鑑於中華人民共和國已於一九九九年十月七日通知作為一九六七年五月二十二日訂於日內瓦的《世界衛生組織關於疾病創傷死亡原因分類規則》及其所附的一九七六年五月一日國際疾病分類第九次修改文本保管實體的世界衛生組織總幹事,有關規則將繼續在澳門特別行政區適用;

行政長官根據十二月二十日澳門特別行政區第3/1999號法律第六條第一款,命令公佈中華人民共和國作出的有關通知書。該通知書的中文本、與送交保管實體的文本相符的英文本,以及有關的葡文譯本附同於本公告。

通 知 書

……根據一九八七年四月十三日簽署的《中華人民共和國政府和葡萄牙共和國政府關於澳門問題的聯合聲明》(以下簡稱《聯合聲明》),中華人民共和國政府將於一九九九年十二月二十日對澳門恢復行使主權。自該日起,澳門將成為中華人民共和國的一個特別行政區,除外交和國防事務屬中華人民共和國中央人民政府管理外,享有高度自治權。

《聯合聲明》附件一《中華人民共和國政府對澳門的基本政策的具體說明》第八節和中華人民共和國全國人民代表大會於一九九三年三月三十一日通過的《中華人民共和國澳門特別行政區基本法》第一百三十八條均規定,中華人民共和國尚未參加但已適用於澳門的國際協議仍可繼續適用。

根據上述規定,我奉中華人民共和國外交部長之命通知如下:

目前適用於澳門的一九六七年五月二十二日訂於日內瓦的《世界衛生組織關於疾病創傷死亡原因分類規則》及其所附的一九七六年國際疾病分類第九次修改文本(以下簡稱該規則及其修改文本),自一九九九年十二月二十日起繼續適用於澳門特別行政區。

在上述範圍內,該規則及其修改文本當事方的國際權利和義務將由中華人民共和國政府承擔。……

Notification

"(...) In accordance with the Joint Declaration of the Government of the People's Republic of China and the Government of the Republic of Portugal on the Question of Macao signed on 13 April 1987 (hereinafter referred to as the Joint Declaration), the Government of the People's Republic of China will resume the exercise of sovereignty over Macao with effect from 20 December 1999. Macao will, from that date, become a Special Administrative Region of the People's Republic of China and will enjoy a high degree of autonomy, except in foreign and defence affairs which are the responsibilities of the Central People's Government of the People's Republic of China.

It is provided both in Section VIII of Elaboration by the Government of the People's Republic of China of its Basic Policies Regarding Macao, which is Annex I to the Joint Declaration, and Article 138 of the Basic Law of the Macao Special Administrative Region of the People's Republic of China, which was adopted on 31 March 1993 by the National People's Congress of the People's Republic of China, that international agreements to which the People's Republic of China is not yet a party but which are implemented in Macao may continue to be implemented in the Macao Special Administrative Region.

In accordance with the above provisions, I am instructed by the Minister of Foreign Affairs of the People's Republic of China to inform Your Excellency of the following:

The World Health Organization Regulations regarding Nomenclature (including the Compilation and Publication of Statistics) with Respect to Diseases and Causes of Death, done at Geneva on 22 May 1967 and 9th Revision of the International Classification of Diseases (ICD-9), of 1 May 1976 (hereinafter referred to as the "Regulation and the Revision"), which applies to Macao at present, will continue to apply to the Macao Special Administrative Region with effect from 20 December 1999.

Within the above limit, the Government of the People's Republic of China will assume the responsibility for the international rights and obligations that place on a Party to the Regulation and the Revision. (...)"

Notificação

"(...) De acordo com a Declaração Conjunta do Governo da República Popular da China e do Governo da República Portuguesa sobre a Questão de Macau, assinada em 13 de Abril de 1987 (de ora em diante designada por "Declaração Conjunta"), o Governo da República Popular da China reassumirá o exercício da soberania sobre Macau com efeito a partir de 20 de Dezembro de 1999. Macau tornar-se-á a partir dessa data uma Região Administrativa Especial da República Popular da China e gozará de um alto grau de autonomia, excepto nos assuntos das relações externas e da defesa, que são da responsabilidade do Governo Popular Central da República Popular da China.

Encontra-se estipulado na Secção VIII do "Esclarecimento do Governo da República Popular da China sobre as Políticas Fundamentais respeitantes a Macau", que constitui o Anexo I da Declaração Conjunta, e no artigo 138.º da Lei Básica da Região Administrativa Especial de Macau da República Popular da China, adoptada em 31 de Março de 1993 pela Assembleia Popular Nacional da República Popular da China, que os acordos internacionais de que a República Popular da China ainda não é parte, mas que são aplicados em Macau, poderão continuar a aplicar-se na Região Administrativa Especial de Macau.

Em conformidade com os supracitados preceitos, fui instruído pelo Ministro dos Negócios Estrangeiros da República Popular da China para informar Vossa Excelência do seguinte:

O Regulamento relativo à Nomenclatura (incluindo a Compilação e a Publicação de Estatísticas) das Doenças, Traumatismos e Causas de Morte da Organização Mundial de Saúde, adoptado em Genebra, em 22 de Maio de 1967 e a 9.ª Revisão da Lista da Classificação Internacional de Doenças, de 1 de Maio de 1976 (CID-9) (de ora em diante designados por "Regulamento e Revisão"), actualmente aplicáveis em Macau, continuar-se-ão a aplicar na Região Administrativa Especial de Macau, com efeito a partir de 20 de Dezembro de 1999.

Neste âmbito, o Governo da República Popular da China assumirá a responsabilidade pelos direitos e obrigações internacionais de Parte do Regulamento e da Revisão. (...)"
