    Publicação do Acordo sobre a Dispensa Mútua de Vistos entre o Governo da Região Administrativa Especial de Macau da República Popular da China e o Governo da República da Bulgária

    O Chefe do Executivo manda publicar, nos termos do n.º 1 do artigo 6.º e da alínea 2) do artigo 5.º da Lei n.º 3/1999 da Região Administrativa Especial de Macau, o Acordo sobre a Dispensa Mútua de Vistos entre o Governo da Região Administrativa Especial de Macau da República Popular da China e o Governo da República da Bulgária.

    互免簽證協定

    獲得中華人民共和國中央人民政府正式授權簽訂本協定的中華人民共和國澳門特別行政區政府和保加利亞共和國政府 (以下簡稱“締約雙方”),為了方便旅遊並藉此促進雙方的友好關係的發展,達成以下協議:

    第一條

    (一)持有本協定附件所列有效旅行證件的持有人,可免辦簽證進入或過境締約另一方境內,由首次入境當天起計六個月內逗留不超過九十日。

    (二)本條第一款所指的人應從向國際旅客開放的通行口岸進入及離開締約另一方。

    第二條

    第一條所指的人倘入境締約另一方逗留多於九十日,或為受僱或教育的目的,須事先取得該締約方有權限當局的簽證。

    第三條

    本協定不免除第一條所指的人應遵守在締約另一方生效的法律和法規的義務。

    第四條

    對於第一條中所指的人,基於公眾安全、公眾衛生或公眾秩序的理由,或倘其被認為不受歡迎,締約任一方保留拒絕其進入或終止其在境內逗留的權利。

    第五條

    (一)為達到本協定的目的,締約雙方應在本協定簽署後並在生效日前最少三十日交換附件所列的有效證件的樣本。

    (二)倘更新有效旅行證件的式樣或啟用新的旅行證件,締約雙方應在其啟用之前最少三十日交換這些證件的樣本及其使用上的必要資料。

    第六條

    第一條所指的人的旅行證件在締約另一方境內遺失、被竊或損毀,應盡快向當地的有權限當局報案及應獲發出確認此事實的文件。

    第七條

    如在適用本協定的過程中發生爭論或分歧,締約雙方應以協商及徵詢的方式將其解決。

    第八條

    任何經締約雙方同意的對本協定的修改,應透過書面通知方式為之。

    第九條

    (一)基於公眾安全、公眾秩序或公眾衛生理由,締約任一方可以書面通知締約另一方,臨時中止本協定全部或部份條款。中止應即時生效並一直生效至另行通知為止。

    (二)締約任一方在採用本條第一款的措施後,應正式通知締約另一方予以解除。

    第十條

    (一)本協定不設限期並於收到最後由締約雙方均已互相通知完成所有內部法律程序的通知之日起三十日後生效。

    (二)締約任一方可書面通知締約另一方終止本協定。在此情況下,協定將在收到該通知之日起三十日後失效。

    本協定於二○五年四月八日在澳門特別行政區簽訂,一式兩份, 每份分別用中文、保加利亞文和英文寫成,三種文本同等作準。如在解釋上遇有分歧,以英文文本為準。

    附件

    為本協定的目的,有效旅行證件包括:

    (一)中華人民共和國澳門特別行政區方面:

    a) 中華人民共和國澳門特別行政區護照。

    (二)保加利亞共和國方面:

    a)普通護照;

    b)外交護照;

    c)公務護照;

    d)海員護照。

    СПОГОДБА

    МЕЖДУ

    ПРАВИТЕЛСТВОТО НА

    СПЕЦИАЛЕН АДМИНИСТРАТИВЕН РАЙОН МАКАО НА КИТАЙСКАТА НАРОДНА РЕПУБЛИКА И

    ПРАВИТЕЛСТВОТО НА РЕПУБЛИКА БЪЛГАРИЯ

    ЗА ПРЕМАХВАНЕ НА ИЗИСКВАНИЯТА ЗА ВИЗИ

    Правителството на Специален Административен Район Макао на Китайската народна република, надлежно упълномощено да сключи настоящата Спогодба от Централното Народно Правителство на Китайската народна република и Правителството на Република България, наричани по-нататък “Договарящите страни”,

    водени от желанието си да улеснят пътуванията и по този начин да съдействат за развитието на приятелските отношения помежду си,

    се договориха за следното:

    Член 1

    1. Притежателите на валидни документи за пътуване, посочени в Приложението към настоящата Спогодба, се освобождават от изискването за виза за влизане и транзитно преминаване през територията на другата Договаряща страна за срок до 90 (деветдесет) дни в рамките на шест месеца, считано от датата на тяхното първо влизане.

    2. Лицата по алинея 1, на този член влизат и напускат територията на другата Договаряща страна през граничните пунктове, открити за международен пътнически трафик.

    Член 2

    Лицата по чл.1, които влизат на територията на другата Договаряща страна за срок по-дълъг от 90 (деветдесет) дни или с цел упражняване на трудова дейност или обучение, трябва предварително да се снабдят с виза от компетентните органи на съответната договаряща страна.

    Член 3

    Настоящата Спогодба не освобождава лицата по чл.1 от задължението да спазват законите и разпоредбите, действащи на територията на другата договаряща страна.

    Член 4

    Всяка Договаряща страна си запазва правото да откаже влизане или да прекрати пребиваването на своя територия на лицата по чл.1 по причини, свързани с обществената сигурност, общественото здраве или обществения ред, или в случай, че тези лица се считат за нежелани.

    Член 5

    1. Договарящите страни, след подписване на настоящата спогодба, но не по-късно от 30 (тридесет) дни преди влизането й в сила, си разменят образци от валидните документи за целите на Спогодбата, посочени в Приложението към нея.

    2. В случай на изменение на валидните документи за пътуване или въвеждане на нови такива, Договарящите страни си разменят образци от тях заедно с цялата необходима информация, свързана с ползването на тези документи най-късно 30 (тридесет) дни преди датата на въвеждането им.

    Член 6

    Лицата по чл.1, чиито документи за пътуване са били загубени, откраднати или повредени на територията на другата Договаряща страна, са длъжни незабавно да уведомят местните компетентни органи, които им издават документ, потвърждаващ тяхното заявление.

    Член 7

    Ако в хода на приложение на настоящата Спогодба възникнат спорове или разногласия, договарящите страни ги уреждат посредством преговори и консултации.

    Член 8

    Всяко изменение на настоящата Спогодба, договорено между договарящите страни, влиза в сила чрез размяна на писмени уведомления.

    Член 9

    1. Всяка Договаряща страна може временно да преустанови, изцяло или отчасти, действието на настоящата Спогодба на основание на причини, свързани със защита на обществената сигурност, обществения ред или общественото здраве, като писмено уведоми за това другата Договаряща страна. Преустановяването влиза в сила незабавно и остава в сила до последващо уведомление.

    2. Договарящата страна, която е въвела мерките по алинея , на този Член, надлежно уведомява другата договаряща страна за отмяната на тези мерки.

    Член 10

    Настоящата Спогодба се сключва за неопределен срок и влиза в сила 30 (тридесет) дни след получаване на последното писмено уведомление, с които договарящите страни се уведомяват взаимно за изпълнение на вътрешноправните процедури, необходими за влизането й в сила.

    Всяка договаряща страна може да прекрати валидността на настоящата Спогодба, като уведоми писмено за това другата Договаряща страна. В такъв случай Спогодбата става невалидна 30 (тридесет) дни след датата на получаване на такова уведомление.

    Изготвена в САР Макао на 8 април 2005 г. в два еднакви екземпляра, всеки от които на китайски, български и английски език, като и трите текста имат еднаква сила. В случай на различия при тълкуване, английският текст се счита за меродавен.

    1. За Специален Административен Район Макао на Китайската народна република

    a) паспорт на Специален Административен Район Макао на Китайската народна република.

    2. За Република България:

    а) паспорт;

    б) дипломатически паспорт;

    в) служебен паспорт;

    г) моряшки паспорт.

    AGREEMENT
    BETWEEN

    THE GOVERNMENT OF THE MACAO SPECIAL ADMINISTRATIVE REGION OF
    THE PEOPLE'S REPUBLIC OF CHINA

    AND

    THE GOVERNMENT OF THE REPUBLIC OF BULGARIA
    ON THE ABOLITION OF VISA REQUIREMENTS

    The Government of the Macao Special Administrative Region of the People's Republic of China, which has been duly authorized to conclude this Agreement by the Central People's Government of the People's Republic of China, and the Government of the Republic of Bulgaria, hereinafter referred to as the «Contracting Parties»,

    desiring to facilitate travels and thus to promote the development of friendly relations between them,

    have agreed as follows:

    Article 1

    1. Holders of valid travel documents, specified in the Annex to this Agreement, shall be exempted from visa requirements for entry into or transit through the territory of the other Contracting Party for up to 90 (ninety) days within a period of six months as from the date of their first entry.

    2. Persons referred to in paragraph 1 of this Article, shall enter and leave the territory of the other Contracting Party through the border crossing points open to international passenger traffic.

    Article 2

    Persons referred to in Article 1 who enter into the territory of the other Contracting Party for a period exceeding 90 (ninety) days or to take up employment, or for educational purposes should obtain a visa in advance from the competent authorities of the respective Contracting Party.

    Article 3

    This Agreement does not exempt the persons mentioned in Article 1 from the obligation to abide the laws and regulations in force in the territory of the other Contracting Party.

    Article 4

    Either Contracting Party reserves the right to refuse the entry or to terminate the term of stay on its territory of persons mentioned in Article 1 for reasons of public security, public health or public order or in case they are considered undesirable.

    Article 5

    1. The Contracting Parties, upon the signing of this Agreement but not later than 30 (thirty) days prior to its entry into force, shall exchange specimens of the valid documents for the purposes of this Agreement as listed in the Annex hereto.

    2. In case of any modification of the valid travel documents or introduction of new ones, the Contracting Parties shall exchange specimens thereof along with all the necessary information bearing upon the use of these documents not later than 30 (thirty) days prior to the date of their introduction.

    Article 6

    Persons mentioned in Article 1 whose travel documents have been lost, stolen or damaged on the territory of the other Contracting Party shall be required to promptly inform the local competent authorities, which shall issue a document confirming this fact.

    Article 7

    If disputes or disagreements arise in the course of application of this Agreement, the Contracting Parties shall settle them by negotiations and consultations.

    Article 8

    Any amendment of this Agreement agreed upon by the Contracting Parties shall be effected by exchange of letters.

    Article 9

    1. Either Contracting Party may temporarily suspend, in whole or in part, this Agreement on the grounds of protection of public security, public order or public health, by notifying the other Contracting Party in writing. The suspension shall become effective immediately and shall remain in force until further notice.

    2. The Contracting Party, which has introduced the measures under Paragraph 1 of this Article, shall duly notify the other Contracting Party of their revocation.

    Article 10

    1. This Agreement is concluded for an indefinite period of time and shall enter into force 30 (thirty) days after the receipt of the notice in writing by which the Contracting Parties have informed each other of the completion of all internal legal procedures required for its entry into force.

    2. Either Contracting Party may terminate the validity of this Agreement by notifying in writing the other Contracting Party to that effect. In this case the Agreement shall become ineffective 30 (thirty) days after the date of receipt of such a notification.

    Done at Macao SAR on 8 April 2005 in two originals, each of them in Chinese, Bulgarian and English languages, all text being equally authentic. In case of any divergence of interpretation, the English text shall prevail.

    ANNEX

    Valid travel documents for the purposes of this Agreement shall be as follows:

    1. For the Macao Special Administrative Region of the People's Republic of China:

    a) passport of the Macao Special Administrative Region of the People's Republic of China.

    2. For the Republic of Bulgaria:

    a) ordinary passport;

    b) diplomatic passport;

    c) service passport;

    d) seaman's passport.
