Aviso do Chefe do Executivo n.º 52/2011

O Chefe do Executivo manda publicar, nos termos do n.º 1 do artigo 6.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, por ordem do Governo Popular Central, o Acordo entre o Governo da República Popular da China e o Governo da Austrália relativo à continuação do exercício das funções consulares por parte da Austrália na Região Administrativa Especial de Macau da República Popular da China, feito em Camberra, em 8 de Setembro de 1999, nos seus textos autênticos em línguas chinesa e inglesa.

Mais se torna público que o referido Acordo entrou em vigor em 20 de Dezembro de 1999.

Promulgado em 20 de Setembro de 2011.

Agreement between the Government of  the People’s Republic of China and the Government of Australia concerning the Continuation of the Consular Functions by Australia in the Macau Special Administrative Region of the People’s Republic of China

The Government of the People’s Republic of China and the Government of Australia (hereinafter referred to as “the two parties”), out of a common desire to develop further the friendly relations between the two countries, in accordance with Section VIII of Annex I of the Joint Declaration of the Government of the People’s Republic of China and the Government of the Republic of Portugal on the Question of Macau and Article 142 of the Basic Law of the Macau Special Administrative Region of the People’s Republic of China, and taking into account the status quo of the friendly consular relations between China and Australia, have reached the following agreement concerning the continuation of consular functions by Australia in the Macau Special Administrative Region of the People’s Republic of China following the resumption of the exercise of sovereignty over Macau by the Government of the People’s Republic of China on 20 December 1999:

1. The Government of the People’s Republic of China agrees to the continuation by the Government of Australia of consular functions in the Macau Special Administrative Region of the People’s Republic of China through its Consulate General located in the Hong Kong Special Administrative Region of the People’s Republic of China.

2. The Government of the People’s Republic of China shall, in accordance with the Vienna Convention on Consular Relations of 24 April 1963 and the relevant laws and regulations of the People’s Republic of China, accord necessary assistance and facilities to the Consulate General of Australia in the exercise of consular functions.

3. The operations in the Macau Special Administrative Region of the Australian Consulate General, Hong Kong, shall be regulated by the Vienna Convention on Consular Relations of 24 April 1963. Consular matters shall be handled on the basis of equality and mutual benefit and in a friendly and cooperative spirit.

4. The Agreement shall enter into force on 20 December 1999 subject to the parties completing their respective domestic legal processes that are necessary to give effect to the Agreement and notification thereof.

IN WITNESS WHEREOF the undersigned, being duly authorised by their respective Governments, have signed this Agreement.

DONE in duplicate at Canberra on the eighth day of September, 1999, in the Chinese and English languages, both texts being equally authentic.
