新西蘭政府與中華人民共和國政府以換文方式就新西蘭在中華人民共和國香港特別行政區保留總領事館達成諒解。按照中央人民政府的命令,行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定,命令公佈新西蘭政府照會的英文正式文本及中華人民共和國政府照會的中文正式文本。

根據上述諒解,自一九九九年十二月二十日中華人民共和國恢復對澳門行使主權之日起,新西蘭駐香港特別行政區總領事館可在澳門特別行政區繼續執行領事職務。

I have the honour to refer to discussions between our two Governments on the maintenance by the Government of New Zealand of its Consulate-General in the Hong Kong Special Administrative Region. Taking note of the relevant provisions of Section XI of Annex I of the Joint Declaration of the Government of the People’s Republic of China and the Government of the United Kingdom of Great Britain and Northern Ireland and of Article 157 of the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China, I propose the following as an understanding between our two Governments:

1. The Government of the People’s Republic of China consents to the maintenance by the Government of New Zealand at its Consulate-General in the Hong Kong Special Administrative Region of the People’s Republic of China.

2. The Government of the People’s Republic of China takes note of the consular function which New Zealand performs in Macau, and consents to the continuation of this function after the Government of the People’s Republic of China resumes the exercise of sovereignty over Macau with effect from 20 December 1999.

3. The Government of the People’s Republic of China will continue, in accordance with the Vienna Convention on Consular Relations of 24 April 1963 and relevant laws and regulations of the People’s Republic of China, to accord necessary assistance and facilities to the Consulate-General of New Zealand in the exercise of consular functions.

4. The operations of the New Zealand Consulate-General in the Hong Kong Special Administrative Region will continue to be regulated by the Vienna Convention on Consular Relations of 24 April 1963. Consular matters will be handled on the basis of equality and mutual benefit and in a friendly and cooperative spirit.

5. This understanding will take effect on 1 July 1997.

I should be grateful for Your Excellency’s confirmation that the above principles meet with the approval of the Government of the People’s Republic of China as a basis for the conduct of consular relations between our two Governments in regard to the Hong Kong Special Administrative Region. The present note and Your Excellency’s affirmative note in reply will constitute an understanding between our two Governments.

我榮幸地收到閣下一九九七年一月二十二日的來照,內容如下:

“我榮幸地提及我們兩國政府關於新西蘭政府在香港特別行政區保留總領事館的商談。考慮到《中華人民共和國政府和大不列顛及北愛爾蘭聯合王國政府關於香港問題的聯合聲明》附件一第十一部分和《中華人民共和國香港特別行政區基本法》第一百五十七條的有關規定,我建議我們兩國政府達成如下諒解:

一、中華人民共和國政府同意新西蘭政府在中華人民共和國香港特別行政區保留總領事館。

二、中華人民共和國政府注意到新西蘭在澳門執行領事職務的情況,並同意自一九九九年十二月二十日中華人民共和國恢復對澳門行使主權之日起,新西蘭繼續執行該職務。

三、中華人民共和國政府將繼續根據一九六三年四月二十四日《維也納領事關係公約》以及中華人民共和國有關法律和規定,為新西蘭總領事館執行領事職務提供必要的協助和便利。

四、新西蘭駐香港特別行政區總領事館的運作將繼續遵循一九六三年四月二十四日《維也納領事關係公約》的規定。領事事務本着友好合作的精神在平等互利的基礎上予以處理。

五、本諒解自一九九七年七月一日起生效。

如蒙閣下確認中華人民共和國政府同意上述原則並以此作為處理我們兩國政府涉及香港特別行政區領事關係的基礎,我將深表謝意。本照會以及閣下的確認覆照將構成我們兩國政府之間的諒解。”

我謹代表中華人民共和國政府確認,同意上述照會內容。
