shall likewise apply to any change concerning the agreed services.
1. The Contracting Parties reaffirm that their obligation to each other to protect the security of civil aviation against acts of unlawful interference forms an integral part of this Agreement. The Contracting Parties shall in particular act in conformity with the provisions of the Convention on Offenses and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at The Hague on 16 December 1970 and the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, signed at Montreal on 23 September 1971.
2. The Contracting Parties shall provide upon request all practicable aid to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities, and any other threat to the security of civil aviation.
3. The Parties shall, in their mutual relations, act in conformity with the aviation security provisions established by the International Civil Aviation Organization and designated as Annexes to the Convention on International Civil Aviation to the extent that such security provisions are applicable to the Parties; they shall require that operators of aircraft of their registry or operators of aircraft who have their principal place of business or permanent residence in their area and the operators of airports in their area act in conformity with such aviation security provisions.
4. Each Contracting Party agrees that such operators of aircraft may be required to observe the aviation security provisions referred to in paragraph 3 above required by the other Contracting Party for entry into, departure from, or while within, the area of that other Contracting Party. Each Contracting Party shall ensure that adequate measures are effectively applied within its area to protect the aircraft and to inspect passengers, crew, carry-on items, baggage, cargo and aircraft stores prior to and during boarding or loading. Each Contracting Party shall also give sympathetic consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat.
5. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such incident or threat thereof to the extent practicable under the circumstances.
1. For the purpose of the following paragraphs, the term “tariff” means the prices to be paid for the carriage of passengers and cargo and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary services but excluding remuneration and conditions for the carriage of mail.
2. The tariffs to be charged by the airlines of one Contracting Party for carriage to or from the area of the other Contracting Party shall be established at reasonable levels, due regard being paid to all relevant factors, including cost of operation, reasonable profit, and the tariffs of other airlines.
3. The tariffs referred to in paragraph 2 of this Article shall, if possible, be agreed by the designated airlines concerned of both Contracting Parties, after consultation with the other airlines operating over the whole or part of the route, and such agreement shall, wherever possible, be reached by the use of the procedures of the International Air Transport Association for the working out of tariffs.
4. The tariffs so agreed shall be submitted for the approval of the aeronautical authorities of both Contracting Parties at least ninety (90) days before the proposed date of their introduction. In special cases, this period may be reduced, subject to the agreement of the said authorities.
5. This approval may be given expressly, if neither of the aeronautical authorities has expressed disapproval within thirty (30) days from the date of submission, in accordance with paragraph 4 of this Article, these tariffs shall be considered as approved. In the event of the period for submission being reduced, as provided for in paragraph 4, the aeronautical authorities may agree that the period within which any disapproval must be notified shall be less than thirty (30) days.
6. If a tariff cannot be agreed in accordance with paragraph 3 of this Article, or if, during the period applicable in accordance with paragraph 5 of this Article, one aeronautical authority gives the other aeronautical authority notice of its disapproval of a tariff agreed in accordance with the provisions of paragraph 3 of this Article, the aeronautical authorities of the two Contracting Parties shall, after consultation with the aeronautical authorities, of any other non-Contracting Party whose advice they consider useful, endeavor to determine the tariff by mutual agreement.
7. If the aeronautical authorities cannot agree on any tariff submitted to them under paragraph 4 of this Article, or on the determination of any tariff under paragraph 6 of this Article, the dispute shall be settled in accordance with the provisions of Article 16 of this Agreement.
8. A tariff established in accordance with provisions of this Article shall remain in force until a new tariff has been established. Nevertheless, a tariff shall not be prolonged by virtue of this paragraph for more than twelve months after the date on which it would otherwise have expired.
1. The designated airline of either Contracting Party shall, not later than 30 days prior to the date of operation of any agreed service (being a scheduled air service) submit its proposed timetables to the aeronautical authorities of the other Contracting Party for their approval. Such timetables shall include all relevant information, including the type of aircraft to be used, the frequency of service and the flight schedules.
2. The aeronautical authorities of a Contracting Party shall supply to the aeronautical authorities of the other Contracting Party at their request such periodic or other statements of statistics as may be reasonably required for the purpose of reviewing the capacity provided on the agreed services by the designated airlines of the Contracting Party referred to first in this Article. Such statements shall include all information required to determine the amount of traffic carried by those airlines on the agreed services and the origins and destinations of such traffic.
1. Each Contracting Party shall grant to the designated airline(s) of the other Contracting Party, the right of transfer the excess of receipts over expenditure, earned in the area of respective Contracting Party. Such remittance, however, shall be made in accordance with the foreign exchange regulations of the Contracting Party in the area of which the revenue accrued. Such transfer shall be effected promptly on the basis of official exchange rates or where there are no official exchange rates, at the prevailing foreign exchange market rates for current payment.
2. If a Contracting Party imposes restrictions on the transfer of excess of receipts over expenditure by the designated airlines of the other Contracting Party, the latter shall have the right to impose reciprocal restrictions on the designated airlines of the First Contracting Party.
3. The Contracting Parties have agreed to request their respective authorities concerned to conclude an agreement for the avoidance of Double Taxation on revenues arising from the activities of their airlines.
1. The designated airlines of one Contracting Party shall be permitted to bring and maintain in the area of the other Contracting Party, employees and other personnel responsible for the administration, technical and operation of their air services activities in accordance with their entry, residence, and employment rules and regulations of the other Contracting Party.
2. These staff requirements may, at the option of the designated airline of one Contracting Party, be satisfied by its own personnel or, by using the services of any other organization, company or airline operating in the area of the other Contracting Party, only if they are authorized to perform such services, (including handling of other airlines) in the area of that Contracting Party.
1. Either Contracting Party may request consultation on the interpretation, application or modification of this Agreement, which may be either oral or in writing and shall begin within a period of sixty (60) days of the date of receipt of the request, unless both Contracting Parties agree to an extension or reduction of this period.
2. In a spirit of close co-operation, the aeronautical authorities of the Contracting Parties shall consult each other from time to time with a view to ensuring the implementation of, and satisfactory compliance with, the provisions of this Agreement and the annexed Schedule.
1. If any dispute arises between the Contracting Parties relating to the interpretation or application of this Agreement, the Contracting Parties shall in the first place endeavor to settle it by negotiations.
2. If the Contracting Parties fail to reach a settlement by negotiation under the provision of paragraph 1 of this Article, the dispute shall be settled through arbitration according to the international practice.
1. If either of the Contracting Party desires to modify any provision of this Agreement including the annexed Schedule, it should be after consultation in accordance with Article 15 of this Agreement.
2. If the amendment relates to the provisions of the Agreement other than those of the annexed Schedule, the amendment shall be approved by each Contracting Party in accordance with its legal procedures and shall come into effect on the date of the exchange of letters through appropriate channels.
3. If the amendment relates only to the provisions of the annexed Schedule, it shall be agreed upon between the aeronautical authorities of both Contracting Parties and would be effective from the date of the approval of the aeronautical authorities.
This Agreement and any subsequent amendments shall be registered with the International Civil Aviation Organization.
Either Contracting Party may at any time give notice to the other Contracting Party of its decision to terminate this Agreement; such notice shall be simultaneously communicated to the International Civil Aviation Organization. In such case the Agreement shall terminate twelve (12) months after the date of receipt of the notice by the other Contracting Party unless the notice to terminate is withdrawn by agreement before the expiry of this period. In the absence of acknowledgment of receipt by the other Contracting Party, notice shall be deemed to have been received fourteen (14) days after the receipt of the notice by the International Civil Aviation Organization.
Annexes to the present Agreement shall be deemed to be part of the Agreement and all references to it shall include reference to the Annexes, except where otherwise expressly provided.
This Agreement shall come into force when the Contracting Parties have notified each other that necessary procedures have been fulfilled.
IN WITNESS WHEREOF, the undersigned being duly authorized by their respective Governments, have signed this Agreement.
Done in Dubai this 6th day of December, 1998 in two originals in Portuguese, Chinese, Arabic and English languages, four texts being equally authentic. In case of divergence, the English text shall prevail.

3. Fifth freedom traffic rights are granted to the designated airlines of the Contracting Parties on above routes. However, blind sector operations via any intermediate and to any beyond points are permitted, Hongkong and points in Taiwan and inland of China may not be served either as intermediate points or beyond points.
4. Any of the points on the specified routes in this Annex may at the option of the designated airline of either Contracting Party be omitted on any or all flights, provided that these flights originate or terminate in the area of the Contracting Party designating the airline.
5. All cargo operations for both parties shall be considered favorably on the basis of reciprocity with their own or leased equipment.
