馬來西亞政府與中華人民共和國政府以換文方式就馬來西亞在中華人民共和國香港特別行政區保留總領事館達成協議。按照中央人民政府的命令，行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定，命令公佈馬來西亞政府照會的英文正式文本及中華人民共和國政府照會的中文正式文本。

根據上述協議，自一九九九年十二月二十日中華人民共和國政府恢復對澳門行使主權後，馬來西亞駐香港特別行政區總領事館可在澳門特別行政區繼續執行領事職務。

I have the honour to refer to the recent meetings between the officials of the Government of Malaysia and the Government of the People’s Republic of China regarding the maintenance by the Government of Malaysia of its Consulate General in the Hong Kong Special Administrative Region of the People’s Republic of China following the resumption of the exercise of sovereignty over Hong Kong by the Government of the People’s Republic of China on 1 July 1997 and propose the following as an agreement between the two Governments.

(i) The Government of the People’s Republic of China agrees to the maintenance by the Government of Malaysia of its Consulate General in Hong Kong Special Administrative Region of the People’s Republic of China;

(ii) The Government of the People’s Republic of China takes note of the Consular function which Malaysia performs in Macao, and agrees to the continuation of this function after the Government of the People’s Republic of China resumes the exercise of sovereignty over Macao with effect from 20 December 1999;

(iii) The operations of the Malaysian Consulate General in the Hong Kong Special Administrative Region are to be regulated by the Vienna Convention on Consular Relations of 24 April 1963. Consular matters are to be handled on the basis of equality and mutual benefit and in a friendly and cooperative spirit; and

(iv) The Government of the People’s Republic of China shall, in accordance with the Vienna Convention on Consular Relations of 24 April 1963 and relevant laws and regulations of the People’s Republic of China accord necessary assistance and facilities to the Consulate General of Malaysia in the Hong Kong Special Administrative Region and its consular officers in the exercise of consular functions.

I would be grateful for Your Excellency’s confirmation that the above principles meet with the approval of the Government of the People’s Republic of China and serve as the basis for the conduct of consular relations between our two Governments in regard to the Hong Kong Special Administrative Region. The present note and Your Excellency’s affirmative note in reply constitute an agreement between our two Governments coming into effect on 1 July 1997.

我榮幸地收到閣下一九九七年五月十四日的來照，內容如下：

“我榮幸地提及馬來西亞政府與中華人民共和國政府官員近期有關一九九七年七月一日中華人民共和國政府對香港恢復行使主權後馬來西亞在中華人民共和國香港特別行政區保留總領事館的會晤，並建議兩國政府達成如下協議：

一、中華人民共和國政府同意馬來西亞政府在中華人民共和國香港特別行政區保留總領事館；

二、中華人民共和國政府注意到馬來西亞在澳門執行領事職務的情況，並同意自一九九九年十二月二十日中華人民共和國政府恢復對澳門行使主權後繼續執行該職務；

三、馬來西亞駐香港特別行政區總領事館的運作得遵循一九六三年四月二十四日《維也納領事關係公約》的規定。領事事務本着友好合作精神在平等互利基礎上予以處理；並

四、中華人民共和國政府將根據一九六三年四月二十四日《維也納領事關係公約》和中華人民共和國有關法律和規定，為馬來西亞駐香港特別行政區總領事館及其領事官員執行領事職務提供必要的協助和便利。

如蒙閣下確認中華人民共和國政府同意上述原則並以此作為處理我們兩國政府涉及香港特別行政區領事關係的基礎，我將深表謝意。本照會以及閣下的確認覆照將構成我們兩國政府間的一項協議，並自一九九七年七月一日起生效。”

我謹榮幸地代表中華人民共和國政府確認，同意上述照會內容。
