    第16/2001號行政長官公告

    鑑於中華人民共和國已於一九九九年十二月二日通知作為一九六六年十二月十六日訂於紐約的《公民權利和政治權利國際公約》保管實體的聯合國秘書長,有關公約將繼續在澳門特別行政區適用;

    行政長官根據澳門特別行政區第3/1999號法律第六條第一款,命令公佈中華人民共和國作出的有關通知書。該通知書的中文本、與送交保管實體的文本相符的英文本,以及有關的葡文譯本附同於本公告。

    通知書

    ......根據一九八七年四月十三日簽署的《中華人民共和國政府和葡萄牙共和國政府關於澳門問題的聯合聲明》(以下簡稱《聯合聲明》),中華人民共和國政府將於一九九九年十二月二十日對澳門恢復行使主權。自該日起,澳門將成為中華人民共和國的一個特別行政區,除外交和國防事務屬中華人民共和國中央人民政府管理外,享有高度自治權。

    《聯合聲明》附件一《中華人民共和國政府對澳門的基本政策的具體說明》第八節和中華人民共和國全國人民代表大會於一九九三年三月三十一日通過的《中華人民共和國澳門特別行政區基本法》第一百三十八條均規定,中華人民共和國尚未參加但已適用於澳門的國際協議仍可繼續適用。

    根據上述規定,我奉中華人民共和國外交部長之命通知如下:

    目前適用於澳門的一九六六年十二月十六日訂於紐約的《公民權利和政治權利國際公約》(以下簡稱“公約”),自一九九九年十二月二十日起將繼續適用於澳門特別行政區,同時中華人民共和國政府聲明:

    l、公約在澳門特別行政區適用,特別是公約第一條,不影響《聯合聲明》和《基本法》關於澳門地位的規定。

    2、公約第十二條第四款和第十三條,涉及人員出入境及驅逐外國人出境,不在澳門特別行政區適用。有關事宜仍按《聯合聲明》、《基本法》和澳門特別行政區有關法律的規定辦理。

    3、公約第二十五條b項,涉及根據《聯合聲明》和《基本法》確定的由選舉產生機構的組成及其成員的選擇與選舉方式,不在澳門特別行政區適用。

    4、公約適用於澳門特別行政區的有關規定通過澳門特別行政區的法律予以實施。

    澳門居民享有的權利和自由除依法規定外不得限制,此種限制不得與公約適用於澳門特別行政區的有關規定抵觸。

    在上述範圍內,該公約當事方的國際權利和義務將由中華人民共和國政府承擔。......

    Notification

    "(...) In accordance with the Joint Declaration of the Government of the People's Republic of China and the Government of the Republic of Portugal on the Question of Macao signed on 13 April 1987 (hereinafter referred to as the Joint Declaration), the Government of the People's Republic of China will resume the exercise of sovereignty over Macao with effect from 20 December 1999. Macao will, from that date, become a Special Administrative Region of the People's Republic of China and will enjoy a high degree of autonomy, except in foreign and defence affairs which are the responsibilities of the Central People's Government of the People's Republic of China.

    It is provided both in Section VIII of Elaboration by the Government of the People's Republic of China of its Basic Policies Regarding Macao, which is Annex I to the Joint Declaration, and Article 138 of the Basic Law of the Macao Special Administrative Region of the People's Republic of China (hereinafter referred to as the Basic Law) which was adopted on 31 March 1993 by the National People's Congress of the People's Republic of China, that international agreements to which the People's Republic of China is not yet a party but which are implemented in Macao may continue to be implemented in the Macao Special Administrative Region.

    In accordance with the above provisions, I am instructed by the Minister of Foreign Affairs of the People's Republic of China to inform Your Excellency of the following:

    The International Covenant on Civil and Political Rights, adopted at New York on 16 December 1966 (hereinafter referred to as the "Covenant"), which applies to Macao at present, will continue to apply to the Macao Special Administrative Region with effect from 20 December 1999. The Government of the People's Republic of China also wishes to make the following declaration:

    1. The application of the Covenant, and its Article 1 in particular, to the Macao Special Administrative Region shall not affect the status of Macao as defined in the Joint Declaration and in the Basic Law.

    2. Paragraph 4 of Article 12 and Article 13 of the Covenant shall not apply to the Macao Special Administrative Region with respect to the entry and exit of individuals and the expulsion of aliens from the territory. These matters shall continue to be regulated by the Provisions of the Joint Declaration and the Basic Law and other relevant laws of the Macao Special Administrative Region.

    3. Paragraph b of Article 25 of the Covenant shall not apply to the Macao Special Administrative Region with respect to the composition of elected bodies and the method of choosing and electing their officials as defined in the Joint Declaration and the Basic Law.

    4. The provisions of the Covenant which are applicable to the Macao Special Administrative Region shall be implemented in Macao through legislation of the Macao Special Administrative Region.

    The residents of Macao shall not be restricted in the rights and freedoms that they are entitled to, unless otherwise provided for by law. In case of restrictions, they shall not contravene the provisions of the Covenant that are applicable to the Macao Special Administrative Region.

    Within the above ambit, the Government of the People's Republic of China will assume the responsibility for the international rights and obligations that place on a Party to the Covenant. (...)"

    Notificação

    "(...) De acordo com a Declaração Conjunta do Governo da República Popular da China e do Governo da República Portuguesa sobre a Questão de Macau, assinada em 13 de Abril de 1987 (de ora em diante designada por Declaração Conjunta), o Governo da República Popular da China reassumirá o exercício da soberania sobre Macau com efeito a partir de 20 de Dezembro de 1999. Macau tornar-se-á a partir dessa data uma Região Administrativa Especial da República Popular da China e gozará de um alto grau de autonomia, excepto nos assuntos das relações externas e da defesa, que são da responsabilidade do Governo Popular Central da República Popular da China.

    Encontra-se estipulado na Secção VIII do "Esclarecimento do Governo da República Popular da China sobre as Políticas Fundamentais Respeitantes a Macau", que constitui o Anexo I da Declaração Conjunta, e no artigo 138.º da Lei Básica da Região Administrativa Especial de Macau da República Popular da China (de ora em diante designada por Lei Básica), adoptada em 31 de Março de 1993 pela Assembleia Popular Nacional da República Popular da China, que os acordos internacionais de que a República Popular da China ainda não é parte, mas que são aplicados em Macau, poderão continuar a aplicar-se na Região Administrativa Especial de Macau.

    Em conformidade com os supracitados preceitos, fui instruído pelo Ministro dos Negócios Estrangeiros da República Popular da China para informar Vossa Excelência do seguinte:

    O Pacto Internacional sobre os Direitos Civis e Políticos, adoptado em Nova Iorque, em 16 de Dezembro de 1966 (de ora em diante designado por "Pacto"), actualmente aplicável em Macau, continuar-se-á a aplicar na Região Administrativa Especial de Macau, com efeito a partir de 20 de Dezembro de 1999. O Governo da República Popular da China deseja ainda fazer a seguinte declaração:

    1. A aplicação do Pacto na Região Administrativa Especial de Macau e, em particular do seu artigo 1.º, não afecta o estatuto de Macau tal como se encontra definido na Declaração Conjunta e na Lei Básica.

    2. O n.º 4 do artigo 12.º e o artigo 13.º do Pacto não se aplicam na Região Administrativa Especial de Macau no que se refere à entrada e saída de pessoas e à expulsão de estrangeiros do território. Estas matérias continuarão a ser reguladas pelas disposições da Declaração Conjunta e da Lei Básica e demais legislação pertinente da Região Administrativa Especial de Macau.

    3. A alínea b) do artigo 25.º do Pacto não se aplica na Região Administrativa Especial de Macau no que se refere à composição dos órgãos eleitos e ao método de escolha e eleição dos seus titulares, tal como se encontram definidos na Declaração Conjunta e na Lei Básica.

    4. As disposições do Pacto aplicáveis na Região Administrativa Especial de Macau são implementadas em Macau através de legislação da Região Administrativa Especial de Macau.

    Os direitos e liberdades de que os residentes de Macau são titulares não serão restringidos excepto nos casos previstos por lei. Em caso de restrições, estas não contrariarão as disposições do Pacto aplicáveis na Região Administrativa Especial de Macau.

    Neste âmbito, o Governo da República Popular da China assumirá a responsabilidade pelos direitos e obrigações internacionais de Parte do Pacto. (...)"
