    第42/2002號行政長官公告

    鑑於中華人民共和國已於一九九九年十二月十六日向作為一九七零年三月十八日於海牙簽署的《關於從國外調取民事或商事證據的公約》保管實體之荷蘭王國作出通知,有關公約將繼續在澳門特別行政區適用。

    又鑑於中華人民共和國於二零零零年十一月一日就澳門特別行政區政府的建議通知有關公約的保管實體,對一九九九年十二月十六日的通知書內容作出一項修改。

    行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定,命令公佈中華人民共和國於一九九九年十二月十六日和二零零零年十一月一日作出的通知書。該通知書的中文本、與送交保管實體的文本相符的英文本,以及有關的葡文譯本附同於本公告。

    通知書

    “(…)根據一九八七年四月十三日簽署的《中華人民共和國政府和葡萄牙共和國政府關於澳門問題的聯合聲明》,(以下簡稱《聯合聲明》),中華人民共和國政府將於一九九九年十二月二十日對澳門恢復行使主權。自該日起,澳門將成為中華人民共和國的一個特別行政區,除外交和國防事務屬中華人民共和國中央人民政府管理外,享有高度自治權。

    為此,我奉中華人民共和國外交部長之命通知如下:

    中華人民共和國政府於一九九七年十二月八日交存加入書的、一九七零年三月十八日訂於海牙的《關於從國外調取民事或商事證據的公約》(以下簡稱“公約”),自一九九九年十二月二十日起將適用於澳門特別行政區。同時中華人民共和國政府聲明:

    1. 根據公約第二條的規定,指定澳門特別行政區檢察院為澳門特別行政區的中心當局;

    2. 根據公約第二十三條聲明,澳門特別行政區不執行普通法國家旨在進行審判前文件調查的請求書;

    3. 根據公約第三十三條聲明,除第十五條以外,澳門特別行政區不適用公約第二章的規定;澳門特別行政區不適用公約第四條第二款的規定。

    因該公約適用於澳門特別行政區所產生的國際權利和義務將由中華人民共和國政府承擔。(…)”

    Notification of 16 de December 1999

    "(...) In accordance with the Joint Declaration of the Government of the People's Republic of China and the Government of the Republic of Portugal on the Question of Macao signed on 13 April 1987, the Government of the People's Republic of China will resume the exercise of sovereignty over Macao with effect from 20 December 1999. Macao will from that date, become a Special Administrative Region of the People's Republic of China and will enjoy a high degree of autonomy, except in foreign and defence affairs which are the responsibilities of the Central People's Government of the People's Republic of China.

    In this connection, I am instructed by the Minister of Foreign Affairs of the People's Republic of China to inform Your Excellency of the following:

    The Convention on the Taking of Evidence Abroad in Civil and Commercial Matters, concluded at The Hague on 18 March 1970 (hereinafter referred to as the Convention), to which the Government of the People's Republic of China deposited the instrument of accession on 8 December 1997, shall apply to the Macao Special Administrative Region with effect from 20 December 1999. The Government of the People's Republic of China also wishes to make the following declaration:

    1. In accordance with Article 2 of the Convention, it designates the Procurate of the Macao Special Administrative Region as the Central Authority in the Macao Special Administrative Region.

    2. In accordance with Article 23 of the Convention, it declares that the Macao Special Administrative Region will not execute Letters of Request issued for the purpose of obtaining pre-trial discovery of documents known in Common Law countries.

    3. In accordance with Article 33 of the Convention, it declares that the provisions of Chapter II of the Convention except for Article 15 will not be applicable in the Macao Special Administrative Region; paragraph 2 of Article 4 of the Convention will not be applicable in Macao Special Administrative Region.

    The Government of the People's Republic of China shall assume the responsibility for the international rights and obligations arising from the application of the Convention to the Macao Special Administrative Region. (...)"

    Notificação de 16 de Dezembro de 1999

    "(...) De acordo com a Declaração Conjunta do Governo da República Popular da China e do Governo da República Portuguesa sobre a Questão de Macau, assinada em 13 de Abril de 1987, o Governo da República Popular da China reassumirá o exercício da soberania sobre Macau com efeito a partir de 20 de Dezembro de 1999. A partir dessa data, Macau tornar-se-á uma Região Administrativa Especial da República Popular da China e gozará de um alto grau de autonomia, excepto nos assuntos das relações externas e da defesa, que são da responsabilidade do Governo Popular Central da República Popular da China.

    Neste âmbito, fui instruído pelo Ministro dos Negócios Estrangeiros da República Popular da China para informar Vossa Excelência do seguinte:

    A Convenção sobre a Obtenção de Provas no Estrangeiro em Matéria Civil ou Comercial, concluída na Haia, em 18 de Março de 1970 (de ora em diante designada por Convenção), cujo instrumento de adesão do Governo da República Popular da China foi depositado em 8 de Dezembro de 1997, aplicar-se-á na Região Administrativa Especial de Macau com efeito a 20 de Dezembro de 1999. O Governo da República Popular da China deseja ainda fazer a seguinte declaração:

    1. Em conformidade com o artigo 2.º da Convenção, designa o Ministério Público da Região Administrativa Especial de Macau como autoridade central na Região Administrativa Especial de Macau.

    2. Em conformidade com o artigo 23.º da Convenção, declara que na Região Administrativa Especial de Macau não serão cumpridas as cartas rogatórias que tenham por objecto requisitar actos de "pre-trial discovery of documents", existentes nos países de Common Law.

    3. Em conformidade com o artigo 33.º da Convenção, declara que, com excepção do artigo 15.º, as disposições do Capítulo II da Convenção não serão aplicáveis na Região Administrativa Especial de Macau; o parágrafo 2 do artigo 4.º da Convenção não será aplicável na Região Administrativa Especial de Macau.

    O Governo da República Popular da China assumirá a responsabilidade pelos direitos e obrigações internacionais decorrentes da aplicação da Convenção na Região Administrativa Especial de Macau. (...)"

    二零零零年十一月一日的

    通知書

    “中華人民共和國駐荷蘭王國大使館(…)提及大使館一九九九年十二月十六日(…)的荷外發第(99)-150號照會。該照會確認,一九七○年三月十八日訂於海牙的《關於從國外調取民事或商事證據的公約》(以下簡稱“公約”),自一九九九年十二月二十日起適用於中華人民共和國澳門特別行政區。

    (…)大使館奉命對該照會內容做以下修正:

    一、將照會中提及的“根據公約第二條的規定,指定澳門特別行政區檢察院為澳門特別行政區的中心當局”修正為:

    “根據公約第二十四條的規定,指定澳門特別行政區檢察院為澳門特別行政區的其他機關,負責接收來自另一締約國司法機關的請求書,並將其轉交執行請求的主管機關。

    澳門特別行政區檢察院的地址為:

    澳門新口岸宋玉生廣場

    行政長官辦公室大樓”。

    二、中華人民共和國政府補充聲明如下:

    “根據公約第四條第三款聲明,澳門特別行政區只接收以中文或葡文寫成,或附有中文或葡文譯文的請求書。(…)”

    Notification of 1 November 2000

    "The Embassy of the People's Republic of China to the Kingdom of the Netherlands (...) has the honor to refer to the Embassy's Note No. He Wai Fa (99)-150 forward (...) on 16 December 1999, which confirmed that the Convention on the Taking of Evidence Abroad in Civil or Commercial Matters, concluded at the Hague on 18 March 1970 (hereinafter referred to as "the Convention") would apply to the Macao Special Administrative Region of the People's Republic of China with effect from 20 December 1999.

    (...) the Embassy is instructed to inform the following amendments with respect to the contents of the above-mentioned Note:

    1. The reference in the above-mentioned Note that "in accordance with Article 2 of the Convention, it designates the Procuratorate of the Macao Special Administrative Region as the Central Authority in the Macao Special Administrative Region" shall be amended as follows:

    "In accordance with Article 24 of the Convention, it designates the Procuratorate of the Macao Special Administrative Region as the Other Authority in the Macao Special Administrative Region, which will undertake to receive Letters of Request coming from a judicial authority of another Contracting State and to transmit them to the authority competent to execute them.

    The address of the Procuratorate of the Macao Special Administrative Region is:

    2. The Government of the People's Republic of China also wishes to make the following supplementary declaration:

    "In accordance with paragraph 3 of Article 4 of the Convention, it declares that the Macao Special Administrative Region will only accept Letters of Request in either Chinese or Portuguese, or those accompanied by a translation in either Chinese or Portuguese".

    Notificação de 1 de Novembro de 2000

    "A Embaixada da República Popular da China no Reino dos Países Baixos (...) tem a honra de se referir à Nota da Embaixada n.º He Wai Fa (99)-150, enviada (...) em 16 de Dezembro de 1999, pela qual se confirmou que a Convenção sobre a Obtenção de Provas no Estrangeiro em Matéria Civil ou Comercial, concluída na Haia, em 18 de Março de 1970 (de ora em diante designada por Convenção), seria aplicável na Região Administrativa Especial de Macau da República Popular da China com efeitos em 20 de Dezembro de 1999.

    (...) a Embaixada foi instruída para comunicar as seguintes alterações ao teor da supracitada notificação:

    1. Na supracitada Nota, a referência a que "em conformidade com o artigo 2.º da Convenção, designa o Ministério Público da Região Administrativa Especial de Macau como autoridade central na Região Administrativa Especial de Macau" é emendada como segue:

    "Em conformidade com o artigo 24.º da Convenção, designa o Ministério Público da Região Administrativa Especial de Macau como a outra autoridade na Região Administrativa Especial de Macau a quem compete receber as cartas rogatórias das autoridades judiciais de um outro Estado Contratante e transmiti-las à autoridade competente para as executar."

    A morada do Ministério Público da Região Administrativa Especial de Macau é:

    2. O Governo da República Popular da China deseja igualmente fazer a declaração suplementar seguinte:

    "Em conformidade com o parágrafo 3 do artigo 4.º da Convenção, declara que a Região Administrativa Especial de Macau apenas aceitará cartas rogatórias em chinês ou português, ou acompanhadas de tradução para chinês ou para português."
