    O Chefe do Executivo manda publicar, nos termos da alínea 6) do artigo 3.º e do n.º 1 do artigo 6.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, o «Acordo entre o Governo da Região Administrativa Especial de Macau da República Popular da China e o Governo da República Democrática Popular do Laos relativo a Serviços Aéreos».

    ACORDO ENTRE O GOVERNO DA REGIÃO ADMINISTRATIVA ESPECIAL DE MACAU DA REPÚBLICA POPULAR DA CHINA E O GOVERNO DA REPÚBLICA DEMOCRÁTICA POPULAR DO LAOS RELATIVO A SERVIÇOS AÉREOS

    O Governo da Região Administrativa Especial de Macau da República Popular da China, devidamente autorizado para concluir este Acordo pelo Governo Popular Central da República Popular da China, e o Governo da República Democrática Popular do Laos,

    Desejando concluir um Acordo com a finalidade de estabelecer um enquadramento para os serviços aéreos entre a Região Administrativa Especial de Macau e a República Democrática Popular do Laos,

    Acordaram entre si o seguinte:

    Artigo 1.º

    Definições

    Para efeitos do presente Acordo, salvo se o contexto diversamente o exigir:

    a) O termo «Autoridades Aeronáuticas» significa, no caso da República Democrática Popular do Laos, o Departamento de Aviação Civil e, no caso da Região Administrativa Especial de Macau, a Autoridade de Aviação Civil ou, em ambos os casos, qualquer pessoa ou entidade autorizada a exercer qualquer função presentemente asseguradas pelas referidas autoridades ou funções semelhantes;

    b) O termo «empresa de transporte aéreo designada» significa uma empresa de transporte aéreo que tenha sido designada e autorizada nos termos do Artigo 4.º do presente Acordo;

    c) O termo «área», em relação à Região Administrativa Especial de Macau, compreende a Península de Macau e as Ilhas de Taipa e de Coloane e em relação à República Democrática Popular do Laos tem o significado atribuído a «Território» no Artigo 2.º da Convenção de Chicago;

    d) Os termos «Serviços Aéreos», «Serviços Aéreos Internacionais», «Empresa de Transporte Aéreo» e «paragem para fins não comerciais» têm o significado que lhes é respectivamente atribuído pelo Artigo 96.º da Convenção de Chicago;

    e) O termo «taxa de utilização» significa uma taxa aplicada às empresas de transporte aéreo pelas autoridades competentes ou por estas autorizada, relativa à utilização de bens ou infra-estruturas aeroportuários ou de infra-estruturas de navegação aérea, incluindo serviços e infra-estruturas relacionados, por aeronaves, suas tripulações, passageiros e carga;

    f) O termo «o presente Acordo» inclui o respectivo Anexo e quaisquer modificações ao Acordo ou ao Anexo;

    g) O termo «leis e regulamentos» de uma Parte Contratante significa as leis e regulamentos vigentes em qualquer momento na área dessa Parte Contratante;

    h) O termo «Convenção de Chicago» significa a Convenção sobre Aviação Civil Internacional, aberta à assinatura em Chicago, em 7 de Dezembro de 1944, e inclui qualquer emenda efectuada que tenha entrado em vigor nos termos do Artigo 94.º, alínea (a) da Convenção, e qualquer Anexo ou qualquer emenda ao Anexo adoptado nos termos do Artigo 90.º da referida Convenção, na medida em que tal emenda ou Anexo estejam, em determinado momento, em vigor para ambas as Partes Contratantes.

    Artigo 2.º

    Disposições da Convenção de Chicago Aplicáveis aos Serviços Aéreos Internacionais

    Na aplicação do presente Acordo, as Partes Contratantes devem agir em conformidade com as disposições da Convenção de Chicago, incluindo os seus Anexos e quaisquer modificações à Convenção ou aos Anexos, na medida em que essas disposições sejam aplicáveis a ambas as Partes Contratantes.

    Artigo 3.º

    Concessão de Direitos

    1. Cada Parte Contratante concede à outra Parte Contratante os seguintes direitos no que diz respeito aos seus serviços aéreos internacionais:

    a) O direito a sobrevoar a sua área sem aterrar;

    b) O direito de fazer escalas na sua área para fins não comerciais.

    2. Cada Parte Contratante concede à outra Parte Contratante os direitos daqui em diante especificados no presente Acordo para o fim de explorar os serviços aéreos internacionais nas rotas especificadas na respectiva Secção do Anexo ao presente Acordo. Tais serviços e rotas são, de ora em diante, designados por «os serviços acordados» e «as rotas especificadas», respectivamente. Na exploração de um serviço acordado numa rota especificada, a(s) empresa(s) de transporte aéreo designada(s) por cada Parte Contratante goza(m), para além dos direitos especificados no número 1. do presente Artigo, do direito de fazer escalas na área da outra Parte Contratante nos pontos especificados para aquela rota no Quadro anexo ao presente Acordo, com a finalidade de embarcar ou desembarcar passageiros, bagagem e carga incluindo correio, separada ou conjuntamente.

    3. Nada no número 2. do presente Artigo deve ser entendido como concedendo à(s) empresa(s) de transporte aéreo designada(s) por uma Parte Contratante o direito de embarcar, na área da outra Parte Contratante, passageiros e carga, incluindo correio, transportados por aluguer ou de forma remunerada e destinados a um outro ponto na área da outra Parte Contratante.

    4. Se por força de conflito armado, perturbações ou acontecimentos de ordem política, ou circunstâncias especiais e anormais, a(s) empresa(s) de transporte aéreo designada(s) por uma Parte Contratante ficar(em) impossibilitada(s) de explorar um serviço na sua rota normal, a outra Parte Contratante deve envidar todos os esforços para facilitar a continuação da exploração desse serviço através de reajustamentos apropriados temporários das rotas.

    Artigo 4.º

    Designação e Autorização de Empresas de Transporte Aéreo

    1. Cada Parte Contratante tem o direito de designar, por escrito, à outra Parte Contratante uma ou mais empresas de transporte aéreo para o efeito de exploração dos serviços acordados nas rotas especificadas e de revogar ou alterar essas designações.

    2. Uma vez recebida essa designação, a outra Parte Contratante deve, nos termos dos números 3. e 4. do presente Artigo, conceder sem demora à(s) empresa(s) de transporte aéreo designada(s) as necessárias autorizações de exploração.

    3. As Autoridades Aeronáuticas de uma Parte Contratante podem exigir que uma empresa(s) de transporte aéreo designada(s) pela outra Parte Contratante prove que preenche as condições prescritas nos termos das leis e dos regulamentos normais e razoavelmente aplicados à exploração dos serviços aéreos internacionais pelas referidas autoridades.

    4. a) O Governo da República Democrática Popular do Laos tem o direito de recusar conceder a autorização de exploração referida no número 2. do presente Artigo, ou de impor as condições que considere necessárias ao exercício por uma(s) empresa(s) de transporte aéreo designada(s) dos direitos especificados no número 2. do Artigo 3.º do presente Acordo, sempre que considere não estar demonstrado que essa empresa de transporte aéreo está constituída e tem o seu principal local de negócios na Região Administrativa Especial de Macau.

    b) O Governo da Região Administrativa Especial de Macau tem o direito de recusar conceder a autorização de exploração referida no número 2. do presente Artigo, ou de impor as condições que considere necessárias ao exercício por uma(s) empresa(s) de transporte aéreo designada(s) dos direitos especificados no número 2. do Artigo 3.º do presente Acordo, sempre que considere não estar demonstrado que essa empresa de transporte aéreo está constituída e tem o seu principal local de negócios na República Democrática Popular do Laos.

    5. Quando uma empresa de transporte aéreo tenha sido desta forma designada e autorizada, pode iniciar a exploração dos serviços acordados, desde que cumpra as disposições aplicáveis do presente Acordo.

    Artigo 5.º

    Aplicação das Leis e dos Regulamentos

    1. As leis e regulamentos de uma Parte Contratante relativos à entrada ou à saída da sua área de aeronaves afectas a serviços aéreos internacionais ou à exploração e navegação dessas aeronaves enquanto se encontrarem na referida área, aplicam-se às aeronaves da(s) empresa(s) de transporte aéreo designada(s) pela outra Parte Contratante, sem distinção de nacionalidade, e devem ser cumpridos por essas aeronaves à entrada, à saída e durante a permanência na área da primeira Parte Contratante

    2. As leis e regulamentos de uma Parte Contratante relativos à entrada ou saída da sua área de passageiros, tripulações, carga ou correio transportados a bordo de aeronaves, tais como os regulamentos respeitantes à entrada, saída, imigração, passaportes, alfândega e quarentena, são cumpridas pela(s) empresa(s) de transporte aéreo designada(s) pela outra Parte Contratante, por ou em nome desses passageiros, tripulações, carga e correio, à entrada, à saída e durante a permanência na área da primeira Parte Contratante.

    3. Na aplicação das leis e regulamentos referidos neste Artigo à empresa(s) de transporte aéreo designada(s) pela outra Parte Contratante, nenhuma das Partes Contratantes deve conceder tratamento mais favorável à sua ou suas próprias empresas de transporte aéreo.

    Artigo 6.º

    Revogação ou Suspensão da Autorização de Exploração

    1. Cada Parte Contratante tem o direito de revogar ou suspender uma autorização de exploração ou de suspender o exercício, por uma empresa de transporte aéreo designada pela outra Parte Contratante, dos direitos especificados no número 2. do Artigo 3.º do presente Acordo, ou de impor as condições que considere necessárias ao exercício desses direitos:

    a) 1) No caso do Governo da Região Administrativa Especial de Macau, sempre que não esteja convencido que essa empresa de transporte aéreo está constituída e tem o seu principal local de negócios na República Democrática Popular do Laos;

    2) No caso do Governo da República Democrática Popular do Laos, sempre que não esteja convencida que essa empresa de transporte aéreo está constituída e tem o seu principal local de negócios na Região Administrativa Especial de Macau; ou

    b) No caso de essa empresa de transporte aéreo não cumprir as leis e regulamentos da Parte Contratante que concedeu esses direitos; ou

    c) Se essa empresa de transporte aéreo deixar de operar de acordo com as condições previstas neste Acordo.

    2. Salvo se a imediata revogação ou suspensão da autorização de exploração ou a suspensão do exercício dos direitos mencionados no número 1. deste Artigo ou a imposição das condições aí referidas se mostrarem essenciais para impedir novas infracções das leis e regulamentos, os direitos referidos só dever ser exercidos após a realização de consultas com a outra Parte Contratante.

    Artigo 7.º

    Princípios Reguladores da Exploração dos Serviços Acordados

    1. As empresas de transporte aéreo designadas por ambas as Partes Contratantes beneficiam de justas e iguais oportunidades na exploração dos serviços acordados nas rotas especificadas.

    2. Os serviços acordados fornecidos pela(s) empresa(s) de transporte aéreo designada(s) pelas Partes Contratantes devem estar estreitamente relacionados com as exigências de transporte de público nas rotas especificadas e ter como objectivo primordial o fornecimento, segundo uma taxa de ocupação razoável, de capacidade adequada à satisfação das necessidades presentes e razoavelmente previsíveis de transporte de passageiros e carga, incluindo correio, de e para a área da Parte Contratante que tenha designado a empresa de transporte aéreo. O fornecimento de transporte de passageiros e carga, incluindo correio, embarcados e desembarcados em pontos nas rotas especificadas que não aqueles pontos na área da Parte Contratante que designou a empresa de transporte aéreo, deve obedecer aos princípios gerais segundo os quais a capacidade está relacionada com:

    a) As exigências de tráfego de e para a área da Parte Contratante que tenha designado a(s) empresa(s) de transporte aéreo;

    b) As exigências de tráfego da região atravessada pelo serviço acordado, após serem tomados em conta os outros serviços de transporte estabelecidos pelas empresas de transporte aéreo dos estados que constituem a região; e

    c) As exigências da exploração integral da empresa de transporte aéreo.

    Artigo 8.º

    Tarifas

    1. O termo «tarifa» inclui um ou mais dos seguintes significados:

    a) o preço cobrado por uma empresa de transporte aéreo pelo transporte de passageiros e a respectiva bagagem em serviços aéreos regulares e os encargos e condições relativos a serviços auxiliares a esse transporte;

    b) a tarifa de carga cobrada por uma empresa de transporte aéreo pelo transporte de carga (excluindo correio) em serviços aéreos regulares;

    c) as condições reguladoras da existência ou aplicabilidade desses preços ou tarifas de carga incluindo quaisquer benefícios relacionados com os mesmos; e

    d) a taxa de comissão paga por uma empresa de transporte aéreo a um agente relativamente a bilhetes vendidos ou conhecimentos de carga aérea emitidos por esse agente para transporte em serviços aéreos regulares.

    2. As tarifas a serem aplicadas, por empresa(s) de transporte aéreo designada(s) pela uma Parte Contratante, ao transporte de e para a área da outra Parte Contratante serão estabelecidas a níveis razoáveis, tendo em devida conta todos os factores relevantes, incluindo o custo de exploração, os interesses dos utilizadores, um lucro razoável, as características de cada serviço e as tarifas praticadas por outras empresas de transporte aéreo.

    3. As Autoridades Aeronáuticas de ambas as Partes Contratantes não devem solicitar às respectivas empresas de transporte aéreo que consultem outras empresas de transporte aéreo antes de submeterem à aprovação as tarifas para os serviços abrangidos pelas disposições seguintes.

    4. As tarifas referidas no número 2. do presente Artigo deverão ser submetidas às Autoridades Aeronáuticas das Partes Contratantes pela empresa(s) de transporte aéreo designada(s), que pretenda a aprovação da tarifa, na forma como as Autoridades Aeronáuticas separadamente exigirem, a fim de remeter os dados referidos no número 1. do presente Artigo. As tarifas serão submetidas pelo menos sessenta (60) dias (ou num prazo menor, se acordado pelas Autoridades Aeronáuticas das Partes Contratantes) antes da data proposta para a sua entrada em vigor. A tarifa proposta será considerada como tendo sido submetida às Autoridades Aeronáuticas de uma das Partes Contratantes na data em que for recebida por essas Autoridades Aeronáuticas.

    5. Qualquer tarifa proposta pode ser aprovada pelas Autoridades Aeronáuticas de uma Parte Contratante, a qualquer momento e, desde que tenham sido submetidas em conformidade com o número 4. do presente Artigo, será considerada como tendo sido aprovada pelas Autoridades Aeronáuticas da outra Parte Contratante, salvo se, no prazo de 30 trinta (30) dias (ou num prazo menor, se acordado pelas Autoridades Aeronáuticas das Partes Contratantes) após a data da submissão, as Autoridades Aeronáuticas de uma das Partes Contratantes tiverem notificado, por escrito, as Autoridades Aeronáuticas da outra Parte Contratante, da sua desaprovação da tarifa proposta.

    6. Se uma notificação de desaprovação é feita em conformidade com o disposto no número 5. do presente Artigo, as Autoridades Aeronáuticas das Partes Contratantes podem estabelecer, conjuntamente, as tarifas. Para este efeito, uma das Partes Contratantes pode, no prazo de trinta (30) dias contados a partir da data da notificação de desaprovação, solicitar consultas entre as Autoridades Aeronáuticas das Partes Contratantes, que deve ser realizada no prazo de trinta (30) dias a contar da data em que a Parte Contratante recebe da solicitação escrita.

    7. Uma tarifa já estabelecida deve manter-se em vigor até que uma nova tarifa seja estabelecida em conformidade com as disposições do presente Artigo.

    Artigo 9.º

    Direitos Aduaneiros

    1. As aeronaves utilizadas em serviços aéreos internacionais pela(s) empresa(s) de transporte aéreo designada(s) por qualquer Parte Contratante, o seu equipamento normal, o combustível, os lubrificantes, as peças sobressalentes incluindo motores, e as provisões de bordo (incluindo mas não limitado a artigos como alimentos, bebidas e tabaco) que se encontrem a bordo dessas aeronaves são isentos pela outra Parte Contratante, numa base de reciprocidade, de todos os direitos aduaneiros, impostos sobre o consumo e taxas e encargos similares não baseados no custo dos serviços prestados à chegada, desde que esses equipamentos e abastecimentos permaneçam a bordo da aeronave.

    2. O equipamento normal, as peças sobressalentes, os abastecimentos de combustíveis e lubrificantes, as provisões de bordo, os bilhetes impressos, os conhecimentos de carga aéreos, quaisquer materiais impressos que tenham aposta a insígnia de uma(s) empresa(s) de transporte aéreo designada(s) por qualquer Parte Contratante e o material publicitário normal distribuído gratuitamente por essa(s) empresa(s) de transporte aéreo designada(s), introduzidos na área da outra Parte Contratante, por ou em nome dessa(s) empresa(s) de transporte aéreo designada(s), ou embarcados nas aeronaves utilizada por aquela(s) empresa(s) de transporte aéreo designada(s) e destinados unicamente ao uso a bordo dessas aeronaves na exploração de serviços internacionais são isentos pela outra Parte Contratante, numa base de reciprocidade, dos direitos aduaneiros, impostos sobre o consumo e taxas ou encargos similares não baseados no custo dos serviços prestados à chegada, mesmo quando esses abastecimentos se destinem a ser usados numa qualquer parte da viagem que tenha lugar sobre a área da Parte Contratante na qual são embarcados.

    3. Pode ser exigido que os artigos mencionados nos números 1. e 2. do presente Artigo sejam mantidos sob a vigilância ou controlo das autoridades competentes.

    4. O equipamento de bordo normal, as peças sobressalentes, os abastecimentos de combustível e lubrificantes e as provisões de bordo das aeronaves de uma(s) empresa(s) de transporte aéreo designada(s) por qualquer Parte Contratante só podem ser descarregados na área da outra Parte Contratante com a aprovação das autoridades alfandegárias dessa Parte Contratante, as quais podem exigir que esses materiais sejam colocados sob a sua vigilância até que sejam reexportados, ou que de outra forma seja disposto sobre eles de acordo com os regulamentos aduaneiros.

    5. As isenções previstas no presente Artigo aplicam-se também aos casos em que uma(s) empresa(s) de transporte aéreo designada(s) por qualquer Parte Contratante tenha estabelecido acordos com outra empresa ou empresas de transporte aéreo para o empréstimo ou a transferência na área da outra Parte Contratante dos artigos especificados nos números 1. e 2. do presente Artigo, desde que essa outra empresa ou empresas de transporte aéreo beneficiem igualmente das mesmas isenções junto dessa outra Parte Contratante.

    6. A bagagem e a carga em trânsito directo através da área de uma Parte Contratante estão isentos de direitos aduaneiros, impostos de consumo e taxas similares não baseadas no custo dos serviços prestados à chegada.

    Artigo 10.º

    Segurança da Aviação

    1. As Partes Contratantes reafirmam que a sua obrigação mútua de protecção da segurança da aviação civil contra actos de interferência ilícita faz parte integrante deste Acordo. As Partes Contratantes devem agir, em especial, em conformidade com as disposições respeitantes a segurança da aviação constantes da Convenção referente às Infracções e a Certos Outros Actos Cometidos a Bordo de Aeronaves, assinada em Tóquio, aos 14 de Setembro de 1963, da Convenção para a Repressão da Captura Ilícita de Aeronaves, assinada na Haia, aos 16 de Dezembro de 1970, da Convenção para a Repressão de Actos Ilícitos Contra a Segurança da Aviação Civil, assinada em Montreal, aos 23 de Setembro de 1971, e do Protocolo para a Repressão de Actos Ilícitos de Violência nos Aeroportos destinados à Aviação Civil Internacional, assinado em Montreal em 24 de Fevereiro de 1988 bem como com qualquer outra convenção e protocolo sobre a segurança da aviação civil que se tornem obrigatórios para ambas as Partes Contratantes.

    2. As Partes Contratantes devem prestar-se mutuamente, mediante pedido, todo o apoio necessário para impedir actos de captura ilícita de aeronaves civis e outros actos ilícitos contra a segurança dessas aeronaves, dos seus passageiros e tripulações, dos aeroportos e infra-estruturas de navegação aérea, e qualquer outra ameaça à segurança da aviação civil.

    3. As Partes Contratantes devem agir, no seu relacionamento mútuo, em conformidade com as disposições sobre segurança da aviação estabelecidas pela Organização da Aviação Civil Internacional e designadas como Anexos à Convenção de Chicago. Exigirão que os operadores das aeronaves nelas registadas ou operadores de aeronaves que tenham o seu principal local de negócios ou residência permanente na sua área e os operadores de aeroportos na sua área, actuem em conformidade com aquelas disposições sobre segurança da aviação.

    4. Cada Parte Contratante aceita que possa ser exigido que esses operadores de aeronaves cumpram as disposições sobre a segurança da aviação, referidas no número 3. supra, exigidas pela outra Parte Contratante à entrada, saída ou durante a permanência na área dessa Parte Contratante. Cada Parte Contratante assegura que sejam efectivamente aplicadas, na sua área, medidas adequadas de protecção às aeronaves e de inspecção aos passageiros, tripulação, bagagem de mão, bagagem, carga e provisões de bordo, antes e durante o embarque ou carregamento. Cada Parte Contratante deve dar especial atenção a qualquer solicitação da outra Parte Contratante respeitante à tomada de medidas especiais de segurança razoáveis para fazer face a uma ameaça específica.

    5. Caso ocorra um incidente ou ameaça de um incidente de captura ilícita de aeronaves civis ou outros actos ilícitos contra a segurança dessas aeronaves, dos seus passageiros e tripulações, de aeroportos ou infra-estruturas de navegação aérea, as Partes Contratantes devem prestar-se apoio mútuo, facilitando as comunicações e outras medidas apropriadas tendentes a pôr termo com rapidez e segurança a esse incidente ou ameaça.

    Artigo 11.º

    Segurança Operacional

    1. Cada Parte Contratante pode solicitar a realização de consultas a qualquer tempo sobre padrões de segurança operacional adoptados pela outra Parte Contratante em qualquer área relativa a tripulações, aeronaves ou à respectiva operação. Tais consultas devem iniciar-se no prazo de trinta (30) dias a contar da data do pedido.

    2. Se, após as consultas referidas, uma Parte Contratante entender que a outra Parte Contratante não mantém e aplica eficazmente, em qualquer das áreas, padrões de segurança operacional que sejam pelo menos equivalentes aos padrões mínimos estabelecidos nessa data em conformidade com a Convenção de Chicago, a primeira Parte Contratante deve notificar a outra Parte Contratante dessas conclusões e das medidas consideradas necessárias para tornar os padrões conforme com os padrões mínimos, e a outra Parte Contratante deve adoptar as medidas correctivas adequadas. A omissão de adopção de medidas apropriadas pela outra Parte Contratante no prazo de quinze (15) dias ou num prazo mais longo que tenha sido acordado constitui fundamento para a aplicação do número 1. do Artigo 6.º do presente Acordo (Revogação ou Suspensão da Autorização de Exploração).

    3. Não obstante as obrigações constantes do Artigo 33.º da Convenção de Chicago, é acordado que qualquer aeronave operada por ou, em nome, da empresa ou empresas de transporte aéreo de uma Parte Contratante, ao abrigo de um contrato de locação, nos serviços para ou a partir da área da outra Parte Contratante, pode, enquanto dentro da área da outra Parte Contratante, ser sujeita a um exame pelos representantes autorizados desta outra Parte Contratante, a bordo e ao exterior da aeronave, para verificar a validade dos documentos da aeronave e da sua tripulação, bem como a condição aparente da aeronave e do seu equipamento, (no presente Artigo designada por «inspecção na placa» (ramp inspection), desde que isto não conduza a atrasos desrazoáveis.

    4. Se qualquer inspecção na placa ou uma série de inspecções na placa originarem:

    (a) preocupações sérias de que uma aeronave ou a operação de uma aeronave não cumprem com os padrões mínimos estabelecidos nessa data em conformidade com a Convenção de Chicago, ou

    (b) preocupações sérias de que há uma falha de manutenção e aplicação eficazes dos padrões de segurança operacional estabelecidos nessa data em conformidade com a Convenção de Chicago;

    a Parte Contratante que efectuar a inspecção tem, para efeitos do Artigo 33.º da Convenção de Chicago, a liberdade de concluir que os requisitos ao abrigo dos quais os certificados ou as licenças relativos àquela aeronave ou relativos à tripulação daquela aeronave foram emitidos ou tornados válidos ou que os requisitos ao abrigo dos quais aquela aeronave é explorada não são iguais ou superiores aos padrões mínimos de segurança operacional aplicáveis em conformidade com a Convenção de Chicago.

    5. Caso o acesso para a realização da inspecção na placa de uma aeronave explorada pela empresa ou empresas de transporte aéreo de uma Parte Contratante, de acordo com o número 3. do presente Artigo, seja negado por um representante dessa empresa ou empresas de transporte aéreo, a outra Parte Contratante tem o direito de concluir que existem preocupações sérias do tipo das referidas no número 4. deste Artigo e de retirar as conclusões referidas nesse número.

    6. Cada Parte Contratante reserva-se o direito de suspender ou alterar com efeitos imediatos a autorização de exploração de uma empresa ou empresas de transporte aéreo da outra Parte Contratante caso a primeira Parte Contratante conclua, em resultado de uma inspecção na placa, várias inspecções na placa, uma recusa de acesso para inspecção na placa, de consultas ou por outros motivos, que a tomada de medidas imediatas é essencial para a segurança operacional das operações de uma empresa de transporte aéreo.

    7. Qualquer medida implementada por uma Parte Contratante, de acordo com os números 2. ou 6. deste Artigo, será suspensa logo que as bases para a adopção dessa medida deixem de existir.

    Artigo 12.º

    Fornecimento de Estatísticas

    As Autoridades Aeronáuticas de uma Parte Contratante devem fornecer às Autoridades Aeronáuticas da outra Parte Contratante, a pedido destas, dados estatísticos periódicos ou outros documentos, que possam ser razoavelmente necessários para a revisão da capacidade oferecida nos serviços acordados pela(s) empresa(s) de transporte aéreo designada(s) pelas Partes Contratantes referidas no início deste Artigo. Esses dados devem incluir toda a informação necessária à determinação do volume de tráfego transportado por essas empresas de transporte aéreo nos serviços acordados.

    Artigo 13.º

    Transferência de Rendimentos

    1. A(s) empresa(s) de transporte aéreo designada(s) pela Região Administrativa Especial de Macau têm o direito de converter e transferir para a Região Administrativa Especial de Macau o excedente das receitas locais sobre as despesas efectuadas localmente. A(s) empresa(s) de transporte aéreo designada(s) pela República Democrática Popular do Laos têm o direito de converter e transferir para a República Democrática Popular do Laos o excedente das receitas locais sobre as despesas efectuadas localmente.

    2. A conversão e a transferência são autorizadas, sem restrições, à taxa de câmbio aplicável às transacções correntes que se verificar à data em que essas receitas sejam apresentadas para conversão e transferência e estão isentas de encargos, excepto os normalmente cobrados pelos bancos para realizar essa conversão e transferência.

    Artigo 14.º

    Representação das Empresas de Transporte Aéreo

    1. A(s) empresa(s) de transporte aéreo designada(s) por uma Parte Contratante podem, de acordo com as leis e regulamentos da outra Parte Contratante respeitantes à entrada, residência e emprego, trazer para e manter na área da outra Parte Contratante o seu próprio pessoal de gestão, técnico, operacional e outro pessoal especializado necessário para o fornecimento de serviços aéreos.

    2. A(s) empresa(s) de transporte aéreo designada(s) por cada Parte Contratante têm o direito de vender transporte aéreo na área da outra Parte Contratante directamente e, se o entenderem, através dos seus agentes. Cada empresa de transporte aéreo tem o direito de vender esse transporte, e qualquer pessoa será livre de adquirir, esse transporte na moeda local ou em qualquer outra moeda livremente convertível.

    Artigo 15.º

    Taxas de Utilização

    1. Nenhuma Parte Contratante pode impor ou permitir que sejam impostas à(s) empresa(s) de transporte aéreo designada(s) pela outra Parte Contratante taxas de utilização superiores às impostas às suas próprias empresas de transporte aéreo que explorem serviços aéreos internacionais similares.

    2. Cada Parte Contratante deve incentivar a realização de consultas entre as suas autoridades responsáveis pela imposição das taxas e as empresas de transporte aéreo utilizadoras dos serviços e infra-estruturas, sempre que possível, através de organizações representativas das empresas de transporte aéreo. Às referidas utilizadoras deve ser dado um pré-aviso razoável de qualquer proposta de alteração nas taxas de utilização por forma a permitir-lhes expressar as suas opiniões antes de as alterações serem efectuadas. Cada Parte Contratante deve estimular ainda a troca de informação apropriada relativa às taxas de utilização, entre as autoridades responsáveis pela imposição das taxas e as empresas de transporte aéreo.

    Artigo 16.º

    Consultas

    Qualquer Parte Contratante pode, a qualquer momento, solicitar a realização de consultas sobre a implementação, interpretação, aplicação ou modificação do presente Acordo. Tais consultas, que podem ter lugar entre as Autoridades Aeronáuticas, devem iniciar-se no prazo de sessenta (60) dias a contar da data em que a outra Parte Contratante receba um pedido escrito, salvo acordo em contrário entre as Partes Contratantes.

    Artigo 17.º

    Resolução de Diferendos

    1. Se surgir um diferendo entre as Partes Contratantes relativo à interpretação ou aplicação do presente Acordo, as Partes Contratantes devem procurar, em primeiro lugar, resolvê-lo pela via da negociação.

    2. Se as Partes Contratantes não conseguirem resolver o diferendo pela via da negociação, podem acordar em submetê-lo a uma pessoa ou entidade ou, a pedido de qualquer Parte Contratante, submetê-lo à decisão de um tribunal de três árbitros, que será constituído da seguinte forma:

    a) No prazo de trinta (30) dias após a recepção do pedido de arbitragem, cada Parte Contratante nomeia um árbitro. Um nacional de um Estado que possa ser considerado como neutro em relação a este diferendo, o qual actuará como Presidente do tribunal, é nomeado como terceiro árbitro por acordo entre os dois árbitros no prazo de sessenta (60) dias a contar a partir da nomeação do segundo;

    b) Se dentro dos limites temporais acima especificados não tiver sido feita uma das nomeações, qualquer Parte Contratante pode solicitar ao Presidente do Conselho da Organização da Aviação Civil Internacional que proceda à nomeação necessária no prazo de trinta (30) dias. Se o Presidente considerar que é nacional de um Estado que não possa ser considerado como neutral em relação ao diferendo, o Vice-Presidente mais antigo, que não esteja impedido pelo mesmo motivo, procede à nomeação.

    3. Salvo o previsto no presente Artigo ou acordo em contrário entre as Partes Contratantes, o tribunal determina os limites da sua jurisdição e estabelece os seus próprios procedimentos. Por iniciativa do tribunal ou a pedido de qualquer Parte Contratante, tem lugar, no prazo máximo de trinta (30) dias após a constituição definitiva do tribunal, uma conferência para determinar as questões precisas a serem arbitradas e os procedimentos específicos a serem seguidos.

    4. Salvo acordo em contrário das Partes Contratantes ou determinação do tribunal, cada Parte Contratante submete um memorando no prazo de quarenta e cinco (45) dias após a constituição definitiva do tribunal. As respostas devem ser submetidas após sessenta (60) dias. Por sua iniciativa ou a pedido de qualquer Parte Contratante, o tribunal realiza uma audiência no prazo de trinta (30) dias após o termo do prazo para a submissão das respostas.

    5. O tribunal deve procurar proferir uma decisão escrita no prazo de trinta (30) dias após a conclusão da audiência ou, se não houver audiência, após a submissão de ambas as respostas. A decisão será tomada por maioria de votos.

    6. As Partes Contratantes podem submeter pedidos de clarificação da decisão no prazo de quinze (15) dias após a sua recepção e essa clarificação será emitida no prazo de quinze (15) dias a contar de tal pedido.

    7. A decisão do tribunal é vinculativa para as Partes Contratantes.

    8. Cada Parte Contratante suporta as despesas do árbitro por si nomeado. As outras despesas do tribunal são repartidas em partes iguais pelas Partes Contratantes, incluindo quaisquer despesas realizadas pelo Presidente ou pelo Vice-Presidente do Conselho da Organização da Aviação Civil Internacional na execução dos procedimentos referidos na alínea b) do número 2. do presente Artigo.

    Artigo 18.º

    Modificação

    1. Qualquer Parte Contratante pode, a qualquer momento, solicitar consultas com a outra Parte Contratante para modificar o presente Acordo ou os seus Anexos. Tais consultas devem ter início no prazo de sessenta (60) dias contados a partir da data de recepção do pedido. Essas consultas podem ser realizadas através de conversações directas ou por correspondência.

    2. Se qualquer das Partes Contratantes desejar modificar uma disposição deste Acordo, a modificação, se acordada entre as Partes Contratantes, pode ser aplicada provisoriamente a partir da data em que foi acordada e entrará em vigor quando confirmada por escrito por ambas as Partes Contratantes.

    Artigo 19.º

    Denúncia

    Qualquer Parte Contratante pode, a qualquer momento, notificar por escrito a outra Parte Contratante da sua intenção de denunciar o presente Acordo. O presente Acordo termina à meia-noite (do local de recepção da notificação) imediatamente anterior ao primeiro aniversário da data de recepção da notificação pela outra Parte Contratante, salvo se a notificação for retirada por acordo antes do termo desse prazo.

    Artigo 20.º

    Registo na Organização da Aviação Civil Internacional

    O presente Acordo e todas as suas modificações devem ser registados junto da Organização da Aviação Civil Internacional.

    Artigo 21.º

    Entrada em Vigor

    O presente Acordo entra em vigor logo que as Partes Contratantes se notificarem mutuamente por escrito que todos os procedimentos necessários foram concluídos.

    EM FÉ DE QUE, os signatários, tendo sido devidamente autorizados pelos seus respectivos Governos, assinaram o presente Acordo.

    Feito em Macau, aos 25 de Junho de 2013, em duplicado, nas línguas chinesa, portuguesa, laociana e inglesa, sendo todos os textos igualmente autênticos. Em caso de divergência de interpretação, prevalece o texto em língua Inglesa.

    AGREEMENT BETWEEN THE GOVERNMENT OF THE MACAO SPECIAL ADMINISTRATIVE REGION OF THE PEOPLE’S REPUBLIC OF CHINA AND THE GOVERNMENT OF THE LAO PEOPLE’S DEMOCRATIC REPUBLIC CONCERNING AIR SERVICES

    The Government of the Macao Special Administrative Region of the People’s Republic of China having been duly authorized to conclude this Agreement by the Central People’s Government of the People’s Republic of China and the Government of the Lao People’s Democratic Republic,

    Desiring to conclude an Agreement for the purpose of providing the framework for air services between the Macao Special Administrative Region and the Lao People’s Democratic Republic,

    Have agreed as follows:

    Article 1

    Definitions

    For the purpose of this Agreement, unless the context otherwise requires;

    a) The term “Aeronautical Authorities” means in the case of the Lao People’s Democratic Republic, the Department of Civil Aviation and in the case of the Macao Special Administrative Region, the Civil Aviation Authority, or, in both cases, any person or body authorized to perform any function at present exercisable by the above-mentioned authorities or similar functions;

    b) The term “designated airline” means an airline(s) which has been designated and authorized in accordance with Article 4 of this Agreement;

    c) The term “area” in relation to the Macao Special Administrative Region includes the Macao Peninsula and the Taipa and Coloane Islands and in relation to the Lao People’s Democratic Republic, has the meaning assigned to “Territory” in Article 2 of the Chicago Convention;

    d) The terms “Air Services”, “International Air Services”, “Airline” and “stop for non-traffic purposes” have the meanings respectively assigned to them in Article 96 of the Chicago Convention;

    e) The term “user charge” means a charge made to airlines by the competent authorities or permitted by them to be made for the provision of airport property or facilities or of air navigation facilities, including related services and facilities, for aircraft, their crews, passengers and cargo;

    f) The term “this Agreement” includes the Annex hereto and any amendments to it or to this Agreement;

    g) The term “laws and regulations” of a Contracting Party means the laws and regulations at any time in force in the area of that Contracting Party;

    h) The Term “Chicago Convention” means the Convention on International Civil Aviation, opened for signature at Chicago on December 7, 1944, and includes any amendment that has entered into force under Article 94(a) of the Convention and any Annex or any amendment thereto adopted under Article 90 of the Convention, insofar as such amendments or Annex are at any given time effective for both Contracting Parties.

    Article 2

    Provisions of the Chicago Convention Applicable to International Air Services

    In implementing this Agreement, the Contracting Parties shall act in conformity with the provisions of the Chicago Convention, including the Annexes, and any amendment to the Convention or to the Annexes, insofar as these provisions are applicable to both Contracting Parties.

    Article 3

    Grant of Rights

    1. Each Contracting Party grants to the other Contracting Party the following rights in respect of its international air services:

    a) The right to fly across its area without landing;

    b) The right to make stops in its area for non-traffic purposes.

    2. Each Contracting Party grants to the other Contracting Party the rights hereinafter specified in this Agreement for the purpose of operating international air services on the routes specified in the appropriate Section of the Annex to this Agreement. Such services and routes are hereinafter called “the agreed services” and “the specified routes” respectively. While operating an agreed service on a specified route the airline(s) designated by each Contracting Party shall enjoy in addition to the rights specified in paragraph 1 of this Article the right to make stops in the area of the other Contracting Party at the points specified for that route in the Schedule to this Agreement for the purpose of taking on board or discharging passengers, baggage and cargo, including mail, separately or in combination.

    3. Nothing in paragraph 2 of this Article shall be deemed to confer on the designated airline(s) of one Contracting Party the right to take on board, in the area of the other Contracting Party, passengers and cargo, including mail, carried for hire or reward and destined for another point in the area of the other Contracting Party.

    4. If because of armed conflict, political disturbances or developments, or special and unusual circumstances, a designated airline(s) of one Contracting Party is unable to operate a service on its normal routing, the other Contracting Party shall use its best efforts to facilitate the continued operation of such service through appropriate temporary rearrangements of routes.

    Article 4

    Designation and Authorization of Airlines

    1. Each Contracting Party shall have the right to designate in writing to the other Contracting Party one or more airlines for the purpose of operating the agreed services on the specified routes and to withdraw or alter such designations.

    2. On receipt of such a designation the other Contracting Party shall, subject to the provisions of paragraphs 3 and 4 of this Article, without delay grant to the airline(s) designated the appropriate operating authorizations.

    3. The Aeronautical Authorities of one Contracting Party may require an airline(s) designated by the other Contracting Party to satisfy them that it is qualified to fulfill the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services by such authorities.

    4. a) The Government of the Lao People’s Democratic Republic shall have the right to refuse to grant the operating authorizations referred to in paragraph 2 of this Article or to impose such conditions as it may deem necessary on the exercise by a designated airline(s) of the right specified in paragraph 2 of Article 3 of this Agreement, in any case where it is not satisfied that that airline is incorporated and has its principal place of business in the Macao Special Administrative Region.

    b) The Government of the Macao Special Administrative Region shall have the right to refuse to grant the operating authorizations referred to in paragraph 2 of this Article, or to impose such conditions as it may deem necessary on the exercise by a designated airline(s) of the rights specified in paragraph 2 of Article 3 of this Agreement, in any case where it is not satisfied that that airline is incorporated and has its principal place of business in the Lao People’s Democratic Republic.

    5. When an airline has been so designated and authorized it may begin to operate the agreed services, provided that the airline complies with the applicable provisions of this Agreement.

    Article 5

    Application of Laws and Regulations

    1. The laws and regulations of one Contracting Party relating to the admission to or departure from its area of aircraft engaged in international air services, or to the operation and navigation of such aircraft while within this area shall be applied to the aircraft of the airline(s) designated by the other Contracting Party without distinction as to nationality, and shall be complied with by such aircraft upon entry into, departure from or while within, the area of the first Contracting Party.

    2. The laws and regulations of one Contracting Party relating to the admission to or departure from its area of passengers, crew, cargo or mail on aircraft such as regulations relating to entry, clearance, immigration, passports, customs and quarantine, shall be complied with by or on behalf of such passengers, crew, cargo or mail of the airline(s) designated by the other Contracting Party upon entry into, departure from, or while within, the area of the first Contracting Party.

    3. In the application to the designated airline(s) of the other Contracting Party of the laws and regulations referred to in this Article a Contracting Party shall not grant more favorable treatment to its own airline or airlines.

    Article 6

    Revocation or Suspension of Operating Authorization

    1. Each Contracting Party shall have the right to revoke or suspend an operating authorization or to suspend the exercise of the rights specified in paragraph 2 of Article 3 of this Agreement by an airline(s) designated by the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of those rights:

    a) 1) In the case of the Government of the Macao Special Administrative Region, in any case where it is not satisfied that that airline is incorporated and has its principal place of business in the Lao People’s Democratic Republic;

    2) In the case of the Government of the Lao People’s Democratic Republic, in any case where it is not satisfied that that airline is incorporated and has its principal place of business in the Macao Special Administrative Region; or

    b) In the case of failure by that airline to comply with the laws and regulations of the Contracting Party granting those rights; or

    c) If that airline otherwise fails to operate in accordance with the conditions prescribed under this Agreement.

    2. Unless immediate revocation or suspension of operating authorization or suspension of the exercise of the rights mentioned in paragraph 1 of this Article or imposition of conditions therein is essential to prevent further infringements of laws and regulations, such right shall be exercised only after consultation with the other Contracting Party.

    Article 7

    Principles Governing Operation of Agreed Services

    1. There shall be fair and equal opportunity for the designated airline(s) of both Contracting Parties to operate the agreed services on the specified routes.

    2. The agreed services provided by the designated airline(s) of the Contracting Parties shall bear a close relationship to the requirements of the public for transportation on the specified routes and shall have as their primary objective the provision at reasonable load factor of capacity adequate to meet the current and reasonably anticipated requirements for the carriage of passengers and cargo, including mail to or from the area of the Contracting Party which has designated the airline(s). Provision for the carriage of passengers and cargo, including mail taken on board and discharged at points on the specified routes other than points in the area of the Contracting Party which designated the airline(s) shall be made in accordance with the general principles that capacity shall be related to:

    a) traffic requirements to and from the area of the Contracting Party which has designated the airline(s);

    b) traffic requirements of the region through which the agreed service passes, after taking into account of the other transport services established by the airlines of the states comprising the region; and

    c) the requirements of through airline operation.

    Article 8

    Tariffs

    1. The term “tariff” includes one or more of the following:

    a) the fare charged by an airline for the carriage of passengers and their baggage on scheduled air services and the charges and conditions for the services ancillary to such carriage;

    b) the freight rate charged by an airline for the carriage of cargo (excluding mail) on scheduled air services;

    c) the conditions governing the availability or applicability of any such fare or freight rate including any benefits attaching to it; and

    d) the rate of commission paid by an airline to an agent in respect of tickets sold or airway bills completed by that agent for carriage on scheduled services.

    2. The tariffs to be applied by a designated airline(s) of one Contracting Party for carriage to and from the area of the other Contracting Party shall be established at reasonable levels, due regard being paid to all relevant factors, including cost of operation, the interest of users, reasonable profit, the characteristics of each service and the tariffs charged by other airlines.

    3. The Aeronautical Authorities of both Contracting Parties shall not require their airlines to consult other airlines before filing for approval of tariffs for services covered by the following provisions.

    4. The tariffs referred to in paragraph 2 of this Article shall be filed with the Aeronautical Authorities of the Contracting Parties by the designated airline(s) seeking its approval in such form as the Aeronautical Authorities may separately require to disclose the particulars referred to in paragraph 1 of this Article. It shall be filed not less than sixty (60) days (or such shorter period as the Aeronautical Authorities of the Contracting Parties may agree) before the proposed effective date. The proposed tariff shall be treated as having been filed with the Aeronautical Authorities of a Contracting Party on the date on which it is received by those Aeronautical Authorities.

    5. Any proposed tariff may be approved by the Aeronautical Authorities of a Contracting Party at any time and, provided it has been filed in accordance with paragraph 4 of this Article, shall be deemed to have been approved by the Aeronautical Authorities of that Contracting Party unless, within thirty (30) days (or such shorter period as the Aeronautical Authorities of the Contracting Parties may agree) after the date of filing, the Aeronautical Authorities of one Contracting Party have served on the Aeronautical Authorities of the other Contracting Party written notice of disapproval of the proposed tariff.

    6. If a notice of disapproval is given in accordance with the provisions of paragraph 5 of this Article, the Aeronautical Authorities of the Contracting Parties may jointly determine the tariffs. For this purpose, one Contracting Party may, within thirty (30) days of the service of the notice of disapproval, request consultations between the Aeronautical Authorities of the Contracting Parties which shall be held within thirty (30) days from the date the other Contracting Party receives such request in writing.

    7. A tariff already established shall remain in force until a new tariff has been established in accordance with the provisions of this Article.

    Article 9

    Customs Duties

    1. Aircraft operated in international air services by the designated airline(s) of either Contracting Party, their regular equipment, fuel, lubricants, spare parts including engines, and aircraft stores (including but not limited to such items as food, beverages and tobacco) which are on board such aircraft shall be relieved by the other Contracting Party on the basis of reciprocity from all customs duties, excise taxes and similar fees and charges not based on the cost of services provided on arrival, provided such equipment and supplies remain on board the aircraft.

    2. Regular equipment, spare parts, supplies of fuels and lubricants, aircraft stores, printed ticket stock, airway bills, any printed materials which bears the insignia of a designated airline(s) of either Contracting Party and usual publicity material distributed without charge by that designated airline(s), introduced into the area of the other Contracting Party by or on behalf of that designated airline(s) or taken on board the aircraft operated by that designated airline(s) and intended only for use on board such aircraft in the operation of international services shall be relieved by the other Contracting Party on the basis of reciprocity from customs duties, excise taxes and similar fees and charges not based on the cost of services provided on arrival, even when these supplies are to be used on any part of journey performed over the area of the Contracting Party in which they are taken on board.

    3. The items referred to in paragraphs 1 and 2 of this Article may be required to be kept under the supervision or control of the appropriate authorities.

    4. Regular air borne equipment, spare parts, supplies of fuels and lubricants and aircraft stores on board the aircraft of a designated airline(s) of either Contracting Party may be unloaded in the area of the other Contracting Party only with the approval of the customs authorities of that Contracting Party who may require that these materials be placed under their supervision up to such time as they are re-exported or otherwise disposed of in accordance with customs regulations.

    5. The reliefs provided for by this Article shall also be available in situations where a designated airline(s) of either Contracting Party has entered into arrangements with another airline or airlines for the loan or transfer in the area of the other Contracting Party of the items specified in paragraphs 1. and 2. of this Article, provided that such other airline or airlines similarly enjoy such reliefs from such other Contracting Party.

    6. Baggage and cargo in direct transit across the area of a Contracting Party shall be exempt from customs duties, excise taxes and similar fees and charges not based on the cost of services provided on arrival.

    Article 10

    Aviation Security

    1. The Contracting Parties reaffirm that their obligation to each other to protect the security of civil aviation against unlawful interference forms an integral part of this Agreement. The Contracting Parties shall in particular act in conformity with the aviation security provisions of the Convention on Offenses and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at The Hague on 16 December 1970, the Convention for the Suppression of Unlawful Acts Against the Safety of Civil Aviation signed at Montreal on 23 September 1971 and the Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, signed at Montreal on 24 February 1988, as well as with any other convention and protocol relating to the security of civil aviation which has become binding upon both Contracting Parties.

    2. The Contracting Parties shall provide upon request all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports, and air navigation facilities and any other threat to the security of civil aviation.

    3. The Contracting Parties shall, in their mutual relations, act in conformity with applicable aviation security provisions established by the International Civil Aviation Organization and designated as Annexes to the Chicago Convention. They shall require that operators of aircraft of their registry or operators of aircraft having their principal place of business or permanent residency in their area, and the operators of airports in their area, act in conformity with such aviation security provisions.

    4. Each Contracting Party agrees that such operators of aircraft may be required to observe the aviation security provisions referred to in paragraph 3 of this Article required by the other Contracting Party for entry into, departure from, or while within, the area of that other Contracting Party. Each Contracting Party shall ensure that adequate measures are effectively applied within its area to protect the aircraft and to inspect passengers, crew, carry-on items, baggage, cargo and aircraft stores prior to and during boarding or loading. Each Contracting Party shall also give sympathetic consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat.

    5. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such incident or threat thereof.

    Article 11

    Safety

    1. Each Contracting Party may request consultations at any time concerning safety standards in any area relating to aircrews, aircraft or their operation adopted by the other Contracting Party. Such consultations shall take place within thirty (30) days of that request.

    2. If, following such consultations, one Contracting Party finds that the other Contracting Party does not effectively maintain and administer safety standards in any such area that are at least equal to the minimum standards established at that time pursuant to the Chicago Convention, the first Contracting Party shall notify the other Contracting Party of those findings and the steps considered necessary to conform with those minimum standards, and the other Contracting Party shall take appropriate corrective action. Failure by the other Contracting Party to take appropriate action within fifteen (15) days or such longer period as may be agreed shall be grounds for the application of paragraph 1. of Article 6 of this Agreement (revocation or suspension of operating authorisation).

    3. Notwithstanding the obligations mentioned in Article 33 of the Chicago Convention it is agreed that any aircraft operated by or, under a lease arrangement, on behalf of the airline or airlines of one Contracting Party on services to or from the area of the other Contracting Party may, while within the area of the other Contracting Party, be made the subject of an examination by the authorised representatives of the other Contracting Party, on board and around the aircraft to check both the validity of the aircraft documents and those of its crew and the apparent condition of the aircraft and its equipment (in this Article called “ramp inspection”), provided this does not lead to unreasonable delay.

    4. If any such ramp inspection or series of ramp inspections gives rise to:

    a) serious concerns that an aircraft or the operation of an aircraft does not comply with the minimum standards established at that time pursuant to the Chicago Convention; or

    b) serious concerns that there is a lack of effective maintenance and administration of safety standards established at that time pursuant to the Chicago Convention;

    the Contracting Party carrying out the inspection shall, for the purposes of Article 33 of the Chicago Convention, be free to conclude that the requirements under which the certificate or licences in respect of that aircraft or in respect of the crew of that aircraft had been issued or rendered valid or that the requirements under which that aircraft is operated are not equal to or above the minimum standards established pursuant to the Chicago Convention.

    5. In the event that access for the purpose of undertaking a ramp inspection of an aircraft operated by the airline or airlines of one Contracting Party in accordance with paragraph 3. of this Article is denied by a representative of that airline or airlines, the other Contracting Party shall be free to infer that serious concerns of the type referred to in paragraph 4. of this Article arise and draw the conclusions referred in that paragraph.

    6. Each Contracting Party reserves the right to suspend or vary the operating authorisation of an airline or airlines of the other Contracting Party immediately in the event the first Contracting Party concludes, whether as a result of a ramp inspection, a series of ramp inspections, a denial of access for ramp inspection, consultation or otherwise, that immediate action is essential to the safety of an airline operation.

    7. Any action by one Contracting Party in accordance with paragraphs 2. or 6. of this Article shall be discontinued once the basis for the taking of that action ceases to exist.

    Article 12

    Provision of Statistics

    The Aeronautical Authorities of a Contracting Party shall supply to the Aeronautical Authorities of the other Contracting Party at their request such periodic or other statements of statistics as may be reasonably required for the purpose of reviewing the capacity provided on the agreed services by the designated airline(s) of the Contracting Party referred to first in this Article. Such statements shall include all information required to determine the amount of traffic carried by those airlines on the agreed services.

    Article 13

    Transfer of Earnings

    1. The designated airline(s) of the Macao Special Administrative Region shall have the right to convert and remit to the Macao Special Administrative Region on demand local revenues in excess of sums locally disbursed. The designated airline(s) of the Lao People’s Democratic Republic shall have the right to convert and remit to the Lao People’s Democratic Republic on demand local revenues in excess of sums locally disbursed.

    2. Conversion and remittance shall be permitted without restrictions at the rate of exchange applicable to current transactions which is in effect at the time such revenues are presented for conversion and remittance and shall not be subject to any charge except those normally made by banks for carrying out such conversion and remittance.

    Article 14

    Airline Representation

    1. The designated airline(s) of one Contracting Party shall be entitled, in accordance with the laws and regulations relating to entry, residence and employment of the other Contracting Party, to bring in and maintain in the area of the other Contracting Party those of their own managerial, technical, operational and other specialist staff who are required for the provision of air services.

    2. The designated airline(s) of each Contracting Party shall have the right to engage in the sale of air transportation in the area of the other Contracting Party directly and, at its discretion, through its agents. Each airline shall have the right to sell such transportation, and any person shall be free to purchase such transportation, in local currency or in any freely convertible currency.

    Article 15

    User Charges

    1. Neither Contracting Party shall impose or permit to be imposed on the designated airline(s) of the other Contracting Party user charges higher than those imposed on its own airlines operating similar international air services.

    2. Each Contracting Party shall encourage consultation between its competent charging authorities and airlines using the services and facilities, where practicable through the airlines representative organizations. Reasonable notice should be given to users of any proposals for changes in user charges to enable them to express their views before changes are made. Each Contracting Party shall further encourage the competent charging authorities and airlines to exchange appropriate information concerning user charges.

    Article 16

    Consultation

    Either Contracting Party may at any time request consultations on the implementation, interpretation, application or amendment of this Agreement. Such consultation, which may be between Aeronautical Authorities, shall begin within a period of sixty (60) days from the date the other Contracting Party receives a written request, unless otherwise agreed by the Contracting Parties.

    Article 17

    Settlement of Disputes

    1. If any dispute arises between the Contracting Parties relating to the interpretation or application of this Agreement, the Contracting Parties shall in the first place try to settle it by negotiation.

    2. If the Contracting Parties fail to reach a settlement of the dispute by negotiation, it may be referred by them to such person or body as they may agree on or, at the request of either Contracting Party, shall be submitted for decision to a tribunal of three arbitrators which shall be constituted in the following manner:

    a) Within thirty (30) days after receipt of a request for arbitration, each Contracting Party shall appoint one arbitrator. A national of a State which can be regarded as neutral in relation to the dispute, who shall act as President of the tribunal, shall be appointed as the third arbitrator by agreement between the two arbitrators, within sixty (60) days of the appointment of the second;

    b) If within the time limits specified above any appointment has not been made, either Contracting Party may request the President of the Council of the International Civil Aviation Organization to make the necessary appointment within thirty (30) days. If the President considers that he is a national of a State which cannot be regarded as neutral in relation to the dispute, the most senior Vice President who is not disqualified on that ground shall make the appointment.

    3. Except as hereinafter provided in this Article or as otherwise agreed by the Contracting Parties, the tribunal shall determine the limits of its jurisdiction and establish its own procedure. At the direction of the tribunal, or at the request of either of the Contracting Parties, a conference to determine the precise issues to be arbitrated and the specific procedures to be followed shall be held not later than thirty (30) days after the tribunal is fully constituted.

    4. Except as otherwise agreed by the Contracting Parties or prescribed by the tribunal, each Contracting Party shall submit a memorandum within forty-five (45) days after the tribunal is fully constituted. Replies shall be due sixty (60) days later. The tribunal shall hold a hearing at the request of either Contracting Party, or at its discretion, within thirty (30) days after replies are due.

    5. The tribunal shall attempt to give written decision within thirty (30) days after completion of the hearing or, if no hearing is held, after the date both replies are submitted. The decision shall be taken by a majority vote.

    6. The Contracting Parties may submit requests for clarification of the decision within fifteen (15) days after it is received and such clarification shall be issued within fifteen (15) days of such request.

    7. The decision of the tribunal shall be binding on the Contracting Parties.

    8. Each Contracting Party shall bear the cost of the arbitrator appointed by it. The other costs of the tribunal shall be shared equally by the Contracting Parties including any expenses incurred by the President or Vice President of the Council of the International Civil Aviation Organization implementing the procedures in paragraph 2.b) of this Article.

    Article 18

    Amendment

    1. Either Contracting Party may at any time request consultation with the other Contracting Party for the purpose of amending the present Agreement or its Annexes. Such consultation shall begin within a period of sixty (60) days from the date of receipt of such request. Such consultations may be conducted through discussion or by correspondence.

    2. If either of the Contracting Parties considers desirable to amend any provision of this Agreement, such amendment, if agreed between the Contracting Parties, may be applied provisionally from the date on which it is agreed and shall enter into force when confirmed by both Contracting Parties in writing.

    Article 19

    Termination

    Either Contracting Party may at any time give notice in writing to the other Contracting Party of its decision to terminate this Agreement. This Agreement shall terminate at midnight (at the place of receipt of the notice) immediately before the first anniversary of the date of the receipt of such notice by the other Contracting Party, unless the notice is withdrawn by agreement before the end of this period.

    Article 20

    Registration with the International Civil Aviation Organization

    This Agreement and any amendment thereto shall be registered with the International Civil Aviation Organization.

    Article 21

    Entry into Force

    This Agreement shall enter into force as soon as the Contracting Parties have given notice in writing to each other that any necessary procedures have been completed.

    IN WITNESS WHEREOF the undersigned, being duly authorized by their respective Governments, have signed this Agreement.

    Done this 25th day of June 2013 in duplicate at Macao in the Chinese, Portuguese, Lao and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.

    1. No points in inland of China, Taiwan and Hong Kong may be served either as intermediate points or beyond points.

    2. Any of the points on the specified routes in this Annex may at the option of the designated airline(s) of either Contracting Party be omitted on any or all flights, provided that these flights originate or terminate in the area of the Contracting Party designating the airline(s).

    3. The points to be served on the routes specified above are to be jointly determined by the Contracting Parties.
