Aviso do Chefe do Executivo n.º 59/2011
O Chefe do Executivo manda publicar, nos termos do n.º 1 do artigo 6.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, por ordem do Governo Popular Central, o Acordo entre o Governo da República Popular da China e o Governo do Reino de Espanha relativo à manutenção do Consulado Geral do Reino de Espanha na Região Administrativa Especial de Hong Kong da República Popular da China, assinado em Madrid, em 18 de Junho de 1997, nos seus textos autênticos em línguas chinesa, espanhola e inglesa.
Em conformidade com o referido Acordo, o Consulado Geral do Reino de Espanha na Região Administrativa Especial de Hong Kong pode, a partir da data em que a República Popular da China voltou a assumir o exercício da soberania sobre Macau, em 20 de Dezembro de 1999, exercer funções consulares na Região Administrativa Especial de Macau.

中華人民共和國政府和西班牙王國政府關於西班牙在中華人民共和國香港特別行政區保留總領事館的協定
中華人民共和國政府和西班牙王國政府（以下簡稱“雙方”），本着發展兩國之間友好關係和加強兩國之間領事關係的共同願望，達成協議如下：
一、中華人民共和國政府同意西班牙王國政府在中華人民共和國香港保留總領事館，領區為香港特別行政區。
二、中華人民共和國政府同意西班牙駐香港總領事館自一九九九年十二月二十日中華人民共和國恢復對澳門行使主權之日起在澳門特別行政區執行領事職務。
三、中華人民共和國政府根據一九六三年四月二十四日《維也納領事關係公約》及中華人民共和國有關的法律和規定，為西班牙駐香港總領事館執行領事職務提供必要的協助和 便利。
四、雙方將本着協商合作的精神，根據國際法和國際慣例，友好地處理兩國間的領事問題。
五、本協定自一九九七年七月一日起生效。雙方在此日期前完成本協定生效必須的國內法律和憲法程序，並通知另一方。
下列簽署人經各自政府授權，簽署本協定，以昭信守。
本協定於一九九七年六月十八日在馬德里簽訂，一式兩份，每份都用中文、西班牙文和英文寫成，三種文本同等作準。遇有分歧，以英文文本為準。
ACUERDO ENTRE LOS GOBIERNOS DE LA REPUBLICA POPULAR CHINA Y DEL REINO DE ESPAÑA SOBRE EL MANTENIMIENTO DEL CONSULADO GENERAL DE ESPAÑA EN LA REGION ADMINISTRATIVA ESPECIAL DE HONG KONG DE LA REPUBLICA POPULAR CHINA
El Gobierno de la República Popular China y el Gobierno del Reino de España (denominados en adelante “las Partes”), como muestra del deseo común de desarrollar los lazos amistosos y fomentar las relaciones consulares entre los dos países, acuerdan:
1. El Gobierno de la República Popular China acepta el mantenimiento por el Gobierno del Reino de España de su Consulado General en Hong Kong de la República Popular China, cuya demarcación consular se extenderá a la Región Administrativa Especial de Hong Kong.
2. El Gobierno de la República Popular China está de acuerdo con la extensión de la demarcación consular del Consulado General de España en Hong Kong a la Región Administrativa Especial de Macao a partir del 20 de diciembre de 1999, fecha de la reversión de dicho territorio a la soberanía de la República Popular China.
3. El Gobierno de la República Popular China, de acuerdo con la Convención de Viena sobre Relaciones Consulares del 24 de abril de 1963 y con las leyes y regulaciones aplicables de la República Popular China, aportará la necesaria asistencia y ayuda al Consulado General de España en Hong Kong en el ejercicio de sus funciones consulares.
4. Las Partes tratarán amistosamente, en un espíritu de concertación y colaboración y de conformidad con el Derecho y prácticas internacionales, los problemas consulares entre los dos países.
5. El presente Acuerdo entrará en vigor el 1 de julio de 1997. Las Partes cumplirán con sus requisitos legales y constitucionales internos necesarios para la entrada en vigor del presente Acuerdo antes de esa fecha y lo notificarán a la otra Parte.
En testimonio de lo cual, los abajo firmantes, debidamente autorizados por su respectivo Gobierno, firman el presente Acuerdo.
Hecho por duplicado en Madrid, el 18 de Junio de 1997, en los idiomas chino español e inglés, siendo todos los textos igualmente auténticos. En caso de cualquier divergencia de interpretación, prevalecerá el texto inglés.
AGREEMENT BETWEEN THE GOVERNMENT OF THE PEOPLE’S REPUBLIC OF CHINA AND THE GOVERNMENT OF THE KINGDOM OF SPAIN CONCERNING THE MAINTENANCE BY THE KINGDOM OF SPAIN OF THE CONSULATE-GENERAL IN THE HONG KONG SPECIAL ADMINISTRATIVE REGION OF THE PEOPLE’S REPUBLIC OF CHINA
The Government of the People’s Republic of China and the Government of the Kingdom of Spain (hereinafter referred to as “the two Parties”), out of a common desire to develop friendly relations and enhance consular relations between the two countries, have reached the following Agreement:
1. The Government of the People’s Republic of China agrees to the maintenance by the Government of the Kingdom of Spain of its Consulate-General in Hong Kong of the People’s Republic of China, the consular district of which shall be the Hong Kong Special Administrative Region.
2. The Government of the People’s Republic of China agrees to the performance by the Consulate-General of the Kingdom of Spain in Hong Kong of its consular functions in the Macao Special Administrative Region after the Government of the People’s Republic of China resumes the exercise of sovereignty over Macao with effect from 20 December 1999.
3. The Government of the People’s Republic of China shall, in accordance with the Vienna Convention on Consular Relations of 24 April 1963 and relevant law and regulations of the People’s Republic of China, accord necessary assistance and facilities to the Consulate-General of the Kingdom of Spain in Hong Kong in the exercise of consular functions.
4. The two Parties shall handle consular matters between them in a friendly manner in the spirit of consultation and cooperation, and in accordance with international law and practice.
5. The present Agreement shall enter into force on 1 July 1997. The two Parties shall complete their respective domestic legal and constitutional processes that are necessary to give effect to this Agreement before this date and notify the other Party accordingly.
In witness whereof the undersigned being duly authorised by their respective Governments, have signed this Agreement.
Done in Madrid, on June 18th 1997, in duplicate in the Chinese, Spanish and English languages, all texts being equally authentic. In case of divergence, the English version shall prevail.
