    公佈《中華人民共和國澳門特別行政區政府與中華人民共和國香港特別行政區政府關於持永久性居民身份證入出境及互免填報入出境申報表協議》

    行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定,命令公佈於二零零九年十一月二十四日在香港特別行政區簽署的《中華人民共和國澳門特別行政區政府與中華人民共和國香港特別行政區政府關於持永久性居民身份證入出境及互免填報入出境申報表協議》。

    關於持永久性居民身份證入出境及互免填報入出境
    申報表協議

    中華人民共和國澳門特別行政區政府(“澳方”)和中華人民共和國香港特別行政區政府(“港方”)(雙方統稱“協議方”),為簡便雙方人員入出對方境的手續,在符合雙方法律及考慮實際要求的基礎下,達成以下安排:

    第一條

    一、除第二條所指的情況以外,澳門居民可持有效的智能卡式《澳門特別行政區永久性居民身份證》以訪客身份進出香港,毋須出示其他旅行證件及在進出香港口岸時毋須填寫入出境申報表。

    二、除第二條所指的情況以外,香港居民可持有效的智能卡式《香港特別行政區永久性居民身份證》以訪客身份進出澳門,毋須出示其他旅行證件及在進出澳門口岸時毋須填寫入出境申報表。

    三、按上兩款規定進入另一協議方口岸的人員,入境時會獲發打印的入境記錄紙,當事人在境內逗留時須予以保存,並應該方的執法人員的要求出示記錄紙。

    第二條

    一、按第一條規定進入另一協議方境內的人員須符合該方其他的入境要求。

    二、除以上第一款的規定外,第一條所指的協議一方人員,如屬根據另一協議方的法律或規定須預先取得入境簽證方可入境的外國公民或所持有的旅遊證件是屬於需要簽證類別,則該人員須由另一協議方有權限當局預先批准方可按本協議的安排入境。

    三、協議雙方的有權限當局可根據本方的法律拒絕對方人員入境或逗留,包括基於公眾利益、秩序、安全或衛生等理由。

    四、協議一方的有權限當局應提前七日透過書面方式通知另一協議方的有權限當局關於本條第二款所指的須預先獲得簽證的國家或地區的名單及其變更。

    第三條

    協議一方可主動或應另一協議方要求,在符合本方法律的前提下,向對方提供為實施本協議第二條第二款而必須提供的本方居民的個人資料,包括:

    (1)居民身份證編號、姓名、別名、性別、出生地、出生日期、容貌影像及國籍; 及

    (2)護照、其他身份證明文件及旅行證件的編號、有效期、簽發日期、簽發地點及簽發機關。

    第四條

    協議雙方根據本方的法律規定處理第三條所指的個人資料,須遵守以下原則:

    (1) 按接收資料的協議方指定的目的及在傳送資料一方訂定的條件下使用資料。

    (2) 如應對方要求提供資料,接收資料的協議方須告知傳送資料的一方所要求資料的用途。

    (3) 有關的個人資料只可由負責實施本協議的有權限當局接收及使用。

    (4) 如被傳送的資料不準確或被不合法地傳送,傳送資料的一方應立即通知接收資料的協議方將有關資料更正或銷毀。

    (5) 如有關人員提出要求,傳送資料一方應根據本方的法律,告知與其本人有關的資料傳送的相關資訊。

    (6)協議雙方須保護被傳送的個人資料的安全,避免資料意外地或不法損毀、意外遺失、未經許可的更改、傳播或查閱,以及任何其他方式的不法處理。

    第五條

    一、雙方可透過協商及交換文件對本協議內容作出修改。

    二、上款所指的修改自換文文件中指定的日期起生效。

    第六條

    任何對本協議的解釋或實施而產生的爭議,由協議雙方的有權限當局透過協商解決。

    第七條

    一、基於公眾利益、秩序、安全、衛生或其他理由,協議一方可中止全部或部份本協議,但須提前三十日以書面通知另一方。

    二、如任何一方要求恢復執行本協議被中止的部份,須提前三十日書面通知另一方。

    第八條

    一、本協議的生效日期由協議雙方另行以書面通知確定。

    二、協議一方可隨時書面通知另一方終止本協議。

    三、本協議在收到上款所指的通知之日起計三十日後終止生效。

    本協議於二零零九年十一月二十四日在香港簽訂,每份分別用中文、葡文及英文寫成,三種文本同等作準。

    Agreement Between The Government Of The Macao Special Administrative Region Of The People’s Republic Of China And The Government Of The Hong Kong Special Administrative Region Of The People’s Republic Of China On Entry And Exit With Permanent Resident Identity Card And Mutual Exemption From Filling In Arrival/Departure Cards

    The Macao Special Administrative Region Government of the People’s Republic of China (Macao SAR) and the Hong Kong Special Administrative Region Government of the People’s Republic of China (HKSAR), hereinafter called the “Contracting Parties”, for the purpose of facilitating the entry and exit procedures for the residents of the other side, on the basis of compliance with the law of both parties and having regard to the practical needs, agreed as follows:

    Article 1

    (1) Without prejudice to Article 2, a Macao resident possessing a valid Macao SAR smart permanent identity card shall be able to enter and exit HKSAR as a visitor without producing any other travel document and filling in any arrival/departure card at the time of entering and exiting HKSAR control points.

    (2) Without prejudice to Article 2, a Hong Kong resident possessing a valid HKSAR smart permanent identity card shall be able to enter and exit Macao SAR as a visitor without producing any other travel document and filling in any arrival/departure card at the time of entering and exiting Macao SAR control points.

    (3) A person entering the control points of the other Contracting Party pursuant to the above paragraphs shall be given a printed entry record. That person shall keep the printed record during his or her stay and produce the record upon the request of any law enforcement officials of the aforesaid Party.

    Article 2

    (1) A person entering the territory of the other Contracting Party pursuant to Article 1 shall comply with the immigration requirements of the aforesaid Party.

    (2) Without prejudice to paragraph 1 above, if a person referred to in Article 1 being a foreign national or a holder of a travel document who is subject to visa requirement in accordance with the law or regulations of the other Contracting Party, that person shall obtain the prior approval of the competent authority of the aforesaid Party before entering the territory of that Party under the arrangement of this Agreement.

    (3) The competent authority of either Contracting Party may, in accordance with its law, refuse the entry or stay of a person from the other Party, on grounds including public interest, public order, security or public health.

    (4) The competent authority of a Contracting Party shall inform the competent authority of the other Contracting Party in writing seven days in advance with regard to the list of countries and territories that are bound by visa requirement referred to in Paragraph 2 of this Article or any subsequent changes to the list.

    Article 3

    For the purposes of implementing Paragraph 2 of Article 2 of this Agreement and in accordance with the law of the Contracting Party concerned, that Party may on its own volition or at the request of the other Contracting Party, provide any information on personal data of its residents which is necessary for such implementation to the other Party, including:

    (a) number of identity card, name, aliases, sex, place of birth, date of birth, facial image and nationality; and

    (b) number, validity, date of issue, place of issue and issuing authority of any passports, other identity documents or travel documents.

    Article 4

    The Contracting Parties agree to handle the personal data referred to in Article 3 according to the law of the Contracting party in which the data is processed and shall observe the following principles:

    (a) The recipient Contracting Party shall use the data transmitted only for the purposes specified and in accordance with the conditions prescribed by the transmitting Contracting Party;

    (b) If any information is provided at the request of a Party, the recipient Contracting Party shall inform the transmitting Contracting Party the purposes of obtaining such transmitted data;

    (c) The relevant personal data may only be received and used by the competent authorities responsible for the implementation of this Agreement;

    (d) If the transmitted data is incorrect or has been transmitted unlawfully, the transmitting Contracting Party shall immediately inform the recipient Contracting Party to rectify or destroy the relevant data;

    (e) At the request of the person concerned, the transmitting Contracting Party shall, in accordance with its law, provide him/her the relevant information regarding the transmission of his/her data;

    (f) The Contracting Parties shall protect the transmitted personal data against any accidental or unlawful damage, loss, unauthorized alteration, dissemination or access, and any other mode of illicit handling.

    Article 5

    (1) Both Parties may make any amendment to this Agreement through consultation and exchange of notes.

    (2) The amendment referred to in the above paragraph shall come into effect on the date designated in notes exchanged.

    Article 6

    Any dispute arising from the interpretation or implementation of this Agreement shall be resolved through consultation between the competent authorities of the Contracting Parties.

    Article 7

    (1) Either Contracting Party may suspend, wholly or partially, the provisions of this Agreement on the ground of public interest, public order, security, public health or any other reasons by giving written notice to the other Contracting Party thirty days in advance.

    (2) If any Contracting Party requests for the resumption of the enforcement of the suspended provisions of this Agreement, the request shall be made in writing to the other Contracting Party thirty days in advance.

    Article 8

    (1) The Contracting Parties shall confirm the effective date of this Agreement by way of a separate written notice.

    (2) Either Contracting Party may terminate this Agreement at any time by giving written notice to the other Party.

    (3) This Agreement shall cease to have effect thirty days after the date of receipt of such notification.
