    第41/2002號行政長官公告

    鑑於中華人民共和國已於一九九九年十二月十日向作為一九六五年十一月十五日於海牙簽署的《關於向國外送達民事或商事司法文書或司法外文書的公約》保管實體之荷蘭王國作出通知,有關公約將繼續在澳門特別行政區適用。

    又鑑於中華人民共和國於二零零零年十一月一日就澳門特別行政區政府的建議通知有關公約的保管實體,對一九九九年十二月十日的通知書內容作出一項修改。

    行政長官根據澳門特別行政區第3/1999號法律第六條第一款的規定,命令公佈中華人民共和國於一九九九年十二月十日和二零零零年十一月一日作出的通知書。該通知書的中文本、與送交保管實體的文本相符的英文本,以及有關的葡文譯本附同於本公告。

    通知書

    “(…)根據一九八七年四月十三日簽署的《中華人民共和國政府和葡萄牙共和國政府關於澳門問題的聯合聲明》,(以下簡稱《聯合聲明》),中華人民共和國政府將於一九九九年十二月二十日對澳門恢復行使主權。自該日起,澳門將成為中華人民共和國的一個特別行政區,除外交和國防事務屬中華人民共和國中央人民政府管理外,享有高度自治權。

    為此,我奉中華人民共和國外交部長之命通知如下:

    中華人民共和國政府於一九九一年五月三日交存加入書的、一九六五年十一月十五日訂於海牙的《關於向國外送達民事或商事司法文書或司法外文書的公約》(以下簡稱“公約”),自一九九九年十二月二十日起將適用於澳門特別行政區。同時中華人民共和國政府聲明:

    1. 根據公約第六條和第九條的規定,指定澳門特別行政區檢察院,初級法院,中級法院和終審法院為澳門特別行政區的中心當局;

    2. 根據公約第八條第二款聲明,只有在文書須送達給文書發出國國民時,才能採用該條第一款規定的方式在澳門特別行政區進行送達;

    3. 根據公約第十五條第二款聲明,在符合該款規定的各項條件的情況下,即使未收到任何送達或交付的證明,澳門特別行政區的法官仍可不顧該條第一款的規定作出判決;

    4. 根據公約第十六條第三款聲明,在澳門特別行政區,要求免除喪失上訴效果的申請只能在自判決之日起的一年內提出,否則不予受理。

    因該公約適用於澳門特別行政區所產生的國際權利和義務將由中華人民共和國政府承擔。(…)”

    Notification of 10 December 1999

    "(...) In accordance with the Joint Declaration of the Government of the People's Republic of China and the Government of the Republic of Portugal on the Question of Macao signed on 13 April 1987, the Government of the People's Republic of China will resume the exercise of sovereignty over Macao with effect from 20 December 1999. Macao will from that date, become a Special Administrative Region of the People's Republic of China and will enjoy a high degree of autonomy, except in foreign and defence affairs which are the responsibilities of the Central People's Government of the People's Republic of China.

    In this connection, I am instructed by the Minister of Foreign Affairs of the People's Republic of China, to inform Your Excellency of the following:

    The Convention on the Service abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters, concluded at the Hague on 15 November 1965 (hereinafter referred to as the Convention), to which the Government of the People's Republic of China deposited the instrument of accession on 3 May 1991, shall apply to the Macao Special Administrative Region with effect from 20 December 1999. The Government of the People's Republic of China also wishes to make the following declaration:

    1. In accordance with Article 6 and 9 of the Convention, it designates the Procurate, the Primary Courts, the Intermediate Courts and the Court of Final Appeal of the Macao Special Administrative Region as the Central Authorities in the Macao Special Administrative Region.

    2. In accordance with the second paragraph of Article 8 of the Convention, it declares that the means of service stipulated in the first paragraph of that Article may be used within the Macao Special Administrative Region only when the document is to be serviced upon a national of the State in which the document originates.

    3. In accordance with the second paragraph of Article 15 of the Convention, it declares that if all the conditions provided in that paragraph are fulfilled, the judge of the Macao Special Administrative Region, notwithstanding the provisions of the first paragraph of that Article, may give judgement even if no certificate of service or delivery has been received.

    4. In accordance with the third paragraph of Article 16 of the Convention, it declares that in the Macao Special Administrative Region the application for relief from the effects of the expiration of the time for appeal shall not be entertained except that it is filed within one year following the date of the judgement.

    The Government of the People's Republic of China shall assume the responsibility for the international rights and obligations arising from the application of the Convention to the Macao Special Administrative Region. (...)"

    Notificação de 10 de Dezembro de 1999

    "(...) De acordo com a Declaração Conjunta do Governo da República Popular da China e do Governo da República Portuguesa sobre a Questão de Macau, assinada em 13 de Abril de 1987, o Governo da República Popular da China reassumirá o exercício da soberania sobre Macau com efeito a partir de 20 de Dezembro de 1999. A partir dessa data, Macau tornar-se-á uma Região Administrativa Especial da República Popular da China e gozará de um alto grau de autonomia, excepto nos assuntos das relações externas e da defesa, que são da responsabilidade do Governo Popular Central da República Popular da China.

    Neste âmbito, fui instruído pelo Ministro dos Negócios Estrangeiros da República Popular da China para informar Vossa Excelência do seguinte:

    A Convenção relativa à Citação e à Notificação no Estrangeiro dos Actos Judiciais e Extrajudiciais em Matérias Civil e Comercial, concluída na Haia, em 15 de Novembro de 1965 (de ora em diante designada por Convenção), cujo instrumento de adesão do Governo da República Popular da China foi depositado em 3 de Maio de 1991, aplicar-se-á na Região Administrativa Especial de Macau com efeito a 20 de Dezembro de 1999. O Governo da República Popular da China deseja ainda fazer a seguinte declaração:

    1. Em conformidade com os artigos 6.º e 9.º da Convenção, designa o Ministério Público, os Tribunais de Primeira Instância, os Tribunais de Segunda Instância e o Tribunal de Última Instância da Região Administrativa Especial de Macau como autoridades centrais na Região Administrativa Especial de Macau.

    2. Em conformidade com o segundo parágrafo do artigo 8.º da Convenção, declara que as formas de citação ou de notificação previstas no primeiro parágrafo daquele artigo só podem ser usadas na Região Administrativa Especial de Macau quando o documento se destine a um nacional do Estado de origem.

    3. Em conformidade com o segundo parágrafo do artigo 15.º da Convenção, declara que, se todas as condições previstas naquele parágrafo se encontrarem reunidas, o juiz da Região Administrativa Especial de Macau pode julgar, não obstante as disposições do primeiro parágrafo daquele artigo, embora não tenha sido recebido qualquer certificado da citação ou notificação, ou da entrega.

    4. Em conformidade com o terceiro parágrafo do artigo 16.º da Convenção, declara que na Região Administrativa Especial de Macau o pedido para a relevação do efeito peremptório do prazo para recurso não será atendido, salvo se for formulado durante o prazo de um ano a contar da data da decisão.

    O Governo da República Popular da China assumirá a responsabilidade pelos direitos e obrigações internacionais decorrentes da aplicação da Convenção na Região Administrativa Especial de Macau. (...)"

    二零零零年十一月一日的

    通知書

    “中華人民共和國駐荷蘭王國大使館(…)提及大使館一九九九年十二月十日(…)的荷外發第(99)-141號照會。該照會確認,一九六五年十一月十五日訂於海牙的《關於向國外送達民事或商事司法文書或司法外文書的公約》(以下簡稱“公約”),自一九九九年十二月二十日起適用於中華人民共和國澳門特別行政區。

    (…)大使館奉命對該照會內容做以下修正:

    一、將照會中提及的“根據公約第六條和第九條的規定,指定澳門特別行政區檢察院、初級法院、中級法院和終審法院為澳門特別行政區的中心當局”改為:

    “根據公約第十八條的規定,指定澳門特別行政區檢察院為澳門特別行政區的其他機關,負責接受並轉遞來自其他締約國的送達請求書。

    根據公約第六條的規定,指定澳門特別行政區終審法院的法院書記及助理書記為有權出具本條所指的證明書的機關。

    根據公約第九條的規定,指定澳門特別行政區終審法院的法院書記及助理書記為接受其他締約國通過領事途徑轉遞的文書的機關。

    澳門特別行政區檢察院的地址為:

    二、中華人民共和國政府補充聲明如下:

    “根據公約第五條第三款的規定聲明,在澳門特別行政區採用本條第一款規定的方式送達的文書須用中文或葡文寫成,或譯為中文或葡文。(…)”

    Notification of 1 November 2000

    "The Embassy of the People's Republic of China to the Kingdom of the Netherlands (...) has the honor to refer to the Embassy's Note No. He Wai Fa (99)-141 forwarded (...) on 10 December 1999, which confirmed that the Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters, concluded at The Hague on 15 November 1965 (hereinafter referred to as "the Convention"), would apply to the Macao Special Administrative Region of the People's Republic of China with effect from 20 December 1999.

    (...) the Embassy is instructed to inform the following amendments with respect to the contents of the above-mentioned Note:

    1. The reference in the above-mentioned Note that "in accordance with article 6 and article 9 of the Convention, it designates the Procuratorate, the Primary Courts, the Intermediate Courts and the Court of Final Appeal of the Macao Special Administrative Region" shall be amended as follows:

    "In accordance with Article 18 of the Convention, it designates the Procuratorate of the Macao Special Administrative Region as the Other Authority in the Macao Special Administrative Region, which will undertake to receive and transmit Requests for Services coming from other Contracting States.

    In accordance with Article 6 of the Convention, it designates the Court Clerks and Assistant Court Clerks from the Court of Final Appeal of the Macao Special Administrative Region as the authority competent to complete a certificate referred to in this Article.

    In accordance with Article 9 of the Convention, it designates the Court Clerks and Assistant Court Clerks from the Court of Final Appeal of the Macao Special Administrative Region as the authority competent to receive Requests for Service forwarded by other Contracting States through consular channels.

    The address of the Procuratorate of the Macao Special Administrative Region is:

    2. The Government of the People's Republic of China also wishes to make the following supplementary declaration:

    "In accordance with paragraph 3 of Article 5 of the Convention, it declares that documents to be served in the Macao Special Administrative Region under the first paragraph of Article 5 shall be written in either Chinese or Portuguese, or be accompanied by a translation in either Chinese or Portuguese".

    Notificação de 1 de Novembro de 2000

    "A Embaixada da República Popular da China no Reino dos Países Baixos (...) tem a honra de se referir à Nota da Embaixada n.º He Wai Fa (99)-141 enviada (...) em 10 de Dezembro de 1999, que confirmou que a Convenção relativa à Citação e à Notificação no Estrangeiro dos Actos Judiciais e Extrajudiciais em Matérias Civil e Comercial, concluída na Haia, em 15 de Novembro de 1965 (de ora em diante designada por "Convenção") se aplicará na Região Administrativa Especial de Macau da República Popular da China com efeito a 20 de Dezembro de 1999.

    (...) a Embaixada foi instruída para comunicar as seguintes alterações ao teor da supracitada notificação:

    1. A supracitada notificação, onde nela se refere "nos termos dos artigos 6.º e 9.º da Convenção, designa o Ministério Público, os Tribunais de Primeira Instância, os Tribunais de Segunda Instância e os Tribunais de Última Instância da Região Administrativa Especial de Macau" será alterada como segue:

    "Em conformidade com o artigo 18.º da Convenção, designa-se o Ministério Público da Região Administrativa Especial de Macau como a outra autoridade na Região Administrativa Especial de Macau a quem compete receber e transmitir os pedidos de citação e notificação provenientes de outros Estados contratantes.

    Em conformidade com o artigo 6.º da Convenção, designam-se os escrivães de direito e os escrivães adjuntos do Tribunal de Última Instância da Região Administrativa Especial de Macau como a autoridade competente para emitir o certificado a que se refere este artigo.

    Em conformidade com o artigo 9.º da Convenção, designam-se os escrivães de direito e os escrivães adjuntos do Tribunal de Última Instância da Região Administrativa Especial de Macau como a autoridade competente para receber os pedidos de citação ou notificação transmitidos por outros Estados contratantes por via consular.

    A morada do Ministério Público da Região Administrativa Especial de Macau é:

    2. O Governo da República Popular da China deseja ainda fazer a seguinte declaração suplementar:

    "Em conformidade com o parágrafo 3 do artigo 5.º da Convenção, declara que os actos que devam ser objecto de citação ou de notificação na Região Administrativa Especial de Macau ao abrigo do 1 parágrafo do artigo 5.º, terão de ser redigidos em chinês ou português, ou acompanhados de tradução para chinês ou português."
